Vice Chairman Dan Stoddard: Commission Members: Mike Schwartz, Jay Buttars, Brady Smith, Thais Ayre, and Carrie Holm. Engineering Technician: Sean Harris. Attorney: Tom Holmes. Office Administrator: Ranelle Simmons Vice Chairman Stoddard called the meeting to order at 7:00 pm. Smith led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: Stoddard entertained a motion to approve the minutes as mailed. Buttars moved the minutes of December 13, 2016 meeting be approved as mailed; Schwartz seconded. The full authority approved. Smith has a conflict of interest with item #s 3, 4, 5 and 6. Ayre was the closing agency for items 1 & 2. This is not a conflict of interest but she wanted to have it on record. The transactions are closed. PUBLIC HEARING 1. An application by Matt Shiozawa, 5328 Yellowstone Ave. Chubbuck, ID 83202 for Preliminary PUD Plan for Lot 1, Block 2 of Mingo Subdivision for Multifamily Infill Planned Unit Development, PUD. Located in Northwest % Section 3, Township 6 south, Range 34 East of the Boise Meridian in Bannock County. Location is 5202 Lucky Street. Stewart Ward, Dioptra 4751 Afton Place Suite B Chubbuck, ID was present representing the applicant. This is a PUD for a 4 building complex with 2 and 3 bedroom apartments. Current zoning is R-2, with a PUD it will be R-4. Avalon Park and Spring Park apartments are also zoned PUD. Water and sewer lines will be stubbed from Lucky Avenue. Applicant has dedicated 13% of open space, the ordinance calls for 10%. Dance PUD and Bobcat PUD on Siphon Road is very similar to this development. 100% funded by the applicant. Applicant is asking for the 100 square feet open space per unit be waived for this development because there are areas nearby such as Stuart Park, Portneuf Library and other amenities. Comments and questions from the board: • Single wide trailer will be removed along with the storage shed • There are fences on all 4 sides • Allowance in the ordinance on 15% is not being used • There is a dumpster pad that in the future may need to be moved for an access road Staff comments: • Nothing at this time • The waiver of 100 square feet is a City Council decision. Stoddard opened the Public Hearing. Sharron Adams 5212 Lucky Avenue Chubbuck, ID 83202. Opposed. Too much for a 1 acre lot with buildings and parking lots. Unwanted road. Property value will fall. Nicki Taysom 4963 Yellowstone Chubbuck, ID 83202. Object to more apartments. Keep it a residential area. Jeff Judkins 5222 Lucky Avenue Chubbuck, ID 83202. 3rd generation to live on Lucky Avenue. Good neighborhood that could change with apartments. Holly Judkins 5222 Lucky Avenue Chubbuck, ID 83202. Taking away a dream of a quiet neighborhood. Rick Capell 330 James Avenue Chubbuck, ID 83202. Opposed. Huge impact on the neighborhood. Please make sure this project is within the City Code and require the developer to build a fence around the project. Cindy Wellard 5261 Lucky Avenue Chubbuck, ID 83202. Opposed. Need to require a cement wall because kids will break the fence. Stoddard closed the Public Hearing and brought back to the applicant. Stewart Ward: • The design is that residents will park inside the parking lot not on Lucky Avenue. • 100 square foot variance waiver is because of the design of the building, there are no back doors. • Irrigation on the east has an open ditch, on the south has a buried irrigation line. Buried line will stay. Irrigation rights will be transferred to the City. • Minimum is 2 parking stalls per unit with a couple of extras for visitors. Meeting back to commission for questions or comments: • 100 square foot variance is allowed in PUD code. • No density issue in Bobcat PUD or Dance PUD. • Short on City staff so the 100 square foot variance cannot be verified. Matt Shiozawa, 5328 Yellowstone Ave., Chubbuck, ID 83202. Fencing is an easy issue to resolve. This is a preliminary plan and changes can be made. Stoddard reminded commissioners this is a recommendation to City Council for approval or denial of the Preliminary PUD Plan. Stoddard entertained a motion. Schwartz moved to approve the application for the PUD Plan, lot 1, block 2 of Mingo Subdivision for multifamily Planned Unit Development subject to City staff validating density calculations with a request to review the 100 square foot private space requirement. No second, motion dies. Buttars moved in order to get the answers that are needed to table this application until the February meeting. Smith seconded. Roll Call Vote: Mike Schwartz, Yes; Jay Buttars, Yes; Brady Smith, Yes; Thais Ayre, Yes; Carrie Holm, Yes; Dan Stoddard, No. Motion carries. 