AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING, IN
ACCORDANCE WITH IDAHO CODE § 50-707 FOR THE DESIGNATION OF
SEATS HELD BY EACH CITY COUNCILMAN; PROVIDING FOR THE ELECTION
OF THE CITY COUNCIL BY ODD NUMBERED SEATS BEGINNING WITH THE
GENERAL ELECTION IN NOVEMBER OF 2015 AND EVEN NUMBERED SEATS
WITH THE GENERAL ELECTION IN NOVEMBER OF 2017; REPEALING PRIOR
CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE
PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS
ORDINANCE IS EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Adoption of Section 2.08.050 of the Chubbuck Municipal Code. The
following Section 2.08.050 is hereby adopted and made a part of the Chubbuck Municipal Code:
2.08.050: ELECTION OF CITY COUNCIL:
A. Size and Term of Council. The city council shall be four (4) in number, designated
by seat in accordance with sub -paragraph B and elected at large. Each member shall serve for a
term of four (4) years
B. Designation Of Council Seats:
Prior to the city council election in November 2015, each council seat
shall be numbered as allowed by Idaho Code § 50-707. The city clerk shall
assign the following numbers to each seat: seat 1, seat 2, seat 3, and seat 4,
with seats 1 and 3 being assigned to the Council members up for election
in November, 2015 and seats 2 and 4 being assigned to the Council
members up for election in November, 2017.
2. Any candidate seeking election to the city council shall designate the seat
sought on the petition for candidacy. A candidate can file for only one
council seat. The candidate shall meet all other qualificatiori.s for the office
of city council member, as required by law.
Commencing at the general city election to be held in November 2015,
seats 1 and 3 shall be the council seats for which city council candidates
may file. Commencing at the general city election held in November 2017,
seats 2 and 4 shall be the council -seats for which city council candidates
may file. Henceforth, the odd numbered council seats and the even
numbered council seats shall be elected in alternate general city elections
in the same rotation pattern.

9 ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City and any provision of the Municipal Code which are in conflict with the provisions of this
Ordinance are repealed to the extent of such conflict.
Section 2. Severability. The sections of this ordinance are severable. The invalidity of
a section shall not affect the validity of the remaining sections.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication.
