0770 Amending Snow RestrictionCITY OF CHUBBUCK, IDAHO ORDINANCE NO. -7"7 Q AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 10. 12.030 TO CHANGE THE DEPTH OF SNOW FOR AN AUTOMATIC SNOW RESTRICTION ON PARKING TO SIX INCHES; ADDING SECTION 10. 12.120 TO INCORPORATE THE CITY OF CHUBBUCK SNOW AND ICE CONTROL POLICIES AND PROCEDURE MANUAL; AMENDING SECTION 9.08.020 TO INCLUDE THE DEPOSIT OF SNOW; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS OF CHAPTERS 10.12 AND 9.08 NOT AMENDED SHALL REMAIN IN EFFECT; AND PROVIDING WHEN THIS ORDINANCE IS EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Amended Section 10.12.030. Section 10.12.030 is amended as follows: 10.12.030. Parking on Streets A. Whenever the mayor finds, on the basis of falling snow, sleet, freezing rain, or on the basis of a forecast by the U.S. weather bureau of snow, sleet, or freezing rain, that weather conditions will make it necessary that motor vehicle traffic be expedited and that parking on city streets be prohibited or restricted for snow plowing and other purposes, the mayor shall put into effect a parking prohibition on parts of or all streets as necessary by declaring it in a manner prescribed by this chapter. The prohibition shall remain in effect until terminated by announcement of the mayor in accordance with this chapter, except that any street area which has become substantially clear of snow and ice from curb to curb for the length of the entire block shall be automatically excluded therefrom. B. Notwithstanding the provisions of subsection A of this section, a parking prohibition shall automatically go into effect on any part of any street on which there has been an accumulation of snow and ice of three inches six inches (6") or more in any day. C. While the prohibition is in effect, no person shall park or allow to remain parked any vehicle on any street to which it applies during the time from seven o'clock (7:00) A.M. until seven o'clock (7:00) P.M. except where the street has been substantially cleared of snow and ice from curb to curb for the length of the entire block. D. However, nothing in this section shall be construed to permit parking at any time or place where it is forbidden by any other provision of law. Section 2. New Section 10.12.120. The following Section 10. 12.120 is hereby added to the Chubbuck Municipal Code: 10.12.120. Snow Removal Policy / Procedures: Snow removal operations shall be completed in accordance with the City of Chubbuck Snow and Ice Control Policies and Procedures Manual as adopted from time to time by resolution of the Chubbuck City Council. Ordinance - Page 1 chubbuck 111617 snow ord.wpd Section 3. Amended Section 9.08.020. Section 9.08.020 is amended as follows: 9.08.020. Deposits of Injurious Material on bight of Way. A. It is unlawful for any person to deposit, place or allow to remain in or upon any public right of way any material or substance injurious to persons or property. B. No person shall cause or allow grass clippings, dirt, dust, solid waste, snow, or other material generated on or originating on nonpublic property to be placed, swept, blown with a portable blower or other device, or otherwise deposited onto or into any part of the public rights of way of the city of Chubbuck. Specific exemptions to this requirement are provided for with respect to organized citywide or neighborhood cleanups where parties have made specific arrangements with the city of Chubbuck sanitation department for pick up and removal of solid waste materials. C. Any person who causes or allows grass clippings, dirt, dust, solid waste, or other material generated on or originating on nonpublic property to be placed, swept, blown with a portable blower or other device, or otherwise deposited onto or into any part of the public rights of way of the city of Chubbuck shall be guilty of a misdemeanor and subject to the provisions of chapter 1.12 of this code. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City and any provision of the Municipal Code which are in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. All other sections of Chapter s 10.12 and 9.08 not herein amended shall remain in effect. Section 2. Severability. The sections of this ordinance are severable. The invalidity of a section shall not affect the validity of the remaining sections. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall become effective upon its passage, approval and publication.
