AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
8.34.060 TO PROVIDE A BURN PERMIT SHALL BE VALID FOR THE CALENDAR
YEAR OF ISSUANCE, TO PROVIDE FOR REPORTING OF EACH BURN BY
PHONE TO POLICE DISPATCH; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS OF CHAPTER
8.34 NOT AMENDED SHALL REMAIN IN EFFECT; AND PROVIDING WHEN
THIS ORDINANCE IS EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Amended Section 8,34.060. Section 8.34.060 is amended to read as follows:

A. A permit is required in all cases except for a recreational fire or for burning inside in a
fireplace, incinerator or wood stove. The fire chief or the chiefs designee is authorized to issue a
permit for burning upon application by applicant. The purpose of the permit is to provide a
record of the location of any bum and the name of the person responsible for conducting the
bum. The permit and application shall be in a form furnished by the fire chief. The application
and the permit shall provide the following information:
1. Location of the proposed open bum;
2. Expected duration of the open bum;
3. Materials to be burned;
4. Name, address and phone number of the person applying for the permit and of the
person that will be responsible for conducting the open bum, if different;
5. Expected date of bum, including if the bum will be at various times during the permit
period.
B. The permit shall be valid fbi Nvo (2) weeks fiorn the calendar year of issuance for the
applicant and the site. If the identity of the responsible person or the location of the proposed
open bum change, the permit shall be void. The responsible person shall in all instances advise
the fire departmi: Chubbuck police dispatch center, by phone Orin person, prior to starting the
each bum.
C. The permit may be revoked or suspended by the chief or the chief s designee if
conditions are inappropriate for a bum. In case of revocation or suspension, the permittee shall be
immediately notified of the action.
D. This permit shall be in addition to a permit required by any other jurisdiction having
control within the same area,

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City and any provision of the Municipal Code which are in conflict with the provisions of this
Ordinance are repealed to the extent of such conflict. All other sections of Chapter 8.34 not
herein amended shall remain in effect.
Section 2. Severability. The sections of this ordinance are severable. The invalidity of a
section shall not affect the validity of the remaining sections.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall become
effective upon its passage, approval and publication.

SUMMARY OF ORDINANCE NO. 7P -
An ordinance of the City of Chubbuck, a municipal corporation of the state of Idaho,
amending section 8.34.060 to provide a burn permit shall be valid for the calendar year of
issuance, to provide for reporting of each burn by phone to Chubbuck police dispatch; providing
for the repeal of conflicting ordinances; providing that all other provisions of Chapter 8.34 not
amended shall remain in effect; providing for the severability of the provisions of this ordinance;
providing when this ordinance shall be in effect.
