CONIbIIT AN ASSAULT ON ANOTH- ER rEMSON WITHIN THE LIMI'T'S OF THE VILLAGE OF CHUBBUCK: MAKING IT UNLAWFUL FOR ANY PERSON TO COMMIT A BATTERY UPON ANOTHER PERSON WITHIN THE LIMITS OF THE VILLAGE OF CHUABUCK: DEFINING THE WORD ASSAULT; DEFINING THE WORD ,BATTERY; PROVIDING A PENALTY FOR THE VIOLATION OF THIS OR -j]. DINANCE; AND REPEALING ALL ORDINANCES AND PARTS OF OR- DINANCES IN CONFLICT WITH THIS ORDINANCE, 13Z IT ORDAINED BY THE CHAIR- MAN AND THE BOARD OF TRUS- TEES OF THE VILLAGE OF CHUA- BUCK, BANNOCK COUNTY, IDAHO: - Section 1. The word "assault" as used in this ordinance is defined*s. an unlawful attempt coupled with a Present ability to commit a violent injury on the pefson of another. Section 2. The word "battery" as l used in this ordinance is any willful) and unlawful use of force or viol!nce upon the person of another. Section 3. It shall be unlawful for ,any person to commit an assault or commit a battery as those terms are jj herein defined within the villagelgl its of the Village of _ Chubbuck, an - nock County, Idaho. Section 4. Any person violating the Provisions of this ordinance shall, up- on conviction, be fined in a sum of not exceeding One Hundred Do11arS, -and in addition thereto the costs in- volved, and in default of the pal'-' -.MOW Of such fine and costs to bel cokiPined in jail at the rate of one day for each $1.50 of such fine and costs X90 imposed, Section 5. All ordinances and parts i of ordinances in conflict with this itirdinance are hereby repealed. It shall be unlawful for anp person or persons within the vill- age limits of the Village of Chubl)uck, Bannock County, Idaho, to willfully, on. 211alfcfously, or intentionally, Or unnecessarily disturb the peace and quiet of another, or of all ]load, family, or other public assem- blv by loud Or unusual tmises, or b indecent bellaviory , offensive or un_ becoming conduct, or threatening language, or quarreling, or fighting, or provoking an assault or battery, or 1153119 Of vulgar or indecent language in the presence of others, Section 2. Any person vioiating the Provisions of this ordinance shall, up- on conviction, be fined in a sum of not exceeding One Hundred Dollars,' and in addition thereto the costs in- volved, and indefault of the payment of such fine and costs to be con- fined in jail at the rate of one day for each $1.50 of such fine and costs SO imposed.