2. An application by Matt Shiozawa, 5328 Yellowstone Ave. Chubbuck, ID 83202 for Preliminary Plat for Lucky Lane Apartments PUD. Lot 1, Block 2 of Mingo Subdivision. Located in Northwest % Section 3, Township 6 South, Range 34 East of the Boise Meridian in Bannock County. Location is 5202 Lucky Street. Holmes suggested holding the Public Hearing so the application will not have to be republished and re -noticed. Stewart Ward, Dioptra 4751 Afton Place Suite B Chubbuck, ID 83202was present representing the application. Preliminary Plat is very straight forward. Water and sewer will be extended along with other public utilities. Buildings will serve as lots in this plat. Irrigation water rights will be transferred to the City with the irrigation system being built in such a way that they can connect to the secondary irrigation in the future. Sprinkler system will be installed with the capability of switching over to secondary water. City Staff: The plat meets all the standards of the appropriate title and City Code. Recommend conditionally approving with meeting all PUD requirements. Stoddard opened the Public Hearing. Darris Ellis 4470 Wasatch Street Chubbuck, ID 83202. There is secondary water there and should be utilized by the developer because of City Code. Nicki Taysom 4963 Yellowstone Chubbuck, ID 83202. City should not have any more water control. Opposed because of ingress and egress, zoning change and the sewer system situation. Delores Binggeli 5232 Lucky Avenue Chubbuck, ID 83202. Opposed. There will be more kids in the neighborhood and the irrigation ditch is a hazard. Stoddard closed the public hearing bringing meeting back to applicant. Stewart Ward: • The city policy for secondary irrigation system to be installed on residential subdivisions but where this is a very small development to put that much infrastructure is over kill. The City has asked the water rights be transferred to them. Buttars motioned to table this proposal to the next meeting keeping it with the other proposal. Seconded by Schwartz. Holmes explained there will be no other public comment on the applications. An application by Ellis Construction Lifestyle Homes 4470 Wasatch Street Chubbuck, ID 83202 for Copperfield Landing Division 4 Preliminary Plat. Located in the Northeast % of Section 4, Township 6 South, Range 34 East, of the Boise Meridian in the County of Bannock, South of Siphon Road, North of Dell Road and East of Cole. Mitchell Greer of Rocky Mountain Engineering and Surveying 600 East Oak Street Pocatello, ID 83201 was present representing the application. 6 lots in this phase for building and a 7th lot for a small park. The original proposal was that the City would take possession of the park and it would be an access to the church. Small parks are a maintenance nightmares for the City and they no longer want them to be developed. Mr. Ellis is developing according to the original plan and the City should hold to that plan. Darris Ellis: • This lot is not a park but a storm water retention system for the subdivision. City does not want the little park he doesn't either. Has to be classified as a park to get on the paperwork. City Staff: The subdivision on a whole meets all the requirements with the exception of 1 lot. As a recreation facility it does not meet the current requirements. City is not interested in maintaining a play area but possibly would entertain the idea of maintaining a storm water facility. Holmes: • The ordinance has been changed to not take parks smaller than 15,000 square feet. Stoddard opened the Public Hearing. Nicki Taysom 4963 Yellowstone Chubbuck, ID 83202. Opposed. If it doesn't meet ordinance requirements don't approve it. Annique Dayley 5037 Constitution Chubbuck, ID 83202. If this was approved three years ago it should be upheld at this time. Public Hearing closed bringing meeting back to commission. City Staff: • Design would need to be in place to determine if using the lot for storm water would work. Mitchell Greer: • This lot is the low point in the phase. Darris Ellis: Phase 2 construction drawings had the storm water lot on the plans. City calls them parks when they are storm water collection place. Stoddard entertained a motion. Schwartz moved to approve the application by Darris Ellis Life Style Homes for Copperfield Landing Division 4 preliminary plat with the designation that lot 1 block 2 be designated as storm water run-off and also that the developer landscape to be easily maintained in the future by City staff. The City will own the lot. Buttars seconded. Roll Call Vote: Thais Ayre, Yes; Carrie Holm, Yes; Mike Schwartz, Yes; Jay Buttars, Yes; Dan Stoddard, Yes. Motion carries. 