COUNCIL MEETING MINUTES
MARCH 2, 2016 — 6:OOPM
CALL TO ORDER: Mayor England called the meeting to order at 6:00pm.
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Evans led the Pledge of Allegiance.
APPROVAL OF MINUTES:
Council Meeting Minutes of February 17, 2015.
Councilmember Lewis moved to approve the minutes of February 17, 2016. Councilmember
Ellis seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
PROCLAMATION: March for Meals. Mayor England read the Proclamation in support of Meals
on Wheels.
PUBLIC HEARING: A public hearing was held to consider a proposed ordinance amending Title
15, Building and Construction, Title 16, Land Improvement Standards, and Title 17, Land
Development.
Rodney Burch, the City's Public Works Director, presented the ordinance. Mr. Burch explained
the process the City went through to make the proposed changes. A committee of city staff has
reviewed this section of code to suggest changes. This has been in front of the Land Use
Commission and is in front of the council with a recommendation for approval from the Land
Use Commission. Most of the changes are a result of the growth and changes the city itself has
experienced since the last ordinance was put in place. These changes are bringing the code into
compliance with what is actually happening in our process. Mr. Burch then outlined the 4
biggest changes that are being made.
15.25. 010 Reader Boards. This section is new to the code. Applications for reader board signs
are coming in and our current code does not address them. Rodney explained the intensity of the
light as an issue. The City would like to be able to regulate the signs if needed.
16.16.030 Dust, Dirt and Materials Control. This section helps us with storm water permit we
are required to share with the City of Pocatello as mandated by the EPA. This section increases
the potential fine. We do work with contractors to mitigate this before we issue a fine. That will
not change. We do want the fine to be severe enough that the contractor will want to comply
with the permit, rather than just pay the fine.
16.12.340 Street Pavement Sections. Rodney explained the pavement serviceability index. The
current construction requirement is designed for passenger vehicles only. The City should adopt
a construction design that will support truck travel. The current standards cheat us out of 7 years
of sustainability. The new design does increase the cost to the developer. Rodney estimates,
using the costs of construction for Whitaker Road, that the anticipated increase would be $642
per 80 foot lot. Although this does cost the developer, the City believes this is best for the City
as whole, in the long run.
17.16.050 Undedicated structure on land in proposed development prohibited. Rodney
explained how the City has been working with developers, with a guarantee, when the site is not
complete and yet the developer needs to move forward. The City would like to change the
amount of the guarantee from 125% to 150% of the project cost. The City also would like to
change the type of guarantee we accept to be only bonds, cashier check, or letter of credit. In the
past we have problems with the guarantee as there was no incentive to finish up the project.
These changes will give the developer an incentive to finish up their project.
Councilmember Ellis asked about the increased easement, or widening of the road, that is
proposed. Rodney explained that there was an adjustment made in the size of the road. One
reason for this is that this is one of the most requested items from citizens and explained that
with cars parked on both sides of the street our current easement requirements should be
adjusted. This change does reflect what the City has been building. Rodney asked if this
requirement could be withdrawn. Mr. Holmes the City attorney said if that change is made to the
ordinance would need to go back through the Land Use Process.
Councilmember Ellis asked about the changes in time limits with preliminary and final plats.
Rodney explained that the current deadlines, six months for a preliminary plat and two years for
a final plat proposed to be one year for a preliminary plat and one year for a final plat.
Councilmember Baumeister asked about the changes in reference from the City Engineer to the
Public Works Director. Mr. Burch explained the history of the position, how until recently the
Public Works Director and the City Engineer were the same position. Currently the City
Engineer is supervised by the Public Works Director, two different positions, so the references to
the City Engineer have been changed to Public Works Director.
Councilmember Baumeister asked about the park requirement. Rodney explained that every
development is required to construct a park or contribute to the park fund. The city would like
some parameters around this requirement such as the minimum functional park size we are
willing to accept, if the space for the park in the development is two small the developer with
then be required to contribute cash rather than build the park. Councilmember Baumeister
expressed her desire to have bigger destination parks rather than smaller neighborhood parks.
Tom, the city attorney, explained that this would be a major change in the philosophy of the city
and is beyond the scope of our discussion for title 15, 16 and 17.
Councilmember Lewis asked if it would be advisable to have the City Engineer sign off on some
of these things rather than the Public Works Director as stated in the proposed ordinance.
Mayor England declared the public hearing open.
Deloy Stuart, 770 East Chubbuck, representing the Building Contractors of Southeast Idaho,
BCSI, testified. Mr. Stuart represents 100 builders. The BCSI would like to work with the city
on these things. Mr. Stuart said, it is easy to recommend more expensive roads and parks
however the BCSI wants to make sure the council understands all the impacts of the decision. It
is important we don't price people out of building a home. Mr. Stuart would like to see the proof
on the improved road construction adding longevity to the roads. Mr. Stuart asked "If the City
had to pay to construct roads with the proposed design would they still do it?" Rodney did
explain that the City is currently using the proposed construction changes, and for example, did
on Whitaker Rd. The BCSI wants to make sure that the City of Chubbuck stays builder friendly.
Mr. Stuart commented on destination parks and think they are a good idea.
Councilmember Lewis asked Mr. Stuart if the additional costs of the roads were the BCSI's only
concern. Mr. Stuart believes the changes to the ordinance and the tightening the requirements
are for those who abuse the system. Chubbuck has always been good to work with and Mr.
