Minutes of the Regular Meeting of the Board of Trustees of the Village of
Chubbuck, held in the Municipal building of the Village of Chubbuck on August 11,1964.
Present - Worsencroft, Hillman, Underwood, Christensen, Ward and McDevitt.
Called to order 8:00 PM.
Minutes of the last Regular Meeting then read and approved as read.
Bills for the Month- Worsencroft explained that in order to save time at the
Meetings, some of the Board Members would go over all the bills with the Clerk, and
if there is any doubt about any of the bills, the ones that are in doubt would be
discussed at the Meeting before any approval of payment.
Financial and Police reports for the month presented to Board.
Garbage Truck - Worsencroft explained that on August 3, 1964, the Clerk was
requested to send out notices of offering to sell the Garbage Truck to small
Villages in the southeast section of the State. The Board of Trustees of the
City of Paul, Idaho sent three of their members here to inspect the 'Truck on
August 8, 1964. On August 11, 1964 they called Worsencroft and offered to bur
the Truck for $!,650.00. Motion to accept this proposition from Paul, Idaho
was made by Ward, seconded by Underwood. All were in favor.
Fire Truck - Worsencroft explained that on August 9, 1964, a meeting of E1
Volunteer Firemen was held at the Green Triangle to discuss the various problems
of the Fire Department. Their main concern was the Fire Truck , they believe
that it is too old and we need a better Truck. The Fire Truck belongs to the
Snake River Mutual Insurance Company,, and they are responsible for the Maintenance
of the Truck. The Village furnishes the Volunteer Firemen. Snake River Mutual
Insurance Co. has promised many times in the past to get a better Truck for
Chubbuck, but they have never carried out their promise. After a discussion among
the Board Members, it was decided that Worsencroft talk with the officials of
the Insurance Co. and see if we can't get more cooperation from them. All Board
agreed that Worsencroft proceed with this decision. It was also requested by the
Volunteer Firemen that they are in need of 6 Hard Hate and 3 Waterproof Coats
for the Firemen to wear when fighting fires in the Winter. Motion to approve
purchase of the 6, Hard Hats and I Waterproof Coats was made by Hillman and
seconded by Christensen. All were in favor. (The Village already has 3 Coats).
Streets- Worsencroft explained that the Village is not always able to hire
equipment for street maintenance when it is needed. Underwood and Worsencroft
have been doing some checking on this matter and asked Mr. McIntosh of the
G K Machinery Co. to present to the Board some of their findings. Mr. McIntosh
was present and had pictures of some of the used equipment he has on hand.
For the time being, the only way the Village could be interested in this
equipment would be on a rental basis. Such equipment was not included in the
currbnt budget and therefore could not be purchased at this time. The piece of
equipment most suitable to Village needs is a Motor Grader AC AD 40 with Snow
Wing. Serial No: Mid 1952. Engine G M Diesel Rebuilt 1963. Sale Price $5,000.00.
After discussion, the Board requested that Mr. McIntosh make a formal proposition
with a lease agreement and final payment date to be December 1965. There will be
no action on this matter until the Board has adequate time to study the formal
proposal.
Complaint from Briscoe Lane Property Owner - Mrs. Darlene Leer,owner of Property
at 319 Briscoe Lane complained of trouble with neighbors. Board advised her to
check with the Clerk, register her complaint, and the Village will help where ever
they can. She was asked to come to the Board Members Table and explain just what
her complaint was about. She stated that the owner of property at 307 Briscoe
has complained to neighbors and possibly Hensley that he did not approve of the
number of animals, conduct of the individual tenants, or anything in general of
the tenants of 319 Briscoe. At one time the resident of 307 Briscoe rented the
pasture of owners of 319 Briscoe and never did pay any rent for the 7 months
his livestock was pastured there, and he complained when he had to move his horses
off the pasture at 319 Briscoe so the owners of the property could rent the
pasture to some one else. In conclusion she hated that if the owner of 307 Briscoe
does straighten out his own mess of animals , she will sell her property to just
anybody, whether they be desirable neighbors or not desirable neighbors.

Safety Hazards- Rex Christensen of Lucky Ave. complained that the safety
hazards existing there, have not been corrected and as a result he cannot get
any FHA loan to complete a Brick Home he is building on Lucky Ave. The safety
Hazard in question is on the property of Troy Galloway. The Board had given
Galloway an extension of 90 days to correct the Hazard. The extension deadline
is August 15, 1964. So far, there has been no permanent foundation for the
Building to the west. The center tuilding has been removed, but the other building
has not been made liveable, nor has it been removed from the property. The original
owner and seller of the lot has offered them $3,000.00 for the lot, which is the
price they paid for it, and another party has offered them $2,000.00 for the
buildings, and they have refused both offers. After discussion, it was the decision
of the Board, that the Village is to sign a complaint against them, cite them into
court and have them give their r4asons for non - compliance of the Village request.
