Cotant, Council members Leroy S. Quick, Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 6 :00 p.m. by Mayor Cotant. APPROVAL OF MEETING - Mayor Cotant asked for corrections or additions to regular meeting minutes of April 26, 1994. Councilman Quick moved to approve regular meeting minutes of April 26, 1994 as read. Councilman Wood seconded. All council members voted in favor of motion. POPPY DAYS PROCLAMATION - Mayor Cotant read the proclamation in full. Mabel Renfrow, 226 Mingo was present to present Mayor Cotant and Council poppies. Councilman Wood moved to direct Mayor Cotant to proclaim May as Poppy Month, and May 13th and 14th., 1994 as Poppy Days in the City of Chubbuck . Councilman England seconded. All counc 11 members voted in favor of motion. LIQUOR, WINE AND BEER LICENSE APPLICATION - Chung H. Pyo, 4333 Yellowstone Ave. has applied for license to sell liquor, wine and beer license at 4333 Yellowstone Ave. (formerly Tina's Oxbow) . Police Department did not object to the application. Councilman Quick moved to approve a liquor, wine and beer license to Chung H. Pyo, 4333 Yellowstone Ave. (formerly Tina's Oxbow). Councilman Gunter seconded. All council members voted in favor of motion. ORDINANCE #412 - An ordinance amending Section 18.28.020 ( d ) of the Chubbuck Municipal Code to change the time written testimony must be filed before the Land Use Commission. Mayor Cotant read Ordinance #412 in full for the third, and final reading. 101 •--• ORDINANCE #412 - (cont.) Councilman England moved to adopt Ordinance #412 as read. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. ORDINANCE #413 - An ordinance amending Section 17.16.040 of the Chubbuck Municipal Code to delete the provision for interest being charged on reserve strips. Attorney Holmes read Ordinance #413 for the third and final reading. Councilman Wood moved to adopt Ordinance #413 as read. Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. ORDINANCE - An ordinance amending 15.08.030 to adopt a more recent version of the Uniform Fire Code, and to not adopt certain sections dealing with fireworks; adding 15.08.025 providing for the adoption of future editions by resolution; amending section 15.08.030 to provide for the clerk to maintain copies of future editions of the Fire Code. Mayor Cotant read ordinance by title for the second reading. After discussion, Council tabled the ordinance until the May 24, 1994 Council Meeting. ORDINANCE - An ordinance providing for the regulation of cable television rates. Attorney Holmes read ordinance in full for the first reading. After discussion, Council tabled the ordinance until the May 24, 1994 Council Meeting. BUSINESS LICENSE APPLICATION - Allstate Enterprises, Victorville, California has applied for license to sell tools, radios, phones and watches at the Days Inn in Chubbuck. Police Department had no objections to the application. Councilman Quick asked how long they plan to sell. Councilman Quick moved to approve a business license to Allstate Enterprises, Victorville, California to sell tools, radios, phones and watches at the Days Inn, in Chubbuck, May 21st. and 22nd., 1994. Councilman England seconded. All council members voted in favor of motion. 103 RESOLUTION #7 -94 - Purchase of a street sweeper through the Congestion Mitigation /Air Quality (CMAQ) Development Program. PWD Smart stated the City has been authorized by ITD to spend congestion mitigation and air quality (CMAQ) monies to purchase a vacuum type street sweeper. The street sweeper purchase is part of the State implementation plan for the PM10' non - attainment area locally. PWD Smart stated the State will fund 80% of the purchase, with the City of Chubbuck responsible for 20 %. PWD Smart recommended he be given approval to pursue the purchase of the sweeper. Councilman Gunter made motion to adopt Resolution #7 -94 as presented, authorizing Mayor Cotant to enter into agreement with State of Idaho - ITD, also authorizing the issuance of a check in the amount of $500.00. Councilman Wood seconded. All council members voted in favor of motion. Councilman England moved to direct PWD Smart to pursue the purchase of a street sweeper through State Bid. Councilman Gunter seconded. All council members voted in favor of motion. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve computer print -out claims as presented. Councilman Wood seconded. All council members voted in favor of motion. GENERAL DISCUSSION - 1. Cities-County Meeting, City of Pocatello at noon, the 25th day of May, 1994. 2. Special Council Meeting was set for May 17th., 1994 at 5:00 p.m. Council will discuss Secondary Water System in City. Larry Perkins, Perkins - Thurgood and Jim Wrigley, First Security Bank will be present. At 7 :30 p.m., Councilman England moved, Councilman Wood seconded, with full council approval to adjourn meeting. i Ron C. Conlin, City Clerk n CALL OF SPECIAL MEETING CITY OF CHUBBUCK Pursuant to Idaho Code Section 50 -604, the undersigned Mayor of the City of Chubbuck, Idaho, hereby calls a special meeting of the City Council to be held at the Chubbuck Municipal Building, at the hour of 6:00 p.m. , on Tuesday, the 10th. day of May, 1994. The object of the special meeting shall be to 1) Approval of April 26, 1994 Council Meeting Minutes. i) Poppy Days Proclamation. 3) Liquor, wine and Beer License Application - Oxbow Rest. and Lounge. 4) Ordinance - Change the time of written testimony. 5) Ordinance. - Delete interest charged on Reserve Strips. 6) Ordinance - Adopt a more recent Uniform Fire Code. 7) Ordinance - Cable Rates. s) Business License Application - Allstate Ent. retail sell of tools, stereos, watches and phones at the Days Innm. 9) Computer print- out claims. 10) Resolution - Street weeper.
