HomeMy WebLinkAbout2013-005 Landlord Agreement RESOLUTION# 2013-05 CITY OF CHUBBUCK A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO, LIMITING THE NUMBER OF DEPOSITS REQUIRED FOR A LANDLORD WHO ENTERS INTO A CONTINUOUS UTILITY SERVICE AGREEMENT WITH THE CITY OF CHUBBUCK. The City of Chubbuck has prepared a Continuous Utility Service Agreement for use with Landlords. The agreement will allow utility services to revert back to the landlord's account when the property is vacant rather than terminating the service and having the landlord set up services each time the property is vacant. Section 13.04.090 Chubbuck Municipal Code specifies that at the time of application for utility service, the owner of the property requesting such service shall deposit with the city clerk the sum of one hundred dollars ($100) or such amount as may be adopted in the future from time to time by resolution of the mayor and council, for each service connection. Presently the utility deposit in Chubbuck is $100 per connection or if the occupant or owner has been delinquent, 3 times the estimated minimum monthly utility bill. The Mayor and Council of the City of Chubbuck, Idaho finds that it is burdensome for a Landlord with multiple properties to have to make deposit of$100 for each property and there for adopt the following resolution to limit the total number of deposits from each landowner who enters into a continuous utility service agreement with the City: Each land owner will be required to pay the current deposit for each service connection to such lot, property, building or residence with the total number of deposits for each continuous utility service agreement up to but not to exceed five (5) deposits for a total maximum deposit of $500. If the landowner has been delinquent, the deposit will be 3 times the estimated minimum monthly utility bill for the Landlord's five properties with the largest individual utility bills but not to exceed five properties. City staff is authorized to take all necessary steps to carry out the deposit collection provided by this Resolution.
