Land Use and Development Commission Meeting Minutes
April 11, 2017 - 7:00 pm
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City
Hall, 5160 Yellowstone, on April 11, 2017.
Chairman Jason Mendenhall: Commission Members: Mike Schwartz, Dan Stoddard, Brady
Smith, Thais Ayre, Brandon Jackson, and Carrie Holm. Public Works Director: Rodney Burch, City
Planner: Paul Andrus. Attorney: Tom Holmes, Office Administrator: Ranelle Simmons
Chairman Mendenhall called the meeting to order at 7:00 pm.
Mendenhall asked if any commissioners had a conflict of interest within the items before the
board tonight.
Jackson led the commission in the Pledge of Allegiance.
APPROVAL OF THE MINUTES: February 14, 2017
Mendenhall entertained a motion to approve the minutes as mailed. Stoddard moved the
minutes of February 14, 2017 meeting be approved as mailed; Holm seconded. The full
authority approved.
PUBLIC HEARING
An application by The City of Chubbuck, 5160 Yellowstone Avenue, Chubbuck, ID 83202
for the annexation into the City of Chubbuck all of Lea Avenue and Lamar Street right-
of-way as depicted on the Lamar Acres No. 1 subdivision plat.
Rodney Burch Public Works Director for the City of Chubbuck was in attendance to represent
the application. Part of the motion by City Council to approve the final plat on Brookstone
Estates Division 7 the developer is required to have a second access road to West Chubbuck
Road. The Lamar right of way is under county jurisdiction and if the City only annexes Lamar the
County would have to drive on a City road, Lamar, to get to a County road, Lea. Makes sense to
have the right-of-way for both streets annexed at the same time. This does not affect home or
land owners, it is only the road.
Answers to questions from commissioners:
Division 7 will have a cul-de-sac at north end of Lamar for a temporary turn around
Rockwell Homes will improve Lamar with this phase
Lamar will be completely reconstructed at developer cost
City Staff: No questions or comments

Carol Newbold 11057 North Lamar Street Pocatello, ID 83202 had questions.
• Will curb and sidewalk be required?
• Sewer stake on their property. Why is the stake there?
• Opposed because horse trailers are driven on the road often and the increase in traffic
will be a problem.
• Will grandfather rights be protected?
• Has division 7 been annexed?
Wayne Newbold 11057 North Lamar Pocatello, ID 83202 asked for clarification on what land is
City and what is County.
Mendenhall closed the Public Hearing.
Burch answered the questions:
• Developer will build the roads to city standards. No jurisdiction on their homes, only the
right-of-way.
• Stake on their property is because the developer is running a new sewer line to service
the new division. Utilities have been stubbed into the right-of-way of the adjoining
parcels to Lamar. Nothing has been done on private property.
• Developer is building a 3 lane road with curb and gutter on the east side of Lamar. If the
west side of Lamar is developed that developer will be responsible for that curb and
gutter.
• Horse trailers are being unloaded in the road right-of-way.
• No grandfather rights in the City but they are in the County.
• Homes on West Chubbuck Road are in the County.
• Both lanes of Lamar will be City instead of % of the road being maintained by the County
and % of the road being maintained by the City.
Mendenhall entertained a motion. Schwartz moved to recommend approval of the annexation
of Lamar and Lea streets right-of-way; Holm seconded.
Roll call vote: Brady Smith, yes; Brandon Jackson, yes; Thais Ayre, yes; Carrie Holm, yes;
Mike Schwartz, yes; Dan Stoddard, yes; Jason Mendenhall, yes. Motion passes.
2. An application by The City of Chubbuck, 5160 Yellowstone Avenue, Chubbuck, ID 83202
for the zoning change for all of Lea Avenue and Lamar Street right-of-way as depicted on
the Lamar Acres No. 1 subdivision plat. Existing zoning is County, proposed zoning is
Single Family Residential (R-1).
Rodney Burch Public Works Director for the City of Chubbuck was in attendance to represent
the application. When a property is annexed into the city it needs to be rezoned from county.
Andrus stated R-1 meets the Comprehensive Plan and is reflective of the other uses around it.
Mendenhall opened the Public Hearing.

No public comments. Mendenhall closed the Public Hearing bringing the meeting back to the
commission.
Mendenhall entertained a motion. Ayre moved to recommend approval of zoning to R-1 single
family residential; Schwartz seconded.
Roll call vote: Dan Stoddard, yes; Thais Ayre, yes; Mike Schwartz, yes; Carrie Holm, yes;
Brady Smith, yes; Brandon Jackson, yes; Jason Mendenhall, yes. Motion carries.
Items 1 and 2 will go to City Council on April 19 at 6 pm.
GENERAL BUSINESS
1. Discuss the Comprehensive Plan Changes Summary.
Andrus provided a summary in the meeting packets that were mailed. Maps were not included
in the packets. Staff recommends having City Council review the Comprehensive Plan before a
public hearing is held at a Land Use meeting.
Andrus explained the Introduction page still has 2020 because it is a name of a 2020 vision for
The Portneuf River Valley and Our Valley Our Vision document.
The list of changes were read by Mendenhall with no concerns by commission members.
Commission is ready for this to move forward to City Council.
Mendenhall welcomed Brandon Jackson to the board. Burch explained Jackson is the facilities
manager for Idaho Central Credit Union.
Mendenhall entertained a motion to adjourn; Schwartz made the motion; Holm seconded. All
voted to adjourn at 7:50 pm.