Stuart does not see that changing.
Niki Taysom, 4963 Yellowstone. Ms. Taysom would like to address land improvement and
development. The City wants a splash park; this should be a private endeavor. She is in favor of
maintaining green spaces and having as many as possible. She does not believe the dust we are
trying to control is dust. It's black from the factories. Fees are putting people out of their
homes. Business need to maintain the cleanliness of their property. The roads and sidewalks
and curbs on Whitaker Road are poorly done.
Doug Briscoe, 5465 Kymball. Mr. Briscoe is worried about the increase cost of the road that
the proposed ordinance will require. He believes this will scare development. Mr. Briscoe is not
against any one change, but all of them at once will scare the development. Mr. Briscoe
mentioned that the builders are having a hard time getting appraisals to meet the cost to
construct. He believes this is because of the land cost.
Doug Briscoe also commented on the parks. He likes the small neighborhood parks. He just put
one in and his kids will play there every day.
Nick Jensen, 11052 Deer Ridge Loop. Mr. Jensen commented on the good working relationship
he has with the City. He is worried about the increased street cost. When we talked about one
cost, it doesn't seem significant. However, every dime starts to add up
Councilmember Evans asked the Mr. Stuart if he had a suggestion on how the BSCI would like
to change the way they participate in this process. Mr. Stuart mentioned communication by
email and the builder's responsibility to be involved with the councils study sessions. The BCSI
would like a heads up on code changes and we will share our thoughts. He also would like a
review of the comprehensive plan to address parks in the City.
Mayor England declared the public hearing closed.
Tom, the City Attorney would like to clarify that the dedication of land and cash in lieu of
building the park is the option of the city. There is no relation to the $400 per lot and the cost of
the park. Rodney added that the cash contribution in lieu is not the $400 per lot. It would be
much more. Councilmember Baumeister is worried about the cost to maintain all the small parks
vs the cost to maintain several destination parks. Councilmember Baumeister wants the council
to be cautious with the proposed changes in the ordinance. She agrees with the changes and
would be comfortable making them in two years, not right now. She believes these changes
could affect building in Chubbuck.
Councilmember Ellis doesn't want to over build the roads. Maybe the City should extend the
required warranty on the road to 5 years rather than changing the specifications. He estimates
the cost of the road per lot at $1,800. He would like to see destination parks as well.
GENERAL BUSINESS;
1. Consider requests for funding. Mayor England explained that out of the seven requests
for funding the City has received, there are two that need to be addressed tonight. Those
two are: Math Counts for $200.00 and Ellis Fun Run for $1,000.00. We can address the
other 5 at a later date. Councilmember Lewis is concerned if we give to Ellis Elementary
PTA should we consider Chubbuck, Tyhee, Syriga or Conner Academy?
Councilmember Baumeister would like the City to have a presence at the run even if we
don't contribute monetarily. The council asked what the reach into our population for
math counts was. It was stated in the study session that out of 17 schools participating, 9
were from our area.
Councilmember Ellis moved to deny the request by Math Counts. Councilmember Evans
seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
Councilmember Lewis moved to deny the request by Ellis Elementary PTA.
Councilmember Baumeister seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -
yes, Evans -yes.
The other 5 requests will be taken care of at a later date.
2. Consider quotes for social media management proposals. This item was postponed.
3. Confirm appointments of Jason Mendenhall and Bryan Nield to the Land Use and
Development Commission. Mayor England presented the names of Jason Mendenhall
and Bryan Nield to serve on the Land Use and Development Commission. Mayor
England explained that both have served two terms on the commission and would need to
be reconfirmed by the Council to serve again.
Councilmember Evans moved to confirm the appointments of Jason Mendenhall and
Bryan Nield to the Land Use and Development Commission. Councilmember
Baumeister seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
4. Review of the Chubbuck Development Authority FY2015 Annual Report.
Rodney Burch, Public Works Director for the City of Chubbuck, presented the CDA
Annual Report with a review of urban renewal projects.
Councilmember Ellis moved to accept the CDA's Annual Report. Councilmember Evans
seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
5. Acceptance of Offer of Dedication for Bobcat PUD, Carmike Subdivision and Dance
PUD. The subdivisions are complete and the improvements are ready to be dedicated to
the City.
Councilmember Ellis moved to accept the Offer of Dedication for Bobcat PUD, Carmike
Subdivision and Dance PUD. Councilmember Baumeister seconded. Roll call vote:
Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
6. Consider proposed Ordinance #753 for zoning Willie Storage Units at 4532 Burley
Drive.
Rich Morgan, City Clerk, explained that the public hearing was held in 2010 and we did
not get the ordinance passed. This is a clean-up item and it is requested that we waive the
rule it be read three times one being in full and pass the ordinance tonight.
Councilmember Lewis moved to approve waive the rule the ordinance be read on three
separate occasions, one being in full. Councilmember Ellis seconded. Roll call vote:
Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
Councilmember Baumeister moved to adopt ordinance #753. Councilmember Evans
seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
7. Consider proposed ordinance amending Title 15, Building and Construction, Title 16,
Land Improvement Standards, and Title 17, Land Development. Tom Holmes read the
ordinance for the first time by title. Council member Ellis is not if favor of the ordinance
as just read. Councilmember Lewis asked for the backup documentation on the
ordinance changes including the information gathered to change the engineering on the
roads.

Councilmember Ellis moved to approve the claims for March 2, 2016. Councilmember Evans