4. An application by Stewart Nelson 4630 N. Inkom Road Inkom, ID 83245 for annexation into the City of Chubbuck the proposed Bilyeu Estates located in Southwest % of Section 4, Township 6 South, Range 34 East, of the Boise Meridian in the County of Bannock, North of Chubbuck Road and East of Philbin Road. Mitchell Greer of Rocky Mountain Engineering and Surveying 600 East Oak Street Pocatello, ID 83201 was present representing the application. Land is still in the County. Heritage West Subdivision next to the proposed Bilyeu Estates is to the east. Borders Chubbuck Road on the south and to the west is Sunset West Subdivision and Brookstone Estates. The City surrounds it on 3 sides, it is a 40 acres area. The Bilyeu home is on 10 acres at the corner of Philbin Road and West Chubbuck Road and it will remain in the county. Proposal is to annex with an R-2 designation. No comments from commission and City staff recommends approval. Stoddard opened the Public Hearing. Nicki Taysom 4963 Yellowstone Chubbuck, ID 83202. In favor of annexation. Public Hearing was closed and brought back to the commission. Stoddard entertained a motion. Buttars moved to approve the annexation of the proposed Bilyeu Estates into the City of Chubbuck. Schwartz seconded. Inkom Road Inkom, ID 83245 for zone change of the proposed Bilyeu Estates located in Southwest % of Section 4, Township 6 South, Range 34 East, of the Boise Meridian in the County of Bannock, from Agricultural (AG) to Limited Residential (R-2). Located North of Chubbuck Road and East of Philbin Road. Mitchell Greer of Rocky Mountain Engineering and Surveying 600 East Oak Street Pocatello, ID 83201 was present representing the application. Master Plan is not formally approved yet. There will be an outlet for Integrity Estates Subdivision at the north end of the development. Requesting R-2 zoning designation with the lots being bigger than Heritage West Subdivision lots. Stoddard opened the Public Hearing. Nicki Taysom 4963 Yellowstone Chubbuck, ID 83202. Opposed. Should be R-1. Plan ahead. Jed Daily 5037 Constitution Chubbuck, ID 83202. Traffic has increased on West Chubbuck Road. There should be a plan on how traffic will flow before the subdivision is approved. How will the City handle the influx of people? Stoddard closed the Public Hearing. Mitchell Greer: • Presented how placement of the streets were decided in the subdivision for the best flow of traffic. Stoddard entertained a motion. Buttars moved to recommend approval of the application for zone change of the proposed Bilyeu Estates from Agricultural (AG) to Limited Residential (R-2). Holm seconded. Roll Call Vote: Jay Buttars, Yes; Thais Ayre, Yes; Carrie Holm, Yes; Mike Schwartz, Yes; Dan Stoddard, Yes. Motion carries. 6. An application by Stewart Nelson, 4630 N. Inkom Road, Inkom, ID 83245 for the Preliminary Plat for Bilyeu Estates Division 1 located in Southwest % of Section 4, Township 6 South, Range 34 East, of the Boise Meridian in the County of Bannock, North of Chubbuck Road and East of Philbin Road. Mitchell Greer of Rocky Mountain Engineering and Surveying 600 East Oak Street, Pocatello ID 83201 was present representing the application. Not asking for cash in lieu of but will build a park. First phase is connecting onto Congress and Jake. There will be widening on Chubbuck Road. Utilities are easily accessible. City Staff: • Noted a correction on the staff report, align with the master plan submitted not the PUD plan. • Great development that will fit the City well and recommends approval. Stoddard opened the Public Hearing. Jed Daily 5037 Constitution Chubbuck, ID 83202. Asking the size of homes? How does this development affect water and sewer? Secondary irrigation plan? Property lines are not lined up. When will Jake push through. Annique Daily 5037 Constitution Chubbuck, ID 83202. Would like clarification on the north boundary for annexation. Nicki Taysom 4963 Yellowstone Chubbuck, ID 83202. Opposed. Only 2 accesses with 100 lots. No sidewalks please. Too many people for the size of the lots. Need to have wells. Public Hearing closed by Stoddard. Greer: • Size of homes has not been decided. • There will be basements. • Lots are not lining up because lots are a little bigger than Heritage West. • Water will have additional looping. Sewer will tie into Chubbuck Road. • There will be a dry secondary irrigation system put into place. • There are 3 accesses. • Larger lots are not affordable anymore. This is a great project for the City. Stoddard entertained a motion. Schwartz moved to recommend approval of the preliminary plat for Bilyeu Estates Division 1. Ayre seconded.
