ORDINANCE NO. 3j
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR
CHANGE OF LAND USE DISTRICT WITH RESPECT TO CERTAIN LANDS DESCRIBED
AS 1). ANTLER RIDGE APARTMENTS NORTH OF EAST CHUBBUCK ROAD AND
WEST OF KAYS KOVE SUBDIVISION - FROM LIMITED RESIDENTIAL (R-2) TO
PLANNED UNIT DEVELOPMENT (PUD); 2). JENSEN'S COVE SUBDIVISION AT THE
CORNER OF TREE VALLEY ROAD AND GARDEN DRIVE- FROM AGRICULTURAL (A)
TO SINGLE FAMILY RESIDENTIAL (R-1); AND 3). LUCKY LANE APARTMENTS PUD
AT 5202 LUCKY STREET FROM LIMITED RESIDENTIAL (R-2) TO PLANNED UNIT
DEVELOPMENT (PUD), ALL OF WHICH ARE WITHIN THE BOUNDARIES OF THE
CITY OF CHUBBUCK AND WHICH LANDS ARE MORE PARTICULARLY DESCRIBED
IN THE ORDINANCE; DECLARING THAT THE CITY COUNCIL FINDS THAT SUCH
CHANGE IN LAND USE PATTERN IS CONSISTENT WITH THOSE PRESCRIBED BY
THE CITY'S COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1. Change of Land Use District. The land use district established by the
Chubbuck Land Use Ordinance, with respect to the lands described below, located within the
boundaries of the City of Chubbuck, are hereby changed is hereby changed from the prior zoning
designation as indicated to the new zoning designation:
Tract 1: Antler Ridge Apartments North of East Chubbuck Road and West of Kays
Kove Subdivision - from Limited Residential (R-2) to Planned Unit
Development (PUD). Property is legally described on the attached Exhibit
A and to be platted as the Antler Ridge Apartments.
Tract 2: Jensen's Cove Subdivision at the Corner of Tree Valley Road and Garden
Drive- from Agricultural (A) to Single Family Residential (R-1). Property
is legally described on the attached Exhibit B and will be platted as
Jensen's Cove Subdivision.
Tract 3: Lucky Lane Apartments PUD at 5202 Lucky Street from Limited
Residential (R-2) to Planned Unit Development (PUD). Property is legally
described as Lot 1, Block 2, Mingo Subdivision and to be platted as the
Lucky Lane Subdivision.
SECTION 2. Comprehensive Plan. The Mayor and Council find, and therefore declare,
that the foregoing changes in the Land Use Districts established in Title 18, Chubbuck Code, are
consistent with the land use pattern prescribed by the City's Comprehensive Plan for the
above-described property.

V� SECTION 3. Effective Date. Full, public hearings having been conducted in this matter,
the rule requiring an ordinance to be read on three separate days, one of which shall be a reading
in full, is hereby dispensed with, and this Ordinance shatl"became effective upon its passage,
approval and publication as provided by law.

Apartments North of East Chubbuck Road and West of Kays Kove Subdivision - from Limited
Residential (R-2) to Planned Unit Development (PUD); 2). Jensen's Cove Subdivision at the
Corner of Tree Valley Road and Garden Drive- from Agricultural (A) to Single Family
Residential (R-1); and 3). Lucky Lane Apartments Pud at 5202 Lucky Street from Limited
Residential (R-2) to Planned Unit Development (PUD); all of which are within the boundaries of
the City of Chubbuck and which lands are more particularly described in the ordinance;
declaring that the city council finds that such change in land use pattern is consistent with those
prescribed by the city's comprehensive plan; providing that this ordinance shall be in effect after
its passage, approval and publication.
