County of Bannock ORDINANCE NO. 201 CITY OF CHUSBUCK, IDAHO AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING ORDINANCE NO. 60 OF THE CITY OF CHUBBUCK, IDAHO, TO PROVIDE FOR PLACEMENT AND USE OF "DUMPSTERS FURTHER AMENDING SAID ORDINANCE TO PROVIDE THAT ALL PROP- ERTIES, BUILDINGS OR RESI- DENCES DISPOSING OF GAR- BAGE WASTES MUST SUB- SCRIBE TO THE SANITARY SERVICE SYSTEM OF THE CITY; REPEALING ALL PRIOR ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PRO- VIDING FOR SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHU8BUCK, IDAHO: SECTION 1. "Dumpsters." Ord! nance No. 60 of the City of Chub - buck, Idaho, enacted on the 10th day of March, 1964, is hereby amended by adding thereto a new Section 3A as follows: 3A. "DUMPSTERS". Property owners or occupants shall utilize on their premises "dumpsters" in lieu of garbage cans when the volume and nature of garbage wastes are found by the Chub - buck city engineer to be inappro. priate for disposal by garbage cans. The city engineer shall es- tablish, from time to time, rea sonable criteria for imposing the "dumpster" requirement, subject to review of the city council upon request of any affected party. The design and construction of such "dumpsters" shall be ap- proved prior to snstallation by the Chubbuck City Engineer, to assure compatibility with sanitary service system equipment. All "dumpsters" shall be placed upon adequate concrete or as- phalt pads. "Dumpsters" and areas surrounding them shall be maintained in a neat and orderly manner. Use of "dumpsters" by persons not authorized to do so by the city or by the property owners or occupants of premises t where such "dumpsters" are lo- cated shall be unlawful and pun- ishable as a misdemeanor. Signs may be placed on "dumpsters" with wording substantially as fol- lows: "For use by authorized persons only. Unauthorized use is unlawful and punishable by fine or imprisonment or both. Chub - buck City Ordinance No. 60, as amended." SECTION 2. Subscriptions to San. itary Service System. Said Ordi ance No. 60 is further amended by adding thereto a new Section 5A as follows: 5A. "SUBSCRIPTIONS TO SANI- TARY SERVICE SYSTEM." From and after the first day Of July, 1919, all properties, build- ings or residences within the City of Chubbuck shall be subscribed by their owners or Occupants to the sanitary service system (gar- bage collection system) of the city, and such owners or occu- pants shall pay the fees therefor. -----qoath ----------------------- being first duly sworn onposes and says: Th _______ ___ ------------ was at all times herein mentioned a citizen of the United States of America, more than 21 years of age, and the Principal Cleric of THE IDAHO STATE JOURNAL, a daily newspaper, printed and published at Pocatello, Bannock County, Idaho, and having a general circulation therein.
