HomeMy WebLinkAbout008.09.16City of Chubbuck Land Use and Development Commission Meeting Minutes August 9, 2016 - 7:00 pm Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on August 9, 2016. Chairman Jason Mendenhall: Commission Members: Mike Schwartz, Dan Stoddard, Brady Smith, Todd Blackinton, Carrie Holm, and Bryan Nield. Public Works Director: Rodney Burch, Administrative Assistant: Ranelle Simmons Chairman Mendenhall called the meeting to order at 7:00 pm. Mendenhall asked if any commissioners had a conflict of interest within the items before the board tonight. Schwartz led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: Mendenhall entertained a motion to approve the minutes as mailed. Blackinton moved the minutes of July 12, 2016 meeting be approved as mailed; Schwartz seconded. All voted in favor. PUBLIC HEARING An application by Briscoe Bybee Contractors, 5465 Kymball Avenue, Chubbuck, ID 83202 for the Preliminary Plat for The Grove Subdivision 2"d Addition located in the Northeast ''/< of Section 8, Township 6 South, Range 34 East of the Boise Meridian in the County of Bannock. This property is located north of 1-86 and west of Philbin Road. Stewart Ward, Dioptra 4737 Afton Place Suite B, Chubbuck, ID 83202 was in attendance representing the applicant. This is a preliminary plat proposal with approx. 10 acres of land in phase 2 and 29 single family homes. This area has been vacant for approx. 10 years. Existing water and sewer will be connected into along with the irrigation line. Connecting into irrigation line is because of a recommendation from City staff. There are open ditches in the field and no one will be cut off from Fort Hall irrigation. Some of the line will be gravity fed other areas will be graded. The developer is requesting to provide a contribution in lieu of building a park. Road widths will match the existing roads and right-of-ways. Homes will be very similar to the homes in phase 1 with a few larger lots in phase 2. Phase 1 has an active irrigation system now. Mendenhall asked if City staff had any comments. Burch stated item 1 on the memo refers to the lot to depth ratios. There are a handful of lots that do not meet that requirement. Staff does not feel that this is an issue and recommends to approve the plat but in the motion acknowledge that title 18.08.040C has been addressed. Relocation of the irrigation line will be in the actual construction plans that are submitted. Idaho code does not allow the applicant to restrict historic water use. Water flows will be tested. The Academy Charter School is making it hard to enter onto Philbin Road. Is there a possibility for another entrance onto Philbin Road? Roy Thompson 1331 Sawtooth Street. He has the same concerns as Ryan Corum. Roger Cameron 1414 Sawtooth Street. His concern is dust and weeds. Sasha Elder 1388 Sawtooth Street. Same concerns with turning onto Philbin Road. George Lucia 14145 West Chubbuck Road. Concerned with irrigation and the ditches getting plugged with tumble weeds causing flooding the neighbors. Will the water be piped? Danny Elder 1388 Sawtooth Street. Entering on Philbin Road. Will there be a crosswalk on Philbin Road? Mendenhall closed the Public Hearing. Mendenhall ask Ward to address weed control and dust. The homes that are being built are not this applicant. Unsure of what that developer's plan is. Mendenhall asked if there are questions from commissioners. The under 90 lots with 1 entrance required meets City Code. Enforcement codes for weeds need to be addressed to Aaron Harker the Code Enforcement Officer at the Police Department. Crosswalk was addressed by Burch. The City is in all honesty are surprised with the amount of traffic The Academy has generated. The City has annexed the west half of Philbin Road. It will probably not be a school zone because the school fronts Alpine Road not Philbin Road. City acknowledges the issue and it will be a slow process for improvements. Anything in City Code that would address the concern of lot and window levels? Burch; No, it is up to the builder and the home owners to decide what is being built. Ward explained the irrigation plan again. The ditches may need to be piped on the north side but the ditch that is outside the property line will stay a ditch. Gryffin Hollow Subdivision to the north has an existing dry irrigation system on the south property line. When final plat and construction drawings are completed and submitted to the City for approval those irrigation questions will be answered. Mendenhall entertained a motion. Nield made the motion to recommend the application as proposed and recognize that the commission addressed the lot width size per City staff recommendation. Smith seconded. Nield added to the motion that the developer is requesting to provide a contribution in lieu of building a park. Roll Call Vote: Brady Smith, Yes; Todd Blackinton, Yes; Carrie Holm, Yes; Bryan Nield, Yes; Mike Swartz, Yes; Dan Stoddard, Yes; Jason Mendenhall, Yes. This application will come before City Council on August 17th at 6:00 pm. Mendenhall entertained a motion to adjourn Nield made the motion. Stoddaard seconded.
