HomeMy WebLinkAbout009.08.15City of Chubbuck Land Use and Development Commission Meeting Minutes September 8, 2015 - 7:00 p.m. Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on September 8, 2015. Chairman: Jason Mendenhall, Commission Members: Mike Schwartz, Dan Stoddard, Jay Buttars, Brady Smith, Russ Armstrong, Pete Anderson, Bryan Nield. City Staff: Rodney Burch, Paul Andrus. Attorney: Tom Holmes. Administrative Assistant: Ranelle Simmons Chairman Mendenhall called the meeting to order at 7:00 pm. Mendenhall led the commission in the Pledge of Allegiance. Mendenhall asked for cell phones to be turned off and if any commissioners had a conflict of interest within the items before the board tonight. APPROVAL OF THE MINUTES: Mendenhall entertained a motion to approve the minutes as mailed. Stoddard moved the minutes of August 11, 2015 meeting be approved as mailed; Schwartz seconded. The full authority approved. PUBLIC HEARING 1. An application by the City of Chubbuck, 5160 Yellowstone, Chubbuck, ID 83202 for a Conditional Use Permit for a 1.5 acre well site, pump station, water reservoir and an 80'communication tower. Well #6 is located in Copperfield Landing PUD, half way between Siphon Road and Homestead Road, Chubbuck, ID 83202. Rodney Burch is the public works director for the City of Chubbuck. Land is off the northwest corner of the existing park on Darris Street. The city is in the process of drilling 2 new wells with storage reservoirs, this site will be well # 6. These wells are for future water demands of Chubbuck citizens. The well # 6 site has been negotiated and a contract is in place to purchase this land. City infrastructure uses a SCADA system. This is a computer controlled communication system via line of site radio. This site will need an 80' tower to allow the sites to communicate with the each other. The Conditional Use Permit is required because the tower exceeds 35'. Questions from the commission: • Does this tie into the rest of the city water systems Burch: yes • How much of the 1.5 million gallon water tank will be in the ground Burch: approx. 80% in the ground cast in place concrete tank, but the final design is not done • Is there another facility like this in the city Burch: no the 2 new sites will include well and storage tanks Well 7 is on Hiline Road in the county • Will the area be fenced Burch: the entire site will be fenced • Explain the tower communication J:\Planning\LUDC\LAND USE SECRETARY\Minutes\Minutes 2015\009.08.15.docx Burch: It can be broadcasting 24 hours a day and is the communication device to the pumps inside the booster stations. The 80' height is to ensure the radio frequency can be above the trees. The tower will sit on a 24" bolt packet. The some tower is on West Chubbuck Road. • Any preliminary drilling Burch: City is in the midst of specifying a test well right now Mendenhall opened the public hearing for comment. Mark Waldram lives at 13181 West Siphon Road, Pocatello, ID 83202. His home is right next door to the project. Concerns are look, noise, resale, and maintenance of his property. Would appreciate the fence be away from the boundary line 5 to 6 feet. Mary Lancaster lives at 5475 Jerry Street, Chubbuck, ID 83202. • How will construction crews access where the work will be done? Mendenhall closed the public hearing bringing the meeting back to the commission, reminding commission that Conditional Use Permits stay with Land Use for a decision. Burch addressed the questions from the public hearing. • Fence will be the property line. Typically chain link fence with security wire on top of the fence is used. • The transmission line that will connect the water line and construction access preference will be Siphon Road. Siphon Road is where the permanent easement is. Burch continued to inform commission: The project is a 12 month construction period before it is completely operational. All pumps and generators are housed inside the building so noise level is minimal. Burch does not have a decimal level. Generators are tested twice a year for 15 minutes. With a privacy fence it is hard to know what is going on behind the fence of a 5 million dollar project. If the test well fails the project will be moved to another site. Holmes stated that the application could be approved subject to the lay out being reviewed. Mendenhall entertained a motion. Armstrong moved the application