COUNCIL MEETING MINUTES
May 27h,2003
Minutes of a regular meeting held at the Chubbuck Elementary School, May 27th, 2003.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes and City Clerk Ron C. Conlin.
Public Works Director Steven M. Smart was excused.
Meeting was called to order at 7:34 p.m. by Mayor Cotant.
INVOCATION was given by Bishop John Oborn, Chubbuck 15t Ward, Chubbuck Stake, The
Church of Jesus Christ of Latter -Day Saints.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Sharik Peck.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the regular
meeting minutes of May 13th, 2003.
Councilman Kearns moved to approve the regular meeting minutes of May 13th, 2003 as
read, Councilman England seconded. All council members voted in favor of motion.
PUBLIC HEARING - An application by Dave Orthel and Assignees, 799 Leonidis, Chubbuck,
Idaho for a change of Land Use District from, Agricultural, (A) to General Commercial,
(C -2). Property is located at 4650 Hawthorne.
Dave Orthel called the City Offices and stated he is not ready for tonight's meeting,
asking that the Land Use Change request at 4650 Hawthorne be tabled until the June 10th,
2003 Council Meeting.
Councilman England moved to tabled the application by Dave Orthel and Assignees for a
change of Land Use District from, Agricultural, (A) to General Commercial, (C -2) until
the June 10th, 2003 Council Meeting, Councilman Gunter seconded. All council members
voted in favor of motion.
PUBLIC HEARING - An application by Bob Elzner, John Cotant and Renae Worthen, P.O. Box
5310, Chubbuck, Idaho 83202 for a change of Land Use District from Agricultural, (A) to
Single Family Residential, (R -1). Property is located south of 4871 Johannsen Place west
of Monika Court.
Mayor Cotant declared the public hearing open.
There being no comment, Mayor Cotant declared the public hearing closed.

Councilman Kearns moved to approve the application by Bob Elzner, John Cotant &
Renae Worthen for a change in Land Use District from Agricultural, (A) to Single Family
Residential, (R -1), Councilman England seconded. All council members voted in favor of
motion.
ERGO LAND SUBDIVISION FINAL PLAT - Mayor Cotant asked if there was any comment on
the Ergo Land Subdivision Final Plat.
Sharik Peck, 2298 Tonja Lane, Pocatello, Idaho said they have two acres of property and
split it into three parcels. The one acre by the railroad track is for a church group, the
other two parcels will be building sites. The frontage to Siphon Road is going to be green
area. There is a 20 foot easement off the back property line. Mr. Peck asked where the
manholes are required.
Councilman Gunter moved to approve the Ergo Land Subdivision Final Plat as presented
subject to, Sharek Peck working with City Engineers on sewer manhole locations,
Councilman Kearns seconded. All council members voted in favor of motion.
BUSINESS LICENSE APPLICATION - Randy J. Watson, Overton, Nevada has applied for a
business license to operate a carnival at the Pine Ridge Mall Parking Lot, June 18"' -June
21 S`, 2003.
Councilman England moved to grant a business license to Randy Watson, Inland Empire
Shows, Inc. to operate a carnival at the Pine Ridge Mall Parking Lot, June 18 "' -June 21St,
2003, Councilman Gunter seconded. All council members voted in favor of motion.
ORDINANCE #572 - Adopting Section 9.04.020 definitions to provide that in all provisions of
the Chubbuck Municipal Code, including all provisions of Title 9 relating to the General
Criminal Code, Title 6 relating to daycare, and Title 8 relating to health and safety, where
"Chief's Designee" is used to indicate a designee of the Chief of Police, in all instances
that "Designee" shall be a member of, or employee of the City of Chubbuck in General
and the Chubbuck Police Department specifically.
Attorney Holmes read Ordinance #572 in full for the first and final reading.
Councilman Quick moved to dispense with the rule of reading Ordinance #572 on three
separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes;
Gunter, yes; Kearns, yes.

Councilman Kearns moved to adopt Ordinance #572 as read, Councilman Quick
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.
ORDINANCE - Adding Section 6.08.045 to the Chubbuck Municipal Code to require a land -line
telephone at a daycare facility.
Attorney Holmes read the ordinance by title only for the first reading.
Council tabled the ordinance until the June 10 ', 2003 Council Meeting.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Quick moved to approve the computer print -out claims as presented,
Councilman Kerns seconded. All council members voted in favor of motion.
GENERAL BUSINESS -
1. Councilman Kearns requested an E -Mail account set up for him through the City. CC
Conlin said he will follow up.
At 8:05 p.m, Councilman England moved, Councilman Kearns seconded, with full council
approval to adjourn meeting.
