Cotant, Council members Leroy S. Quick, Steven M. England, David A. Landon, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting called to order at 7::32 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the Regular Meeting Minutes of November 24, 1992 and Special Meeting Minutes, December 1, 1992. Councilman Landon moved to approve Regular Meeting Minutes of November 24, 1992 as read. Councilman Quick seconded. All council members voted in favor of motion. Councilman Wood moved to approve Special Meeting Minutes of December 1, 1992 as read. Councilman Landon seconded. All council members voted in favor of motion. PUBLIC HEARING - ORDINANCE - A proposal by the City of Chubbuck to establish the maximum rate ratio of lot depth to lot width. Mayor Cotant read the ordinance in full for the first reading. Mayor Cotant declared the public hearing open, asking for comment, for or against. There was no comment. Mayor Cotant declared the public hearing closed. After discussion, Council decided to table ordinance until the January 12, 1992 Council Meeting. PUBLIC HEARING - LANDSCAPING ORDINANCE - A proposal by the City of Chubbuck to amend Chapter 18.12.020 (c), to reduce the size of trees growing from two to two and one half inches to one to one and one -half inches. Mayor Cotant read the ordinance in full for the first reading. Mayor Cotant declared the public hearing open, asking for comment, for or against. There being no comment, Mayor Cotant declared the public hearing closed. After discussion, Council decided to table ordinance until the January 12, 1992 Council Meeting. 269 PUBLIC HEARING - A proposal by the City of Chubbuck to change the City's Comprehensive Plan Land Use Pattern for that portion of the NE Quarter, (NE 1/4) of Section 11, Township 6 South, Range 34 E.B.M., lying east of I -15. It is proposed that the Land Use Pattern be changed from Single Family Residential (R- 1), to General Commercial, (0-2). Streets affected by the change will be E. Chubbuck Road lying east of I -15, and Fairgrounds Road. Mayor Cotant declared the public hearing open. There being not comment for, or against the proposal Mayor Cotant closed the public hearing. Attorney Holmes suggested the council approve the proposal. Attorney Holmes stated he will prepare an ordinance to be presented at the January 12, 1992 Council Meeting, changing the Comprehensive Plan for both the Oiser Property, Hawthorne Rd. and the Hancock property on East Chubbuck Rd., lying east of I -15 and Fairground Rd. Councilman England moved to approve a change in the City's Comprehensive Plan Land Use Pattern from Single Family Residential (R -1), to General Commercial, (C -2), for that portion of the (NE 1/4), of Section 11, Township 6 South, Range 34 E.B.M., lying east of I -15. Councilman Wood seconded. All council members voted in favor of motion. ACCEPTANCE OF OFFER OF DEDICATION - Heritage West Subdivision was approved February 12, 1980, by the Chubbuck City Council, said plat is recorded on Page 11, Book 11 of the Book of Plats of Bannock County. Mayor Cotant read the Offer of Dedication in full. Councilman Landon made motion the City of Chubbuck hereby accept and confirms the dedication and offer of dedication, as contained in the final plat of Heritage West Subdivision, of all streets, utilities, dedicated lands, easements, pedestrian ways, parks and recreation areas depicted therein. Councilman Wood seconded. All council members voted in favor of motion. ACCEPTANCE OF OFFER OF DEDICATION - Heritage West No. 2 Subdivision was approved April 10th., 1990 by the Chubbuck City Council, said plat is recorded on Page 23, Book 12 of the Book of Plats of Bannock County. Mayor Cotant read the Offer of Dedication in full. Councilman England made motion the City of Chubbuck hereby accept and confirms the dedication and offer of dedication, as contained in the final plat of Heritage West Subdivision 271 ACCEPTANCE OF OFFER OF DEDICATION - (cont.) No. 2, of all streets, utilities, dedicated lands, easements, pedestrian ways, parks and recreation areas depicted therein. Councilman quick seconded. All council members voted in favor of motion. RENEWAL OF LIQUOR, WINE AND BEER LICENSES for year of 1993 - Police Department have approved the renewal of licenses to present holders of liquor, wine and beer licenses. City Clerk Conlin explained Idaho Unlimited, Kimberly Nurseries, Tom's Gyro and Days Inn have not applied for license as of yet this year. City Clerk Conlin stated he talked to all of them, they said they will have the applications with fees prior to the last week in December, 1992. Councilman Wood moved to approve the renewal of present beer, wine and liquor licenses for the year of 1993, subject to the compliance of all requirements of ordinance and statutes, as determined by the City Clerk. Councilman England seconded. All council members voted in favor of motion. PROCLAMATION - `DRUNK AND DRUGGED DRIVER PREVENTION MONTH" - Mayor Cotant read the proclamation in full. Councilman Quick moved to direct Mayor Cotant to proclaim December as, "Drunk and Drugged Driver Prevention Month". Councilman Landon seconded. All council members voted in favor of motion. ORDINANCE #388 - An ordinance adding Chapter 9.24 to define the responsibilities of parents for their children and providing penalties for neglecting those responsibilities. Mayor Cotant read ordinance in full for the first reading. Mayor Cotant said a Mayor's letter will be prepared, then sent to residents explaining the ordinance to parents, also advising the ordinance is in effect. Councilman Quick moved to dispense with rule of reading Ordinance #388 on separate days. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; Wood, yes. Councilman England moved to adopt Ordinance #388 as read. Councilman Landon seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; Wood, yes. FINANCIAL REPORT for month of November presented to Mayor Cotant and Council. 273 CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman England moved to approve computer print -out claims as read. Councilman Landon seconded. All council members voted in favor of motion. WATER AND SEWER RATE DISCUSSIONS - PWD Smart passed to Mayor Cotant and Council a breakdown showing rates, if three employees were removed from the 1992 -93 Fiscal Year Budget. Larry Miller, Ray Hansen, Larry Kohntopp, Bryan Hall and Tom Myler, City Employees expressed concern about cuts in maintenance department, they felt we are short employees now. Mayor Cotant stated we have to review all areas including, Health Insurance, privatization, contracting services and being more efficient. Bryan Hall, City Employee stated the sewer system in the City is deteriorating, if it takes raising the sewer rates, it should be done. Councilman England stated he planned on getting involved in the next Legislative Session, asking for help in funding the General Fund.
