ORDINANCE NO. 183
AN ORDINANCEOF THE CITY
OF CHUBBUCK, IDAHO, DE-
CLARING AS A MATTER OF
POLICY THAT FOR REASONS
OF PROPER ENGINEERING
AND ENACTMENT OF A COM-
PREHENSIVE LAND DEVELOP-
MENT ORDINANCE, ORDI-
NANCE NO. 168 OF THE CITY
OF CHUBBUCK , IDAHO ,
SHOULD BE REPEALED; RE-
PEALINGSAID ORDINANCE
NO. 168 IN ITS ENTIRETY;
AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE
MAYOR AND COUNCIL. OF THE
CITY OF CHUBBUCK, IDAHO:
Section f'Declaration of Policy.
The mayor and council of the
City of Chubbuck, Idaho, find and
therefore declare as a matter of
public policy that Ordinance No.
168 of the City of Chubbuck, Ida-
ho, enacted on June 22, 1976,
should be repealed for the follow-
ing reasons:
A. Said Ordinance provides for
individual property owners along
arterial thoroughfares to install
curbs, gutters and sidewalks,
when their respective properties
are improved. Sound engineering
indicates that such work should
be performed either in conjunc-
tion with large scale develop.
ments or coordination projects
undertaken among several adjoin-
ing property owners, in order to
ensure that proper lines and
grades are established.
B. The mayor and council have
under consideration Chubbuck'
City Ordinance No. 178, which es-
tablishes comprehensive land de-
velopment standards. These stan-
dards provide for curbs, gutters
and sidewalks to be installed in
developments governed by the or-
dinance. Accordingly, it appears
that Ordinance No. 178 addresses
in appropriate cases the subject
matter of Ordinance No. 168,
which is no longer needed.
Section 2. Repeal. Ordinance No.
16B of the City of Chubbuck, Ida-
ho, is hereby repealed in its en-
tirety, and shall no longer be of
any force or effect with respect
to property owners who have
been in the past or would be in
the future subject to its provi-
sions,
Section 3, Effective Date. The
rule requiring ordinances to be
read on three separate occasions
is hereby dispensed with, and
this ordinance shall become effec-
tive upon its passage, approval
and publication as provided by
law.

AND APPROVED BY THE MAY-
OR of the City of Chubbuck, Ida-
ho, this 25th day of October,
1977.
