SUMMARY OF LAND USE
ORDINANCE
-NOTICE IS HEREBY GIVEN that the
Chubbuck City Council has passed, and
the Mayor has approved, Chubbuck City
Ordinance No. 241, which shall be known
and citedas the "Chubbuck Land Use
Ordinance". Theordinance becomes ef-
fective upon publication of this summa-
ry in the Idaho State Journal, the official
newspaRer of the City.
The ordinance amends the prior Land
Use Ordinance, Chubbuck City Ordi-
nance No. 205, and materially alters the
land use (zoning) regulations for the
City. The land use districts, consisting of
agricultural, limited and general resi-
dential, limited and general commer-
cial, and industrial land use districts, as
modified since the enactment of Ordi-
nance No. 205, are shown on the map
published with this summary. The ordi-
nance sets forth in detail the uses
allowed or conditionally permitted in
each district. The ordinance continues
the height and area regulations set forth
in Chubbuck City Ordinance No. 205,
including minimum front, side and rear
yard dimensions, for all land use dis-
tricts, although the ordinance does pro-
vide for some modification of said regu-
lations. As with Ordinance No. 205, the
new Land Use Ordinance specifies visi-
bility requirements at street intersec-
tions and supplemental yard and land-
scaping standards. It provides for limi-
tations upon density of development in
neighborhoods heavily impacted by ur-
ban growth.
Ordinance No. 241 also sets forth addi-
tional controls for commercial and in-
dustrial uses. It provides supplemental
standards for accessory, structures; ani-
mal care sites, the storage of chemicals,
-
pesticides, and fertilizers; drive-in es-
tablishments; gravel pits; home occupa-
tions, commercial kennels; off-street
parking; the outdoor storage of industri-
al products; production building sales
offices; riding stables and schools, and
vehicle storage sites. It also regulates
the conversion of dwellings to more
units, temporary buildings, parking and
storage of certain vehicles (including — -- -
recreational vehicles), improvement of
garbage collection areas, and placement (jay of
of structures or vegetation in or near -
streets or right-of-ways.
The ordinance distinguishes between
"Site dwellings" (those constructed on
the sites where they are intended to be
occupied and "production buildings"
(those constructed at plants or factories
elsewhere). The ordinance further dis-
tinguishes between Class 1, Class 2, and
Class 3 production buildings. Class 1