be approved conditioned upon the review of conceptual drawings when they are available. Buttars seconded. Roll Call Vote: Schwartz, Yes; Stoddard, No; Buttars, Yes; Smith, No; Armstrong, Yes; Anderson, No; Nield, No; Mendenhall, Yes. Motion dies. Anderson moved the application by the City of Chubbuck for a Conditional Use Permit for a 1.5 acre well site, pump station, water reservoir and an 80'communication tower located at well #6 in Copperfield Landing PUD be approved subject to the presentation by the city of the preliminary design plans at which time the conditional use will go into effect. Nield seconded. J:\Planning\LUDC\LAND USE SECRETARY\Minutes\Minutes 2015\009.08.15.docx Mendenhall asked for clarification from Holmes that if the motion is approved that is on the table now and comes back for preliminary plan review and the commission votes against would that trigger going to City Council or new permit. Holmes said it would trigger a new design and review. Roll Call Vote: Schwartz, Yes; Stoddard, Yes; Buttars, Yes; Smith, Yes; Armstrong, Yes; Anderson, Yes; Nield, Yes; Mendenhall, Yes. Motion carries. GENERAL BUSINESS 1. Discuss ordinance draft amending section 18.12.030(A) of the Chubbuck municipal code. Burch presented the change to the draft that commission asked for in the August meeting. There are 3 options for commission to decide on: • approve the change in language today and have a notice of public hearing in an upcoming land use meeting modify the language again commission could deem that the modification is not necessary Burch went over the changes with the commission. 5. An accessory structure in a residential or residentially zoned districts shall: (remove per LUDC 8-12-15) Not exceed the maximum height, measured at the peak of the roof, allowed in that zoning district Not exceed 40% of the total lot area, when combined with the primary structure finishes, unless the DesignReviewCommittee all.,ws semethiRg Ai#. (revised per LUDC 8-12-15) wet he le-e—ated it the fFeRt . aFd setbaGk (remove per LUDC 8-12-15) This section shall only apply to an A+¢ accessory structure greater than Two Hundred square feet in, t pFi„1 and shall require a building permit be issued after review by the Design Review Committee for conformity with this section Burch reminded the commission that the Design Review Committee is all city department heads, planning, engineering, building, sanitation, police, fire, public works, clerk and Mayor. Any commercial project is required to meet with the committee. Nield ask why the purpose of controlling residents choice to build. Burch stated that city staff was instructed by City Council to look into this. Holmes informed commission that 50% of the City Council believes this is a big deal and accessory structures are too big. Mendenhall stated the question before commission tonight is does commission feel this is ready for a public hearing. Anderson made a motion to move the ordinance to land use with a public hearing if publishing of the notice can be done. Smith seconded. All voted in favor except Nield. Motion carries. Burch stated that it may be beneficial to include 18.12.30(A) in with the rest of the changes in title 18 and have only one public hearing. 2. Discuss 18.08.040 (A), Land Uses By Districts in the Chubbuck municipal code. Andrus let commission know the matrix was broken into categories and duplicates removed. Anderson commented it is beneficial to have categories. The broader the categories are kept the better. Andrus asked the commission to review the matrix more closely and bring suggestions and changes to the next meeting. Burch explained that from a Land Use stand point the matrix is the most important tool in the code book. Commission would like to know the current date for the code to make sure their books have been updated. 3. Review chapters 12 and 13 in the Comprehensive Plan. Objective 1.1 c was discussed in chapter 12. The decision was made to change preseFve torp otect and adding at the end of the sentence as long as it is practical. Chapter 13 In the Regional Vision Statement changing 2020 to 2030. Changing junior high to middle school and adding private school and charter school was discussed. The decision was to add charter school to Goal 3. 2.2 h was also discussed and no change was made Mendenhall entertained a motion to adjourn; Anderson made the motion. Nield seconded.
