Land Use and Development Commission Meeting Minutes
May 9, 2017 - 7:00 p m
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall,
5160 Yellowstone, on May 9, 2017.
Chairman Jason Mendenhall: Commission Members: Mike Schwartz, Dan Stoddard, Jay Buttars, Brady
Smith, Thais Ayre, Brandon Jackson, and Carrie Holm. Public Works Director: Rodney Burch, City Planner:
Paul Andrus. Attorney: Tom Holmes, Office Administrator: Ranelle Simmons
Chairman Mendenhall called the meeting to order at 7:00 pm.
Mendenhall led the commission in the Pledge of Allegiance.
Mendenhall asked if any commissioners had a conflict of interest within the items before the board
tonight. Buttars abstained from item # 2 and Holms from # 2.
APPROVAL OF THE MINUTES: April 11, 2017
Mendenhall entertained a motion to approve the minutes as mailed. Schwartz moved the minutes of
April 11, 2017 meeting be approved as mailed; Ayre seconded. The full authority approved.
PUBLIC HEARING
1. An application by Mason Lewis, 15136 West Hunziker Road, Pocatello, ID 83202 for the
Preliminary Plat for Lewis Subdivision located in Northeast % of Section 4, Township 6 South,
Range 34 East, of the Boise Meridian in the County of Bannock, approximately 555 Homestead
Road.
Stewart Ward, Dioptra, 4737 Afton Place Suite B, Chubbuck Idaho 83202 was present representing the
applicant.
This land is West of Walsh Estates Subdivision on Homestead Road with approx. 1 acre. Water and sewer
services will be added for his home. The existing irrigation system will remain a private irrigation system.
Mendenhall opened the Public Hearing.
No comments from the public, Public Hearing was closed and brought back to the commission.
Mendenhall entertained a motion. Schwartz moved to recommend approval of the Lewis Subdivision
preliminary plat application. Jackson seconded.
Roll Call Vote: Buttars, yes; Smith, yes; Jackson, yes; Ayre, yes; Holm, yes; Schwartz, yes;
Stoddard, yes; Mendenhall, yes. Motion carries.
The application moves to City Council on May 17, 2017 at 6 pm.
2. An application by DelTam 3 and Briscoe Bybee Contractors for a Change in Land Use District for a
portion of the Grove Subdivision from single family residential (R-1) to limited commercial (C-1).
Located Northeast % of Section 8, Township 6 South, Range 34 East, of the Boise Meridian in the
County of Bannock, Philbin Road between 1-86 and West Chubbuck Road.
Stewart Ward, Dioptra, 4737 Afton Place Suite B, Chubbuck Idaho 83202 was present representing the
applicant.

Approx. 2 acres being applied for rezoning from single family residential (R-1) to limited commercial (C-
1).This is currently outside the Grove Subdivision on Philbin Road. The Grove Subdivision Phase 2 when
the platting was done the owners decided not to include the 2 acres in the residential subdivision.
University Bible Church across Philbin Road is zoned commercial.
Mendenhall opened the Public Hearing.
Mike Popovich 6215 Fruitwood Pocatello, Idaho neutral. Representing First Baptist Church that owns
land on the southeast corner of Sawtooth. Holmes explained that city code has guidelines for what can
be built in limited commercial C-1. If the application to build is permitted the City cannot deny unless
there were other issues. If the application is not permitted it can be submitted for approval with a
Conditional Use Permit that would be a Public Hearing meeting.
Ryan Corn 1400 Sawtooth Chubbuck, Idaho neutral. Second access battle was lost by residents. Philbin
Road has crazy traffic on it.
Roy Thompson, 1331 Sawtooth Chubbuck, Idaho opposed. We were told a year ago there couldn't be a
second exit when it was residential but now that they want to change to commercial a second exit will
be required. Emergency vehicles will not be able to access.
