SPECIAL COUNCIL MEETING MINUTES
MAY 31ST' 2017 — 5:00PM
CALL TO ORDER: Mayor England
COUNCIL MEMBERS PRESENT: Mayor Kevin England, Ryan Lewis, Melanie Evans, Annette
Baumeister, Josh Ellis, and City Attorney Tom Holmes
STAFF MEMBERS PRESENT: Public Works Director Rodney Burch, City Clerk Rich Morgan, and
Deputy Clerk Joey Bowers
GENERAL BUSINESS:
1. Discussion on how the Chubbuck Development Authority and the City handle Contracts
Councilmember Lewis wanted an open public meeting to let Council know about the
decisions made by the Chubbuck Development Authority; before the Council agrees to
allow the Mayor to enter into a contract. Councilmember Lewis would also like the City
of Chubbuck Claims and Chubbuck Development Authority claims to be approved
separately. Councilmember Lewis does not want the Council to get caught up in design
issues on any plat. Councilmember Lewis said that the Council is not authorized to tell
the Chubbuck Development Authority what to do. But the Council can decide not to
approve a City project that they approved to finance. He felt like that the Chubbuck
Development Authority needs to make the decision to approve finance or not before
Council approves the project or not.
Councilmember Baumeister would like to be assured that all designs are meeting City
code. Councilmember Baumeister would like to see written clarification of what roles
and responsibilities the Chubbuck Development Authority has so that everyone
understands these roles and responsibilities. Councilmember Baumeister felt like the
Chubbuck Development Authority and the Council should be able to see a presentation of
project design before approval.
Councilmember Evans feels like that it is important to listen to the communities
opinions when the City is making construction designs.
Councilmember Ellis would like the City to look at the science of the bump outs and if
they are efficient in helping to slow traffic before deciding on whether to continue or
discontinue with that design or not. Councilmember Ellis wonder if the executive director
of the CDA should be the one to sign the contract. Councilmember Ellis agrees that the
Council does not need to be involved in the designing of projects, but should know what
is being purchased.
City Attorney Tom Holmes explained that in reality the City should be helping with
the planning, development, and designs of CDA projects because they become City
assets. Mr. Holmes does not think that the executive director of the Chubbuck
Development Authority should be the one to sign contracts. He felt like that an elected
official needed to be in control to make sure that all compliance procedures have been
completed.
Public Works Director Rodney Burch believes these are City of Chubbuck projects
that the City is presenting to the Chubbuck Development Authority for the financing of
these projects.
Mayor England stated that after getting public opinion from the community. They
would not do the same bump outs that they did on the Stuart reconstruction, in the
Country Acres reconstruction.
2. Review Contract for Services between Chubbuck Development Authority and the City
No contract was presented
3. Review and Acceptance for low bid on Country Acres
Public Works Director Rodney Burch wanted Council to know that at the last
Chubbuck Development Authority meeting the Mayor represented the City and asked for
the Chubbuck Development Authority to fund the complete 4.4 million dollar
reconstruction project for Country Acres. Mr. Burch informed Council that the Chubbuck
Development Authority approved the funds for the original design and reconstruction
including sidewalks, curb and gutter for Country Acres. Mr. Burch asked Council to
approve the City of Chubbuck entering into contract with the low bidder, Knife River
Corporation, for the Country Acres reconstruction project.
Councilmember Lewis motioned based on authorization of Chubbuck Development Authority, to
authorize the Mayor to enter into a contract with Knife River Corporation for the Country Acres
road construction project according to the construction bid of $4,377,084.50.
Councilmember Evans seconded motion for approval
