ORDINANCE NO.
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, VACATING CERTAIN
RIGHTS OF WAY IN THE MAGELBY MANORS ADDITION AND MAGELBY
MANORS FIRST ADDITION AS MORE FULLY DESCRIBED IN THE LEGAL
DESCRIPTIONS ATTACHED TO THE ORDINANCE; SAID RIGHTS OF WAY ARE
NOT USED BY THE CITY; REPEALING PRIOR CONFLICTING ORDINANCES;
PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Vacation. The rights of way described on the attached exhibits being in
Magelby Manors Addition and Magelby Manor First Addition are hereby vacated.
Section 2, History. These rights of way were established by the plats for said
subdivisions but were rendered unnecessary by the platting of the Frasure Industrial Park ' 1 s`
Addition in 1998 and the resulting alignment of Laurel Lane therefrom. These rights of way
have not been used by the City and do not need to be preserved for City use. Any rights of way
granted by the above-described subdivision plats for which the real estate is not described herein
are not vacated but shall remain in effect.
Section 3. Recording. The City Clerk is hereby directed to cause the ordinance to be
recorded in the records of Bannock County.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City and any provision of the Municipal Code which are in conflict with the provisions of this
Ordinance are repealed to the extent of such conflict.
Section 2. Severability. The sections of this ordinance are severable. The invalidity of a
section shall not affect the validity of the remaining sections.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall become

effective upon its passage, approval and publication.

An ordinance of the City of Chubbuck, a municipal corporation of the state of Idaho,
vacating certain rights of way in the Magelby Manors Addition and Magelby Manors First
Addition as more fully described in the legal descriptions attached to the ordinance; said rights of
way are not used by the City; repealing prior conflicting ordinances; providing for the
severability of the provisions of this ordinance; providing when this ordinance shall be in effect.
