HomeMy WebLinkAbout08 02 2017 CM Study SessionCITY OF CHUBBUCK COUNCIL STUDY SESSION MINUTES AUGUST 2ND° 2017 — 4:00PM CALL TO ORDER: Mayor England COUNCIL MEMBERS PRESENT: Mayor Kevin England, Melanie Evans, Josh Ellis, Annette Baumeister, Ryan Lewis and City Attorney Tom Holmes STAFF MEMBERS PRESENT: Planning and Development Director Devin Hillam, Paul Andrus, Deputy Clerk Joey Bowers, and City Clerk Rich Morgan GENERAL BUSINESS: 1 Discussion on Deltam3 Councilmember Evans understood that C-1 is an allowable zone within a mixed use area. She also understood that denying a zoning change based solely off of not having a preliminary plat is not a valid reason. Councilmember Evans felt like that since most of this area had been developed residential that this plot of land should remain residential and not commercial. Councilmember Evans didn't see how rezoning this property as commercial would serve the daily needs of the neighborhood. Councilmember Evans felt like once the Council rezoned this parcel to C-1 then there hands would be tied and the Council would be done with the building process. Councilmember Ellis explained his statement at the previous meeting about this property eventually being zoned C-1. He stated that after rereading the entire comprehensive plan and all of section 18 of the City code, that he would not rezone this as C-1. He felt like rezoning this as commercial does not provide a service for the surrounding residents. Councilmember Ellis doesn't feel like this is an all or nothing, he feels like they need to come and show why it qualifies for the zoning that the developer is asking for. Councilmember Baumeister felt like they need to prove that this would benefit the neighborhood, and that it is a beneficial buffer between the residential and the main artillery. Councilmember Baumeister is worried about leaving it residential, because nobody wants to live off a major artillery. Councilmember Lewis felt like that the Developers will always be responsible for the burden of proof -of a zoning change. If the Developer does not show that burden of proof then they can come before Council and try it again. Councilmember Lewis felt like before Council could make any decision on a motion for reconsideration that the public needs to be made aware of the meeting. Councilmember Lewis felt like that the City was way too commercial heavy. City Attorney Tom Holmes stated that C-1 is a compatible use next to residential, provided that it is a true limited use C-1. Mr. Holmes also could see why Council would feel more comfortable about making a zoning change if the preliminary plat was available for review. Mr. Holmes answered all the questions presented to him by the Council. Mr. Holmes stated that if the applicant wants to bring in any new information then another public hearing needs to be held. Planning and Development Director Devin Hillam talked about the comprehensive plan and the general decisions that had been made in previous plans.
