HomeMy WebLinkAbout02 17 1972 Ord. 104Legal Notice Legal Notice Legal Notice Legal Notice ORDINANCE NO. 104 AN ORDINANCE RELATING ' O THE SEWER SYSTEM OF THE CITY OF CHUBBUCK, IDAHO; PROVIDING FOR A SPECIAL ELECTION AT WHICH THERE SMALL BE SUBMITTED TO THE ELECT- ORS QUALIFIED TO VOTE THEREON THE QUESTION OF ISSUING SEWER REVENUE BONDS OF THE CITY FOR THE PURPOSE OF DEFRAY- ING IN PART THE COST OF CONSTRUCTING A SEWER- AGE SYSTEM; PRE'SCRBING DETAILS IN CONNECTION THEREWITH: RATIFYING AC- TION PREVIOUSLY TAKEN CONCERNING SAID SEWER, SYSTEM ,AND SAID BONDS: AND PROVIDING THE EF- FECTIVE DATE HEREOF. WHERAS, the City of Chub - buck (herein "City") in the County of Bannock and State of Idaho, is a municipal corp- oration duly organized and ex- isting as a City under the gen- eral laws of the State of Idaho; and WHEREAS, the City is present- ly without any sewage collection and treatment facilities; and WHEREAS, the City Council (herein "Council") has deter mined and does hereby deter- mine that the interest of the community and the public inter- est and necessity require the construction and acquisition of a municipal sewerage system (herein the "Project"), and WHEREAS, for the purpose of defraying a part of the cost of acquiring the sewer Project, the Council further deems it nec- essary to issue its sewer rev- enue bonds in the aggregate principal amount of $1,000,000.00, or so much thereof as may be necessary, payable solely from the revenues of said sewer sys tem as so constructed pursuani to the Revenue Bond Act cite: as Sections 50-1027 through 50 1642, Idaho Code, and all law: thereunto enabling; and WHEREAS, the City has nev er pledged the revenues de rived from the operation o the sewer system for the re demption of revenue bonds pay able from such revenues, a otherwise, with the result tha the net revenues to be derive+ from the operation of the sys tem may be pledged lawfull; and irrevocably to secure th repayment of said revenu bonds herein authorized pursu ant to the Revenue Bond Act and WHEREAS, s a i d revenu bonds shall not be a debt c the City and it shall not b liable thereon, nor shall sai bonds be payable out of an funds other than the revenu equisition of a municipal sew - rage system, including, with- ut limitation, collection lines, ransmission lines and outfall nd trunk lines to the sewage' reatment facility of the City f Pocatello, Idaho. Section 4. The details of con- tructing the system are more peci€ically shown and describ- d in the preliminary engineer - ng report and 1972 addendum hereto prepared therefor by oregren, Perkins and Associ- ates (herein "Engineer"). For urther details, reference is iereby made to said report and iddendum, which is now on file and available for inspection in he office of the Clerk of the :ity. Section 5. The cost of the ?roject, including all incidental ;xpenses has been estimated )y the Engineer to be approxi- mately $2,175,000.00. The City :ontemplates issuing revenue 3onds in the aggregate princi- 3al amount of $1,009,000.00 or ;o much thereof as may be necessary. The City anticipates' khat the balance of the cost will be defrayed by federal grants Df approximately $965,000.00 and a grant from the State of Idaho in the amount of approx- imately $210,000.00. The amounts of these grants may vary from these estimates depending upon the availability of funds. Section 6. Such sewer revenue bonds shall bear interest at a rate or rates not exceeding 6% per annum, payable annually, or at such lesser intervals as may hereafter be prescribed by ordinance; shall mature serially (or in installments if one bond is issued representing the entire principal amount of the bond issue) commencing 1 year and ending 40 years from the Jan- uary 1 following delivery; shall be payable solely from the rev- enues of the sewer system; and may be made subject to prior redemption at such time or >imes, with or without a prem- ium, and upon such terms and conditions as may be determin- ed by the Council in the ordin- ance authorizing said bonds. Section 7. A special municipal bond election be and the same hereby is, called to be held on Tuesday, the 7th day of March, 1972, between the hours of 12:00 o'clock noon and 8:00 o'clock p.m., on said day, for the pur- pose of enabling the qualified electors of said City to vote up- on the question of issuing said sewer revenue bonds set forth in the notice of election, the form of which is prescribed by this ordinance. Section 8. There shall be one voting precinct with boundaries conterminous with those of the City. Section 9. At said election the voting place and officials serv- ing thereat shall be as follows: CHUBBUCK PRECINCT Palling Place The Chubbuck Fire Station 4727 Yellowstone Street Chubbuck, Idaho Officials Phyllis Armstrong Nadine Stuart Janice Johnson Judges Marie L. The polls and bal- lot boxes shall open at the hour of 12:00 o'clock noon on said day and shall remain open con- tinuously until the hour of 8:00 o'clock P.M. of said day, at which time the polls shall be closed. Section 11. The details of con- structing the system are more specifically shown and describ- ed in the preliminary engineer- ing report and 1972 addendum thereto prepared therefor by Foregren, Perkins and Associ- ates (herein "Engineer"), For further details, reference is hereby made to said report and addendum, which is now on file and available for inspection in the office of the Clerk of the City. Section 5. The cost of the Project, including all incidental expenses has been estimated by the Engineer to be approxi- mately $2,175,000.00. The City contemplates issuing revenue bonds in the aggregate prinel- pal amount of $1,000,000,00 or so much thereof as may be necessary.
