County of Bannock ORDINANCE NO. 127 AN ORDINANCE OF THE CITY - OF CHUBBUCK, IDAHO, RE- QUIRING ALL INDIVIDUALS, PERSONS, FIRMS OR CORPOR- ATIONS PARTICIPATING IN ANY CONSTRUCTION. DEMO- LITION, CLEARANCE, EXCA- VATION, MAINTENANCE OR REPAIR PROJECT ON OR IN ANY PUBLIC STREET, ALLEY, SIDEWALK, CURB, GUTTER, LAND, BUILDING, FACILITY, UR OTHER PUBLIC PLACE, INCLUDING PROPERTY SUB- JECT TO AN EASEMENT HELD BY THE CITY OF CHUBBUCK, TO DEPOSIT WITH THE CITY CLERK A SURETY BOND IN THE SUM OF TEN THOUSAND DOLLARS ($10,000.00), OR A CORPORATE PERFORMANCE BOND IN THE CASE OF A PUB- LIC UTILITY DIRECTLY REGU- LATED BY A FEDERAL OR STATE PUBLIC UTILITIES COMMISSION; SPECIFYING THE OBLIGATIONS WHICH SUCH BONDS MUST IMPOSE; REQUIRING EVERY SUCH IN- DIVIDUAL, PERSON, FIRM OR CORPORATION TO DISCLOSE TO THE CITY CLERK, AT Tiff TIME OF FILING THE SURETY OR CORPORATE PERFORM- ANCE BOND, THE NATURE AND EXTENT OF LIABILITY INSURANCE IN FORCE TO PRO- TECT OTHER PRIVATE PAR- TIES AFFECTED BY THE PROJECT IN QUESTION; MAK- ING A VIOLATION OF THE FOREGOING SECTIONS A MIS- DEMEANOR; DISPENSING WITH THE RULE REQUIRING ORDINANDES TO 13E READ ON THREE SEPARATE DAYS, AND PROVIDING THAT THIS ORDI- NANCE SHALL BECOME EF- FECTIVE UPON ITS APPROV- AL AND PUBLICATION AS PRO- VIDED BY LAW. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: That all individ- uals, persons, firms orcorpora. tions participating in any con- struction, demolition, clear- ance, excavation, maintenance or repair project on or in any public street, alley, sidewalk, curb, gutter, Iand, building, fa- cility or other public place, in- cluding property subject to an easement held by the City of Chubbuck shall deposit with the City Clerk, prior to commenc- ing work on the project, a sure- ty bond in the sum often thousand dollars ($10,000.00), or a cor- porate performance bond in the case of a public utility directly regulated by a federal or state public utilities commission;.
