0750 Vacating Certain Platted Rights of Way21515033 CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 750 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, VACATING CERTAIN PLATTED RIGHTS OF WAY FOR ALL OF VICTORIAN CIRCLE AND A PORTION OF BURLEY DRIVE AS MORE FULLY DESCRIBED IN THE LEGAL DESCRIPTIONS ATTACHED TO THE ORDINANCE; SAID RIGHTS OF WAY ARE NOT USED BY THE CITY; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Vacation. The platted right of way of Victorian Circle from its Easterly terminus running West to its intersection with Central Way as described on the attached Exhibit A and that portion of Burley Drive from its Southerly terminus, North approximately 764 feet and more fully described on the attached Exhibit B are both hereby vacated. Section 2. History. The right of way for Victorian Circle was established by plat but never improved. That portion of Burley Drive being vacated is improved but with the purchase by Idaho Central Credit Union of all adjoining properties, the replatting of those properties in the Idaho Central Complex plat and the redevelopment of the land within that plat, these rights of way will not be necessary and are vacated. Section 3. Recording. The City Clerk is hereby directed to cause the ordinance to be recorded in the records of Bannock County. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City and any provision of the Municipal Code which are in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. Section 2. Severability. The sections of this ordinance are severable. The invalidity of a section shall not affect the validity of the remaining sections. Section 3. Effective Date.
