Land Use and Development Commission Meeting Minutes
December 9, 2014 - 7:00 p.m.
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall,
5160 Yellowstone, on December 9, 2014.
Chairman Peter Anderson: Commission Members: Rodney Burch, James Eborn, Ron Horner, Jason
Mendenhall. City Staff: Steve Smart, Paul Andrus. Attorney: Tom Holmes. Secretary: Ranelle Simmons
Chairman Anderson called the meeting to order at 7:00 pm.
Burch led the commission in the Pledge of Allegiance.
Anderson asked if any commissioners had a conflict of interest within the items before the board
tonight.
APPROVAL OF THE MINUTES:
Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of
November 12, 2014 meeting be approved as mailed; Horner seconded. The full authority approved.
NOTICE OF PUBLIC HEARING
1. Application from Walter Rowntree, 22 5t" Avenue East, Kalispell, MT 59901 for a Conditional Use
Permit for construction of a pole mounted solar panel cluster at Bannock Animal Medical
Center, 5262 Yellowstone Avenue, Chubbuck, ID 83202.
Walter Rowntree, 22 5t" Avenue East, Kalispell, MT was in attendance to represent the application. He is
pleased with the performance of the pole mounted solar panel system at his residence off of
Reservation Road. For 6 months straight the amount paid to Idaho Power was $5.20 a month. Would
like to add the panel system to the building where he is the landlord, 5262 Yellowstone Avenue.
No comments from city staff.
Public Hearing was opened.
Nicki Taysom lives at 4604 Burley Drive, Chubbuck ID. She would like to know the height and can the
panel be attached to the building. Anderson let her know it would be 20 feet tall.
Rowntree: He would like to attach the panel to the building but the roof line is not situated in the
correct direction.
Anderson entertained a motion for the Land Use to grant or deny the Conditional Use Permit
application.
Mendenhall made the motion to approve the Condition Use Permit for the construction of a pole
mounted solar panel cluster at Bannock Animal Medical Center, 5262 Yellowstone Avenue, Chubbuck, ID
83202. With the condition that the equipment is far enough off of the property line so if it falls it will
land on site.

Horner seconded.
Anderson suggested an amendment to make sure the structure complies with the city building codes.
Mendenhall agreed.
Roll Call Vote: Burch, Yes; Eborn, Yes; Horner, Yes; Mendenhall, Yes; Anderson, Yes. Motion carries.
GENERAL BUSINESS
1. Review, revise as necessary and adopt Findings of Facts, Conclusions of Law regarding the approval
of T -Mobile cell tower at Chubbuck Elementary.
Holmes has asked the board to review.
Mendenhall does not see anything that needs to be updated or changed.
Holmes explained the Findings Fact, Conclusion of Law to the commission. It will be forwarded on to the
City Council.
Mendenhall made the motion that the Finding and Fact for the T -Mobile cell tower application be
adopted. Horner seconded. All voted in favor. Motion carries.
2. Discuss chapter 5, Transportation, and chapter 8, Recreation, in the Comprehensive Plan.
Commission decided to discuss in January.
Anderson entertained a motion to adjourn; Mendenhall made the motion.er seconded. All voted
