HomeMy WebLinkAbout01 15 1971 Ord. 91PROOF OF PUBLICATION STATE OF IDAHO ss County of Bannock ORDINANCE NO. 91 AN ORDINANCE OF THE CITY OF CHUBBUCK PRES- CRIBINGPENALTIES AND -OR IMPRISONMENT FOR VIOLA- TIONS OF CITY ORDINANCES; DECLARING VIOLA'T'ION OF ANY ORDINANCE A MIS- DEMEANOR AND PROVIDING THAT FAILURE TO CEASE OR ABATE SHALL CONSTITUTE A CONTINUING VIOLATION. BE IT ORDAINED &Y THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Any person con* victed of a violation of any ordi- nance of the City of Chubbuck, may be fined in a sum not to ex- ceed three hundred dollars ($ 00.00) for any offense and such person may be confined in jail for a period of not more than thirty (30) days. Either or both such fine and imprison- ment may be imposed; and in addition thereto, any person so convicted shall pay such costs as the Court may assess. Section 2. Any person con- victed of driving a motor ve- hicle while under the influence of intoxicating liquor or a nar- cotic drug may be fined in ay. amount not to exceed three hun- dred dollars ($100.00) and may be confined in jail for not more than thirty (30) days of both such fine and imprisonment. Section 3. The penalty herein provided shall be applicable to every ordinance of the City of Chubbuck the same as though it were a part of each and every separate ordinance. Any per. son convicted of a violation of any ordinance of this city shall be deemed guilty of a misde. meanor. A separate offense shall be deemed committed for each day during on or which a vio• lation occurs or continues. Section 4. That this ordinance shall be in full force and effect the lith day of January, 1971, 12:01 A.M.
