AN ORDINANCE OF THE CITY
OF CHUBBUCK, IDAHO ANNEX-
ING ' CERTAIN LANDS WITHIN
THE YELLOWSTONE HIGHWAY
RIGHT-OF-WAY TO BE INCLUD-
ED WITHIN THE BOUNDARIES
AND JURISDICTIONAL LIMITS
OF THE CITY OF CHUBBUCK,
IDAHO; RECITING THAT NO
ZONING CLASSIFICATION
NEED BE APPLIED TO SAID
LANDS; DIRECTING THE
CHUBBUCK CITY CLERK TO
COMPLY WITH THE FILING
REQUIREMENTS CONTAINED
IN IDAHO CODE SECTION 63-
2215; AND PROVIDING WHEN
THIS ORDINANCE SHALL BE-
COME EFFECTIVE.
BE IT ORDAINED BY THE
MAYOR AND COUNCIL OF THE
CITY OF CHUBBUCK, IDAHO;
Section 1; Annexation. The fol-
lowing described lands, located
within Bannock County and con-
tiguous to the existing boundaries
of the City of Chubbuck, Idaho,
are hereby annexed and included
within the boundaries and juris-
dictional limits of the City of
Chubbuck, Idaho:
Yellowstone Highway, 33 feet,
more or less, each side of the
highway center line; the highway
center line being more particular-
ly described as follows:
Beginning at the North Iii corner
of Section 3, T. 6S., R. 34E.,
B.M., Bannock County, Idaho;
thence westerly 4.0 feet, more or
less, to the True Point of Begin-
ning; thence Southerly 2640 feet,
more or less to the latitudinal
center line of Section 3.
Section 2: zoning. The above -de
scribed lands, newly annexed to
the City of Chubbuck, Idaho, con-
sist entirely of a public vehicular
right-of-way and need not be sub
ject to a zoning classification.
Section 3: Filing. The Chubbuck
City Clerk is hereby directed to
comply with the filing require-
ments contained in Idaho Code
section 63-2215.
Section 4: Effective Date. The re-
quirement that ordinances be
read on three separate occasions
is hereby dispensed with and this
ordinance shall become effective
upon its passage, approval and
publication, as provided by law.
PASSED BY THE COUNCIL
AND APPROVED BY THE MAY-
OR of the City of Chubbuck, Ida-
ho, this 1011h day of April, 1979.
