Land Use and Development Commission Meeting Minutes
September 13, 2016 - 7:00 pm
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall,
5160 Yellowstone, on September 13, 2016.
Chairman Jason Mendenhall: Commission Members: Mike Schwartz, Brady Smith, Russ Armstrong,
Carrie Holm, and Bryan Nield. City Planner: Paul Andrus. Engineer Technician: Sean Harris. Attorney:
Tom Holmes, Administrative Assistant: Ranelle Simmons
Chairman Mendenhall called the meeting to order at 7:00 pm.
Mendenhall asked if any commissioners had a conflict of interest within the items before the board
tonight. Holms has a conflict with items 2 and 3.
Nield led the commission in the Pledge of Allegiance.
APPROVAL OF THE MINUTES: August 9, 2016
Mendenhall entertained a motion to approve the minutes as mailed. Schwartz moved the minutes of
August 9, 2016 meeting be approved as mailed; Nield seconded. The full authority approved.

An application by Idaho Central Credit Union, 4400 Central Way, Chubbuck, ID 83202 requesting
a change in Land Use District from Limited Residential (R-2) to General Commercial (C-2).
Property is located at 124 Parrish Lane.
Stewart Ward, Dioptra, 4737 Afton Place, Chubbuck, ID 83202 is representing the applicant.
The application is to rezone the land just west of the credit union on Yellowstone Avenue. Idaho Central
Credit Union bought a residential home to expand their parking lot. The short plat was approved at City
Council last week.
No questions from commissioners.
Andrus commented that the application does meet the standards of Title 18 in City Code.
Mendenhall opened the Public Hearing.
Mark Mitchell, 141 Briscoe Road, Chubbuck, ID 83202. Can the zoning go back to residential at a later
date?
Andrus, yes with an application to rezone.
Mendenhall closed the Public Hearing reminding commissioners that this is a recommendation to City
Council.
Andrus let commission know that the access to the parking lot will be moved west, moving it farther
from Yellowstone Ave.
No further discussion
Mendenhall entertained a motion. Smith moved to recommend approval to City Council for the request
to change the Land Use District from Limited Residential (R-2) to General Commercial (C-2) on the
property located at 124 Parrish Lane. Armstrong seconded.

2. An application by Spring Creek Homes, 4604 Burley Drive, Chubbuck, ID 83202 for Residential
Infill Planned Unit Development (PUD) for multifamily housing units. Project location is 231
West Siphon Road, Chubbuck, ID 83202.
Stewart Ward, Dioptra, 4737 Afton Place, Chubbuck, ID 83202 is representing the applicant.
Application is to develop the land west of existing Dance Apartments off of Siphon Road across from
Gate City Christian Church. The area is 1.4 acres that is not being used at this time. It will mirror existing
apartments except there will be storage units. Same access at existing apartments will be used. There
will be 5 units built even though city code would allow 7. Mix of 2 and 3 bedroom units with a picnic
area for residents to use. Utilities will hook into the Dance Apartments.
Commission questions or comments:
• Storage units will only be for the residents and will not be rented out?
Con Jensen, owner, 4604 Burley Drive, Chubbuck, ID 83202. No intention to rent the storage units.
Phase 1 and phase 2 renters will use the storage units.
• Is entrance big enough?
Ward, it is big enough for 2 -way traffic and emergency services to access.
Mendenhall opened the Public Hearing.
Bonnie Griskowsky, 152 Briscoe Road, Chubbuck ID 83202. Are these the same owners as the
apartments on Briscoe Road? Mendenhall, no. Will property values change? Andrus, studies show there
is no correlation with values for single family when multi -family units are built near by.
Mark Mitchell, 141 Briscoe Road, Chubbuck, ID 83202. Clarification on the entrance into the apartments.
Asked that the storage units are not for public use. Since apartments on Briscoe were built more traffic
and foot traffic. High density housing is detrimental. Opposed.
Mendenhall closed the Public Hearing bringing the meeting back to commission.
Mendenhall asked Ward to explain again the entrance and the access from Siphon Road.
Commission questions or comments:
• Streets in the complex are not city maintained
• Utilities will be city maintained.
• There will be a same fence around the complex as phase 1, 4'2 slat vinyl fence.
Mendenhall entertained a motion. Nield moved to approve the rezoning to Planned Unit Development
at 231 West Siphon Road with the stipulation that the storage units are only used for residents, no
commercial uses. Armstrong seconded.
Roll Call Vote: Brady Smith, Yes; Russ Armstrong, Yes; Brian Nield, Yes; Mike Schwartz, Yes; Jason
Mendenhall, Yes. Motion passes.
3. An application by Spring Creek Homes, 4604 Burley Drive, Chubbuck, ID 83202 for Dance PUD
Phase 2 Preliminary Plat. Located in NW'/< Section 3, Township 6 South, Range 34 East, of the
Boise Meridian in the County of Bannock. Project location is 231 West Siphon Road, Chubbuck,
ID 83202.
Stewart Ward, Dioptra, 4737 Afton Place, Chubbuck, ID 83202 is representing the applicant
Water and sewer will connect to Phase 1 and be city maintained. 5 lots will be used for the units and 1
lot for the common area. South boundary line has an irrigation ditch that will be piped and buried.
Water will be stubbed to the west for future development. Common area will be landscaped with
drainage facilities.
Discussion on Fort Hall Irrigation. City will control the water right.
Harris stated it is a mirror of the previous development and meets all the requirements of Titles 16, 17
and 18. Staff recommends it meet all PUD requirements.

Mendenhall opened the Public Hearing.
Kelly Davis, 152 Briscoe Road, Chubbuck, ID 83202. Checking to make sure they will have access to the
land they just bought. Mendenhall, yes, developer cannot block the irrigation water from getting to his
land. Opposed to the application.
Bonnie Griskowsky, 152 Briscoe, Chubbuck, ID 83202. Opposed. Difficult to raise animals next to
apartments.
Mark Mitchell, 141 Briscoe, Chubbuck, ID 83202. Opposed. High density residents are not use to animals
around them. Not a good selling point to have apartments as the view from his home.
Mendenhall closed the Public Hearing bringing the meeting back to the Commission.
Comments and questions from commission:
• Irrigation water should be required to be used by developer.
• Who maintains the common areas? Ward, owner maintains himself or hires someone to
maintain. No private well at this site.
• Water conservation is not being taken into consideration, need to be consistent with using
water rights.
• The pipe is being buried to assure there will be water available for land down the line.
• Irrigation system needs to be designed so it can be converted overjust like phase 1.
Mendenhall entertained a motion. Nield moved to recommend approval of Dance PUD Phase 2 with
approval conditioned upon meeting all PUD requirements including irrigation requirements of the City.
Fort Hall Irrigation / secondary water is available thru a pressurized pump system that will be easily tied
into this development. Schwartz seconded.
Roll Call Vote: Russ Armstrong, Yes; Brady Smith, Yes; Mike Schwartz, Yes; Brian Nield, Yes; Jason
Mendenhall, Yes. Motion passes.
GENERAL BUSINESS
November 8th meeting is on Election Day and Council Chambers are a polling place.
Smith moved to change the meeting to Wednesday the 9th at 7pm. Schwartz seconded. All voted in
favor.
ADJOURN
Mendenhall entertained a motion to adjourn; Nield moved to adjourn. Smith seconded. All voted to
adjourn at 7:55 pm.
