HomeMy WebLinkAbout05 04 2016 CM Study SessionCITY OF CHUBBUCK COUNCIL STUDY SESSION AGENDA MAY 4, 2016 — 4:00pm CALL TO ORDER: Mayor England GENERAL BUSINESS: Discussion on Hoops Academy design review requirements with Joe Worrell. Mayor asked if there were any questions for staff. No questions were asked at this time. Joe Worrell, 4849 Johannsen place in Chubbuck, addressed the council. Joe gave some factual and historical explanations for Hoops Academy. Hoops is located at 206 E Chubbuck Road. It is a location behind Palace Playhouse and Rug Rat. The academy was established in 2011 as a basketball training facility. No games are played at the facility. They have approximately 100 kids go through the academy annually. They are open year around. Joe shared some financial information. Most hours worked at the facility are volunteer hours. Mr. Worrell understands the city would like the parking lot at his facility paved. He cannot afford to do that. He would like to come to a workable solution for both parties. Joe stated that the building is a multiple use building; some of the building is used for storage for Joe's other enterprises. Joe believes the building is being used for the same purpose as it was for the theater and has not been developed into something new. Joe stated the build was and is used for storage, rehearsals (for games) and making props. Deloy Stuart stated that Terry Commons built the building with a stage to include rehearsals and eventually it became 100% storage for the theater. Councilmember Ellis asked about other Cities and their paving requirements. Councilmember Ellis stated all final decisions for City planning should end with City Council. Tom Holmes reminded the Council of the City's ordinance and the need for compliance. Councilmember Baumeister is also concerned about compliance. Joe Worrell is not asking to be out of compliance, he believes he is in compliance. Councilmember Lewis commented that the review of past notes, minutes and letters mention the paving requirement and there is no prior contention that there has not been a change in use, this is the first the City has heard this. Joe asked if the City could consider auditorium or sports use and use that requirement for parking. Rug Rat owns the property that is the access to Hoops. Hoops have an easement. Rug Rat does not want the property with the easement paved. So Hoops cannot comply with this requirement. Joe does have the opportunity to lease Rug Rats parking from him as an option to try and comply. 2. Discussion on water production and water rights. Rodney Burch gave some details on the City's water system. There are 71 miles of transmission lines, 1600 valves, 620 hydrants, 3 wells, 4200 accounts in the city. We charge our users, residential, $24 base rate and $1.15 per 1000 gallons used. The system is operated on a SCADA system from City Hall. All our water is subject to state law which includes water right law; Seniority and point of diversion rights apply. Rodney showed graphics explaining the Cities water right portfolio and the City's pumping expectations. Each year there is a water call which threatens the City's ability to provide water in the manner we are accustomed. We participate with IGWA and with AIC's processes concerning this issue. The lease is part of the answer to mitigate the effects of the water call. I Discussion on changes to City Title 18. Councilmember Evans, for aesthetic reasons, would like to keep the requirement for fencing around the cell towers. Rodney explained that currently the fence is required but that in some situations the fence might not be a good idea. Cell Towers are always conditionally permitted and in that process a fence may be required if it is desired. Councilmember Ellis wants the time frames plats to remain unchanged.
