HomeMy WebLinkAbout002.14.17City of Chubbuck Land Use and Development Commission Meeting Minutes February 14, 2017 - 7:00 pm Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on February 14, 2017. Chairman Jason Mendenhall: Commission Members: Dan Stoddard, Jay Buttars, Brady Smith, Russ Armstrong, Carrie Holm, and Bryan Nield. Public Works Director: Rodney Burch, City Planner: Paul Andrus. Attorney: Tom Holmes, Office Administrator: Ranelle Simmons Chairman Mendenhall called the meeting to order at 7:00 pm. Mendenhall asked if any commissioners had a conflict of interest within the items before the board tonight. Smith has a conflict with items 1 and 2. Holms led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: January 10, 2017 Mendenhall entertained a motion to approve the minutes as mailed. Buttars moved the minutes of January 10, 2017 meeting be approved as mailed; Holms seconded. The full authority approved. PUBLIC HEARING 1. An application by Precision Properties, PO Box 4082 Pocatello, ID 83205 for PUD Preliminary Development Plan for proposed Antler Ridge Subdivision for Multifamily Infill Planned Unit Development, PUD. Located in the Southwest quarter of the Southwest quarter of Section 2, Township 6 South, Range 34 East of the Boise Meridian in Bannock County. Location is North of East Chubbuck Road and West of Kays Kove. Mitchell Greer, Rocky Mountain Engineering and Survey, 600 East Oak Pocatello, ID 83204 was in attendance representing the application. RMES had a 3D representation of the apartment buildings and property. Site is located at the corner of Hiline Road and East Chubbuck Road. RMES has a history of development in this area. The project area is 2.35 undeveloped ground. Current zoning is R-2, Limited Residential, the application is proposing Residential Infill PUD. Codes and Comprehensive plan are looked at when developing. This project is located within Mixed Use designated area. Predevelopment meeting with City staff have been held. Total of 44 units with 11 buildings providing 98 parking places when 88 is required. Possible amenities are basketball court, BBQ area, personal recreation area and playground. Storm water control will be in the park area. There will be a gated access into Kays Kove Subdivision on Emma Lane that will only be opened for emergencies. Polder Lane to Whitaker Road and road to East Chubbuck Road are the possible main accesses to the apartment buildings. PUD ordinance allows density bonuses but the application is not asking for any. Common concerns are decrease in property value, increased traffic, increase in crime and loss of neighborhood identity/ integrity. This is not low income housing but market value. The proposal complies with the Comprehensive Plan and consistent with City Codes. Mendenhall asked if commissioners had any comments or questions. Mendenhall stated 3 residents submitted testimony letters, Jack W. Wells, Kenneth M. Olney and Susan Ganske. Land Use commission received a copy and the letters will be in the packets for City Council's meeting. Mendenhall opened the Public Hearing. Matt Spears, 829 Wendy Chubbuck, ID 83202. In favor because of tax revenue and more options for housing. There was opposition to the development of Kays Kove. If we don't have growth the City will become stagnant. Cliff Spears, 1285 Wright Avenue Pocatello, ID 83201. Owner of the property for 10 years and this has been the plan from the beginning. Idaho is the 3rd fastest growing state. Therese Marchetti, 4861 Reed Street Chubbuck, ID. Everyone that lives in Kays Kove are opposed. Not opposed to R-2 or townhomes. Blinda Thomas, 4832 Polder Lane Chubbuck, ID 83202. This area is not suited for apartments. Concerned with the upkeep. Polder Lane cannot handle more traffic. Kristan Long, 608 Nathan Ave., Chubbuck, ID 83202. Mother lives in Kays Kove. Opposed. Concerned with zoning, mixed use was not meant for high density but commercial because of Chubbuck Road. Other high density areas nearby are bordered by interstate, agricultural or railroad tracks. Only opposed to high density not development. Also concerned with Code Enforcement and the upkeep continuing over time. Property owners in Kays Kove have the right to put a boulder in the middle of Emma. Paul Whitaker 4821 Reed Street, Chubbuck, ID 83202. Mother lives at Kays Kove. Opposed Emma Lane should not be an emergency exit. Concerned with city codes and upkeep. A dumpster outside a Kays Kove window is not acceptable. Linda Bundy, 620 Emma Lane Chubbuck, ID 83202. Concerned with the amount of trash that will be generated and the dumpsters container staying clean. Allen Quinn, Unit 4840 in Kays Kove Chubbuck, ID 83202. Opposed. Declaration and CC&R for Kays Kove was not taken into consideration. Emma Lane belongs to Kays Kove and is not for sale. Amendment to the declaration is in the process of being drafted. Ross Minson, 4840 Whitaker Chubbuck, ID 83202. Presented a letter from Wayne and Alane Hale to City Staff. Opposed to the high density housing with the 2 story design. Polder Lane is not a good access road. Not large enough parking spaces by the apartments for larger vehicles. Concerned with the irrigation line to his property and the proposed storm water collection site. Sharon Long 4831 Reed Street Chubbuck, ID 83202. 