Lynn Olsen 1330 Sawtooth Chubbuck, Idaho opposed. Agrees with Mr. Thompson. Cars are coming into
our subdivision to turn around.
Roger Cameron 1414 Sawtooth Chubbuck, Idaho opposed. Built their home 3 years ago. Residents were
told a year ago that there could never be a second road to Philbin and now you're saying there will be.
Philbin Road needs to be 4 lanes. 30 more homes are going to be built so a second access is a must.
Ian Nicely 1401 Sawtooth Chubbuck, Idaho opposed. Agrees with Mr. Thompson and Mr. Cameron.
Emergency vehicles can't get in.
Matt Taylor 1429 Sawtooth Chubbuck, Idaho opposed. Lots of accidents this winter on Philbin. Agrees
with what has already been stated. There is not enough parking for a business to be built.
Danny Elder 1318 Sawtooth Chubbuck, Idaho opposed. Agrees with what has been said. Want the area
to still have the country feel.
Mendenhall closed the Public Hearing bringing the meeting back to the commission
Commission and City Staff comments:
• Concerns with not having another access into the residential area.
• This development would be required to do the same improvements on Philbin Road as University
Bible Church has done.
• City has no plans to improve Philbin Road.
• The application is in the Comprehensive Plan but this is a bad decision to recommend approval.
• The limit of 90 homes had not been met in the beginning when a second access was not
required.
• Frontage length is approx. 450 feet.
• Acceleration and deceleration lanes length depends on the speed limit on the road. Those lanes
would be dealt with when platted.
• The rezone is because the land is being sold and the new owner will be required to plat before
anything can be built.
Mendenhall entertained a motion. Ayre made the motion to recommend denial of the rezone of the
parcel from (R-1) single family residential to (C-1) limited commercial. Smith seconded.

Roll Call Vote: Smith, yes; Jackson, no; Stoddard, yes; Ayre, yes; Mendenhall, yes; Schwartz, yes.
Motion is approved.
GENERAL BUSINESS
1. An application by Matt Shiozawa, 5328 Yellowstone Ave., Chubbuck, ID 83202 for Final PUD Plan
for Lot 1, Block 2 of Mingo Subdivision. Location is 5202 Lucky Street.
Stewart Ward, Dioptra 4737 Afton Place Suite B, Chubbuck Idaho. This is the 3rd step in a total of 4 for
this application. Past concerns were privacy space. Layout with 4 buildings has stayed the same with 45
parking stalls. Patio was enlarged to 20' x 20' from 15' x 15'. There will also be a tether ball court.
Construction drawings are with City Staff for approval.
Burch read the City Council 5 recommendations that were in their motion from the March 15, 2017
meeting.
• Stop sign required at exit to Lucky Street
• 6' high privacy fence on the South, East and North sides of property
• Establishment of HOA to maintain common areas
• Resolve gravity irrigation issues with adjoining land owner, this is in the North East corner of the
property
• Proof of open space sufficient to offset 100 s. f. private space
Ward explained how these recommendations are being handled.
Mendenhall entertained a motion. Schwartz moved to recommend approval of the Final PUD Plan for
Lucky Lane Apartments PUD located at 202 Lucky Street with conditions set forth by City Council being
satisfied. Butters seconded.
Roll call Vote: Jackson, yes; Holm, yes; Buttars, yes; Smith, yes; Schwartz, yes; Stoddard,
yes; Ayre, yes; Mendenhall, yes. Motion is approved.
2. Announce the 4 year reappointment of Mike Schwartz to seat 1 and Dan Stoddard to seat 2.
3. Elect Commission Chairman and Vice -Chairman for the term ending May 31, 2018.
Mendenhall opened the nominations for chair and vice chair. Buttars nominated Mendenhall for Chair
and Stoddard to be the Vice -Chair. All voted in favor
Mendenhall entertained a motion to adjourn; Schwartz made the motion. Holm seconded. All voted to
adjourn at 7:55 pm.
