COUNCIL MEETING MINUTES

APPROVAL OF MINUTES: September 20th, 2017 & October 04th, 2017

Councilmember Evans recused herself from Public Hearings 1 & 2, and General Business Items 2 & 3
PUBLIC HEARING:
1. An application for a Planned Unit Development (PUD) Preliminary Development Plan for
a proposed "Evans PUD", an 8 unit Multifamily Infill PUD. Located Northwest % of
Section 3, Township 6 South, Range 34 East of the Boise Meridian, City of Chubbuck,
Bannock County, Idaho. Approximate location is on north and south sides of Belva Lane
at approximately 159 Belva Lane. Application will be evaluated against criteria
established by Idaho Code §67-6511 and municipal code §18.20.110.E. On 9/12/17, the
Land Use & Development Commission recommended approval of the Plan and of a
waiver request from the 100 square feet of private space per unit requirement.
Stuart ward of Dioptra presented a two building 4-plex infill off of Belva lane. One
Building will be located on the Northside of Belva and one will be on the Southside of
Belva. Both units will have a gazebo and a fire pit as amenities. Mr. Ward stated that
since Belva lane separates these units they will be treated as separate units. Mr. Ward
also stated that due to space and being an infill there will be only once dumpster on the
Northside for both units. Mr. Ward stated that that this project meets the 10% open
space requirements by having 30% of open space as a whole project. But to maintain
uniformity the applicant is asking for a waiver on the 100 square feet of private space.
Mr. Ward stated that the applicant feels like the open space will create a community fill
that can be used for private space. Mr. Ward verified that this application meets all the
City's PUD requirements other than the requested waiver. Mr. Ward also stated that the
developer will maintain control and maintenance of the units, and that the units are
planned to remain under common ownership.
Councilmember Ellis wanted to know if the applicant was asking for a waiver on the
private space because they were giving more open space to the residents.
Councilmember Ellis wanted to know if the Southside could have individual Garbage
cans instead of having to cross the street. Councilmember Ellis asked Nate Jensen if he
had any thoughts as a developer.
Mr. Jensen stated that he was for the development and the requested waiver. Mr.
Jensen gave the Council some ideas and suggestions to consider.
Councilmember Baumeister was concerned about the open space differences
between the two units. Councilmember Baumeister also was concerned about only
having one dumpster on the Northside. Councilmember Baumeister was concerned
about residents leaving garbage on the doorstep until they could run across the street,
and having animals getting into it.
Councilmember Lewis gave Mr. Ward the PUD requirements to verify that this
application meets all the requirements. Councilmember Lewis wanted to know how the
applicant was going to maintain all common areas. Councilmember Lewis was
concerned about the danger of having residents and/or their children crossing the road
to empty the garbage. Councilmember Lewis wanted to know if the Developer would be
willing to put in a garden space for the residents to use instead of waiving the private
space requirement. Councilmember Lewis asked Captain Guiberson if Chubbuck Police
had any thoughts or concerns.
Captain Bill Guiberson stated that his only concern would be street lighting.
Mayor England opened the public hearing and due to no public comment then closed the hearing
2. An application for a Preliminary Plat for "Evans PUD". Proposed division is 4 residential
lots and 2 common area lots on approximately 0.5 acres. Located Northwest % of
Section 3, Township 6 South, Range 34 East of the Boise Meridian, City of Chubbuck,
Bannock County, Idaho. Approximate location is on north and south sides of Belva Lane
at approximately 159 Belva Lane. Application will be evaluated against criteria
established municipal code §17.12.100. On 9/12/17, the Land Use & Development
Commission recommended approval of the Preliminary Plat and of a waiver request
from the 50 foot local right right-of-way requirement.
Stuart ward of Dioptra didn't have anything else more to address for the plat that
was different from the plan, except for Mr. Ward presented the waiver to maintain the
current 25ft right of way on Belva Lane.
Mayor England opened the public hearing and due to no public comment then closed the hearing.
GENERAL BUSINESS:
1. Bannock Development Corporation Progress Report Presentation
Executive Director John Regetz represented Bannock Development Corporation, and
presented a progress report to the Council.
2. Approval of Evans PUD Preliminary Plan
City Planner Paul Andrus stated that in the City's code 18.20.25 gives the Council the
ability to waive requirements for an infill project. Mr. Andrus also stated that staff
recommends approval of the development with the requested waiver.
Councilmember Baumeister motioned for approval of Evans PUD Preliminary Plan with the
waiver of the 100 square feet of private space per unit requirement. Also with the condition
that sanitation is resolved on the Southside or added street lighting solution.

3. Approval of Evans PUD Preliminary Plat
City Planner Paul Andrus stated that staff recommends approval of the development
with the requested waiver.
Councilmember Ellis motioned for approval of Evans PUD Preliminary Plat as presented with
the exemption of the 50ft right of way.

4. Approval of Jensen's Cove Final Plat
City Planner Paul Andrus stated that staff recommends approval of the final plat with
the condition of a cash in lieu of the park.
Councilmember Lewis motioned for approval of Jensen's Cove Final Plat, subject to the
conditions set forth in the preliminary plat.

5. Approval of Integrity Estates Div. 2 Final Plat
City Planner Paul Andrus stated that staff recommends approval of the final plat with
the condition to provide cash in lieu of a park.
Councilmember Baumeister motioned for approval of Integrity Estates Div.2 final plat, with the
condition for a cash in lieu of a park in the amount of $2,138.21 per lot.

6. Acceptance of Offer of Dedication for Sunset West Div. 9
Public Works Director Rodney Burch stated that staff recommends acceptance of offer
of dedication.

7. Approve items for auction
Public Works Director Rodney Burch recommends approval for these items for
auction. Mr. Burch stated that the City has had a greater return on investment with
internet auctions than with local auctions.
