RESPECT TO CERTAIN LANDS WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK LOCATED IN THE SW 1/4, SECTION 2, TOWNSHIP 6 SOUTH, RANGE 34 E.B.M., FROM AG- RICULTURAL (A) TO LIMITED RESI- DENTIAL (R -l); DECLARING THAT THE CITY COUNCIL FINDS THAT SUCH CHANGE IN LAND USE DIS- TRICT IS COMPATIBLE WITH THE LAND USE PATTERN PRESCRIBED BY THE CITY'S COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFEC- TIVE: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1. Change of Land Use District. The lend use district established by the Chubbuck Land Use Ordinance, with re- spect to the lands described below, locat- ed within the boundaries of the City of Chubbuck, is hereby changed from Agri- culturtal (A) to Limited Residential (R- 1): A tract of land in the Southwest quarter of Section 2, Township 6 South, Range 34 East B.M., Bannock County, Idaho, more particularly described as follows: Commencing at the Southeast corner of a parcel described in Instrument No. 478780 dated April 13th, 1971 and recorded at the Bannock County Recorder's Office. Said corner is 660 feet more or less south and 660 feet more or less east of the west sixteenth corner on the latitudinal center IIne of said section 2; thence south along the west line of Bunce Subdivision 131.92 feet more or less to the north Right of Way o/ Garden Drive, this point being the true point of beginning; thence continuing south along the west line of Bunce Subdi- vision, 1651 feet more or less to the northepst corner of a parcel described by Instrument No. 512599 dated August 9, 1973 and recorded at the Bannock County Recorder's office; thence west parallel to the south line of said Section 2, a distance of 310 feet more or less to a point on the east line of a road easement described in Instrument No. 517740 dated January 4, 1974, and. recorded in the Bannock County Recorder's Office; thence south along said easements east line 215.0 feet to said easement's southeast corner, thence west along the south line of Section 2, a distance 50 feet to said easement's South- west corner; thence north parallel to the west sixteenth fine of said section 2 and along the west line of said easement, 614.5 feet more or fess to a point on the south llne.of a parcel described in Instru- ment No. 564837 dated November 18, 1975 and retarded at the Bannock County Recorder's office; thence east along said parcels south line. 15 feet to said parcels southeast corner; thence north parallel to the west sixteenth line of said section 2, a distance of 1251 feet more or less to a point that is 131.92 feet south of the south line of said parcel described .by Instru- ment No. 478780; thence east parallel to the south line of said parcel 343 feet more or less to the true point of beginning. SECTION 2. Comprehensive Plan. The Mayor and Council find, and therefore declare, that the foregoing changes in the Land Use Districts established by the Chubbuck Land Use Ordinance No. 241, are consistent with the land use pattern prescribed by the City's Comprehensive Plan for the above-described property. Sandra K Herald being first duly sworn on oath deposes and says: That th was at all times herein mentioned a citizen of the United States of Ameri- ca, more than 21 years of age, and the Principal Clerk of THE IDAHO STATE JOURNAL, a daily newspaper, printed and published at Pocatello, Bannock County, Idaho, and having a general circulation therein. That the document or notice, a true copy of which is attached, was published in the said IDAHO STATE JOURNAL, on the following dates, to -wit: November 1 - 19A4 19- 19- 19 9-1919 19 That said paper has been continuously and uninterruptedly published in said County for a period of seventy-eight weeks prior to the publication of said notice or advertisement and is a newspaper within the meaning of the laws of Idaho.