Operation of Taverns- Proposed Ordinance # 62 was read in full by McDevitt.
Worsencroft then asked for discussion on the Ordinance. Attorney Clark Gasser,
representing Redwood Garden, Myrtles Place and Five Mile Inn, then explained to
Board that the taverns in Chubbuck are in competition with other areas of the
County.He stated that the points to consider are Paragraph 12-C and 14. These
paragraphs pertain to the hours restricting sale of Beer for consumption on
the premises, which are from 1:00 A M on Sunday Morning to 7:00 A M on Monday
Mornings. Worsencroft explained that the Sunday Business is getting out of hand
and the Village must maintain law and�,,order.A long discussion followed and the
Tavern Owners that they have a trial period of at least 90 days, during which
time they would hire and pay themselves for an extra deputy, and it would not
cost the Village anything in extra wages. They would try to handle any trouble
or disturbances occuring in their places of business. Hillman in expressing his
opinion of the Ordinance stated that if the Tavern Owners can handle their own
trouble, then they should be allowed to stay open on Sunday as they really need
that Sunday Business to stay in operation. He further stated that he does not
think that any church should enter in to this. He can run his business without
` fights and he thinks the other Tavern Owners can do the same. Ward in expressing
his opinion stated that if you have a business that cannot operate without Sunday
business, then you should get into another type of business. The Tavern Owners
have had a couple of chances to comply with the wishes of the Board, and still
nothing has changed, so the Board must take action. Christensen stated that he
is in favor of closing the Taverns on Sunday and he is sure that Sunday closing
will eliminate the existing problems. Mrs. Hageman explained that the Chubbuck
Taverns cannot compete with Pocatello Taverns because we do not have drop -in
trade out here. This is entirely drive -out trade. Hillard Jones asked if this
matter could not be put to a vote of the people.Underwood explained that he did
not have too much comment to make, and he was not sure any church can tell the
Board how to act. Motion to suspend the rules, read once yep full, and twice by
Title then made by Ward, seconded by Christensen.Roll Call Vote for suspension
of the rules, Ward -yes, Christensen yes, Hillman -no, Underwood - abstained from
voting, Worsencroft -yes. Proposed Ordinance # 62 then read twice by Title by
McDevitt. Roll Call Vote for Passage of Ordinance ## 62, Ward -yes, Christensen -yes,
Hillman-no., Underwood- abstained from voting,Worsencroftryes. The motion to vote
for Passage of Ordinance ## 62 was made by Ward, seconded by Christensen, and
the Roll Call Vote was then called. Some of the Tavern Owners then expressed
their willingness to sell their business to anybody, whether the buyers were
desirable persons, or not desirable persons. Petitions against Ord. #65t are on file.
B&D Excavating, Bill Ridley- His bid for excavating for the correction of
the four hook -ups on Briscoe property, and also property he is in the process
-- of selling, located off the 5400 hundred block of Yellowstone, was $240.00.
He billed the Village $250.00 for the job. He owes the Village $140.00 for work
done on his property near the intersection of W. Chubbuck Rd. and N. Afton.
This work was done by the Village during the Village Clean -up campaign. He wants
the Village to discount this bill to $100.00, then the Village can withhold $100.00
from his check and send him the balance of $140.00. Board all agreed that there
should be no discount, the Village is to deduct the $140.00 from his check and
send him the balance of $100.00. It was also brought out in the discussion that
Ridley, still has not complied with the request of the Board that he remove or
fix up the safety hazard that exists at his property on W. Chubbuck Road. The
house there is not in a safe condition, has not been closed in, and is a, threat
to safety of children who play in the area, and also to the valuation of
surrounding homes and properties.
Proposed Ordinance # 63- Read in full by McDevitt. After a discussion on the
Proposed Ordinance # 63, a motion to suspend the rules, read once in full and
twice by Title was made by Ward, seconded by Christensen. Roll Call Vote for
suspension of the rules, Ward -yes, Christensen -yes, Hillman -no, Underwood -yes and
Worsencroft yes. Proposed Ordinance #63 then read twice by Title by McDevitt.
Motion to vote for passage of Ordinance # 63 then made by Christensen, seconded
by Worsencroft. Roll Call Vote for Passage of Ordinance # 63 , Ward -yes,
Christensen -yes, Hillman-no, Underwood -yes, and Worsencroft -yes. Clerk will have
both Ordinance # 62, and Ordinance #63, published as soon as all necessary
signatures are affixed to the Ordinances.
