Land Use and Development Commission Meeting Minutes
January 13, 2015 - 7:00 p.m.
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall,
5160 Yellowstone, on January 13, 2015.
Chairman Peter Anderson: Commission Members: Rodney Burch, Dan Stoddard, lay Buttars, James
Eborn, Ron Horner, Bryan Nield. City Staff: Steve Smart, Paul Andrus, Sean Harris. Attorney: Tom
Holmes. Secretary: Ranelle Simmons
Chairman Anderson called the meeting to order at 7:00 pm.
Anderson asked if any commissioners had a conflict of interest within the items before the board
tonight.
Stoddard led the commission in the Pledge of Allegiance.
APPROVAL OF THE MINUTES
Anderson entertained a motion to approve the minutes as mailed. Buttars moved the minutes
of December 9, 2014 meeting be approved as mailed; Horner seconded. The full authority
approved.
NOTICE OF PUBLIC HEARING
1. An application by Miller Properties LLC, 6034 Fruitwood Lane, Pocatello, ID 83201 for Sunset
West Division 7 Preliminary Plat. Located in East %2 of Section 5, Township 6 South, Range 34
East of the Boise Meridian in the County of Bannock. The subdivision will be North of Jasmine
Drive and West of Angela Street.
Brady Smith from Rocky Mountain Engineering and Surveying, 2043 East Center Street, Pocatello, ID
83201 was here to represent the application.
This preliminary plat is a continuation of Jasmine Drive to the north and a connection into Angela Street
to the east. Sunset West Division 7 has 17 lots with 7.25 acres. It is zoned single family residential.
The commission had no questions and no comments from City staff.
Anderson opened the Public Hearing.
No comment from the public so the Public Hearing was closed and the discussion was brought back to
the commission.
Stoddard ask about the secondary pressurized irrigation system that was mentioned on the staff report.
Smart explained that secondary pressurized irrigation is a requirement of our ordinance and the Fort
Hall irrigation water is a crucial part of the City's water rights portfolio. All new developments are
required to install. The city continues to pick up the operation and maintenance fee for the Fort Hall
irrigation water so the rights are not relinquished and the water can be utilized on the properties.
Anderson explained this decision will be a recommendation to the City Council.
Nield made the motion to approve the application by Miller Properties LLC, 6034 Fruitwood Lane,

Yes. Motion carries.
The application will go before the City Council on January 21, 2015.
2. An application by Tari Jensen/ Safe T Gard Storage, 4604 Burley Drive, Chubbuck, ID 83202 for a
Conditional Use Permit to have a beauty shop located at 4604 Burley Drive, Chubbuck, ID 83202.
Tari Jensen lives at 11070 Deerridge, north of Chubbuck, 83202 was present to represent the
application.
Tari Jensen owns the building and storage units at 4604 Burley Drive location. There are storage units
and office spaces with a night watchman's house across the street. The Conditional Use Permit would be
for suite B. Storage units are zoned industrial and hair salons are zoned commercial. Ashley McLean is
renting suite B and relocating her business Cut Loose Hair Salon from Yellowstone Avenue to Burley
Drive. There are enough parking spaces.
No questions or comments from commission or City staff.
Anderson opened the Public Hearing.
Nick! Taysom lives at 4604 Burley Drive, Chubbuck, ID 83201. Nicki lives in the apartment over the
offices. The City needs to determine what the actual zoning should be and stick with that. There needs
to be consistency. The person living in the apartment will smell the odors from the beauty salon. The
Conditional Use Permit should not be approved.
Ashley Mclean lives at 221 Isaac Chubbuck, ID 83202. Ashley has been in the hair business for 12 years
and has owned and operated Cut Loose at 4519 Yellowstone for 6 years. The Burley Drive location will
allow her to expand her business.
Robert Poleki, Bannock County Clerk, tenant of Tari Jensen and a resident of Chubbuck. Please give
Ashley a chance to have this business.
Phil Richardson lives at 289 Henry, Chubbuck, ID 83202. Bill moved to Chubbuck in 1962. Please approve
the application so his daughter-in-law can relocate.
Wendy Burrup lives at 4865 Pleasant View Chubbuck, ID 83202. There are people who will lose their
jobs if the Conditional Use Permit is not granted.
No other public comment.
Anderson closed the Public Hearing.
Anderson allowed Tari Jensen to clarify comments that were made.
Anderson brought the discussion back to the commission. Conditional Use Permit approval is the Land
Use Commissions decision.

Anderson explained that the City does not zone property. Applicant's requests are how the zoning is
changed. The Comprehensive Plan calls for Burley Avenue to become a commercial industrial zone.
Burch made a motion to approve the application by Tari Jensen/ Safe T Gard Storage, 4604 Burley Drive,
Chubbuck, ID 83202 for a Conditional Use Permit to have a beauty shop located at 4604 Burley Drive
Suite B, Chubbuck, ID 83202.
Nield seconded.
Roll Call Vote: Burch, Yes; Stoddard, Yes; Buttars, Yes; Eborn, Yes; Horner, Yes; Nield, Yes; Anderson,
Yes. Motion carries. Appeals to City Council can be made within 25 days from this meeting date.
GENERAL BUSINESS
Discuss chapter 5, Transportation, and chapter 8, Recreation, in the Comprehensive Plan.