3 concerns privacy, safety and increased traffic. Strongly oppose zoning changes. Tamara Oney, 4448D Chucker Chubbuck, ID 83202. Father lives in Kays Kove and wrote a testimony letter. Fathers concern is he is a snow bird and to be away from his home would it be safe? Her concerns are his safety and property value. Opposed. If there is a road next to her home there are concerns. Keep the development as owner occupied. Gates should not be happening. Apartments are too close to her property line. Nothing has been said about irrigation. Storm water run- off is not well planned. Stay with a twin home design. Hunter Bennett, 1530 Jessie Court Pocatello, ID 83201. Lives by OK Ward Park that is not well maintained. Safety of kids is a concern. Traffic and kids on bikes could be a problem. Nicki Taysom, 4963 Yellowstone Chubbuck, ID 83202. Opposed. Children's safety is a concern. People don't respect if they don't own. Too much light and school population are concerns. Sanitation dumpster will be an issue. Losing open spaces. Lee Goddard, 4842 and 4852 Polder Lane Chubbuck, ID 83202. The road can't handle the traffic. Privacy is an issue. Mendenhall closed the Public Hearing bringing the meeting back to the commission reminding commission this is a recommendation to City Council. Mitchell Greer Rocky Mountain Engineering and Survey, 600 East Oak, Pocatello, ID 83204. There will be an increase in traffic but it is not significant. Greer addressed questions: • Traffic on a public street will increase with development • When Kays Kove was built the plan was to connect Emma Lane to Polder Lane • The access to Chubbuck Road can be moved to phase 1 instead of phase 2 • The owner for this project lives in the area and there will be an onsite manager • CC&Rs were not researched for this project • Irrigation and storm water will be handled during the design process • PUD ordinance standards have been met • The dumpster can be moved to another area • The distance from the south apartment unit to 530 E. Chubbuck Road can be adjusted Mendenhall concerned with only 1 access into the development. Burch addressed City Code 18.20.040's opening paragraph. It is speaking about multiple uses inside a single PUD and that they could have up to 10% of the gross land directed to a different use. 18.20.040D is if they access a collector road, this does not apply with this application. Yes traffic will increase on Polder Lane but it is less than 10% of most of the residential streets in the city. It is 200' from Polder Lane to East Chubbuck Road. Andrus explained the Comprehensive Plan calls for mixed use which goes from R-1 to C-1 in the area on Chubbuck Road by the project. There are several different zonings along that area, PUD next door, R-2, C-1 and C-2 across E. Chubbuck Road. PUD and R-2 are the zoning next to the proposed project. Mendenhall entertained a motion. Stoddard made a motion that the recommendation to City Council is to not approve this application. Nield seconded. Roll Call Vote: Jay Buttars, No; Russ Armstrong, Yes; Carrie Holm, Yes; Bryan Nield, Yes; Dan Stoddard, Yes; Jason Mendenhall, Yes. Motion carries. 2. There are 11 lots that would be for sale in the preliminary plat. Each building will be a lot. Access to utilities is on site and there is a public utility easement over Emma Lane. Questions or comments from City staff. Burch added the memo that was conveyed to commission from staff identifies that they do meet the criteria of the City platting codes relative to a preliminary plat for a PUD if the zoning is PUD. Staff recommends approval. Mendenhall opened the Public Hearing. Tamara Oney, 4448D Chucker Chubbuck, ID 83202. The Kays Kove Home Owners Association ask that she state they are opposed. Nicki Taysom, 4963 Yellowstone Chubbuck, ID 83202. Opposed. Terry Taylor, 530 E. Chubbuck Road, Chubbuck, ID 83202. PUD would be in the middle of owner occupied single homes causing traffic issues. Road access next to her property is a concern. Mendenhall closed public hearing bringing the meeting back to the commission. Holmes noted that the preliminary plat needs to be recommended for denial to City Council because the PUD plan was recommended for denial. It would be confusing if the PUD plan is a denial recommendation and preliminary plat is an approval recommendation. Mendenhall entertained a motion. Nield made a motion to recommend to City Council denial of the preliminary plat application. Stoddard seconded. Roll Call Vote: Russ Armstrong, Yes; Dan Stoddard, Yes; Bryan Nield, Yes; Jay Buttars, No; Carrie Holm, No; Jason Mendenhall, Yes. Motion carries. GENERAL BUSINESS 1. An application by Matt Shiozawa, 5328 Yellowstone Ave., Chubbuck, ID 83202 for Preliminary PUD Plan for Lot 1, Block 2 of Mingo Subdivision for Multifamily Infill Planned Unit Development, PUD. Location is 5202 Lucky Street. There were questions in last month's meeting regarding open space. Andrus stated the 100' open space can be waived because it is an infill PUD. It does meet density calculations. Mendenhall reminded commission that this is a recommendation to City Council to approve or deny the application and entertained a motion. Buttars made a motion to approve the application by Matt Shiozawa forthe Preliminary PUD Plan Lot 1, Block 2 of Mingo Subdivision located at 5202 Lucky Street with the waiver for the 100' of private space. No second, motion died. Stoddard made a motion to recommend approval of the application at 5202 Lucky Street while requiring 100 square foot of private space. Armstrong seconded. Roll Call Vote: Russ Armstrong, Yes; Carrie Holm, Yes; Jay Buttars, Yes; Brady Smith, Yes; Dan Stoddard, Yes; Bryan Nield, Yes; Jason Mendenhall, Yes. Motion carries. Smith moved to approve the application by Matt Schiozawa, 5328 Yellowstone Ave., Chubbuck, ID 83202 for preliminary plat for Lucky Lane Apartments PUD. Lot 1, Block 2 of Mingo Subdivision. Buttars seconded. Roll Call Vote: Carrie Holm, Yes; Dan Stoddard, Yes; Brady Smith, Yes; Russ Armstrong, Yes; Bryan Nield, Yes; Jay Buttars, Yes; Jason Mendenhall, Yes. Motion carries 3. Discuss changing Land Use meeting because March 10 is School District 25 Supplemental Levy Election. Council Chambers is a polling place. City Council meets Wednesday the 15t' Mendenhall recommended cancelling March's meeting. Commissioners agreed. March meeting is cancelled. Burch thanked Russ Armstrong for his service because this is his last meeting as a Land Use Commissioner. Mendenhall entertained a motion to adjourn; Smith made the motion. Nield seconded.
