Chairman Peter Anderson: Commission Members: Dan Stoddard, Morris Kinghorn, Ron Horner, Jason Mendenhall. City Staff: Steve Smart, Paul Andrus. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 pm. Anderson asked if any commissioners had a conflict of interest within the items before the board tonight. Horner led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of July 8, 2014 meeting be approved as mailed; Horner seconded. The full authority approved. NOTICE OF PUBLIC HEARING 1. An application by Bobcat Properties LLC, 1360 Albion Avenue, Burley, ID 83318 for Residential Infill Planned Development (PUD) for multifamily housing units. Project location is 207 Briscoe Road, Chubbuck, ID 83202. Rodney Burch, Dioptra, 4737Afton Place, Chubbuck, ID 83202 is here to represent the application. Burch has an ownership interest in this property. This property is a 1 acre piece of ground that is currently zoned General Commercial (C2). Density calculation allows 18 units on this property and the application is requesting 12 units, not trying to obtain maximum density. Buildings are turned to face the interior of the project rather than facing the parking lot to create more of a neighborhood feel. The common area will have picnic tables and tall trees. The PUD ordinance requires 10% in open space. This project has 44% of the property dedicated to open space. One item lacking in the development is that every unit does not have a 10x10 private space. There are three reasons why that space will not be provided. • Trying to eliminate back yard use and bring the families to the common and community area. • These are 2 story units so the upper units would have to have an elevated deck. • The floor plans for these units have the bedrooms in the back so there is no rear access out of these units. Home Owners Association will maintain the common area with river rock and maintenance free landscaping where the drainage will be. Comprehensive Plan directs growth in the urban infill areas making them usable parcels. The current home on this property is owned by Bobcat and has had a $20,000 remodel and will be used as a rental property. Horner asked about parking. Anderson asked for consideration in making the common area a concrete slab. Burch is not opposed to looking into. Holmes asked if there is a problem with backing out onto the collector, Briscoe Road. City staff sees no problem with backing out of the parking spaces. Anderson opened the public hearing for public comment. No public comment so the hearing was closed and brought back to the commission. Mendenhall does not have a problem waiving private space for individual units but the common area needs more than just grass. Anderson entertained a motion to approve or deny the Infill PUD. Mendenhall moved the commission approve the application by Bobcat Properties, LLC for Residential Infill Planned Development (PUD) for multifamily housing units. Project location is 207 Briscoe Road, Chubbuck, ID 83202, waive the requirement for the 10x10 private spaces for each unit, including a requirement to look into changes made to the common area. Kinghorn seconded. Roll Call Vote: Stoddard, Yes; Kinghorn, Yes; Horner, Yes; Mendenhall, Yes; Anderson, Yes. Motion carries and will go before the City Council in September. An application by Bobcat Properties LLC, 1360 Albion Avenue, Burley, ID 83318 for Bobcat PUD Preliminary Plat. Located in NW % Section 3, Township 6 South, Range 34 East, of the Boise Meridian in the County of Bannock. The subdivision will be between Briscoe Road and Belva Lane. Rodney Burch, Dioptra, 4737 Afton Place, Chubbuck, ID 83202 is here to represent the application. PUD only applies to the 3 buildings but at the city's request the existing home as part of that document. Belva Lane on the south is 25' wide but on the west side it is only 20' wide. The west side will be dedicated so Belva Lane will be 25' on both sides. Utilities will be stubbed off of existing lines. Curb and gutter will be wrapped around parking areas that will be paved. There is no delivery system for irrigation. No questions from commission. No comments from city staff. Anderson opened the public hearing for public comment. No public comments so the public hearing was closed and brought back to commission. This is a recommendation to City Council. Kinghorn made a motion to recommend approval to City Council the plat as presented for this property between Briscoe Road and Belva Lane for Bobcat Properties, LLC. Horner seconded. Located in NW % Section 9, Township 6 South, Range 34 East of the Boise Meridian in the County of Bannock. The property is next to Philbin Road and 1 -86. Stuart Ward, Dioptra, 4737Afton Place, Chubbuck, ID 83202 is here to represent the application. The request is to annex 31 acres of land south of Park Meadows Subdivision, along 1 -86 and Philbin Road. McNabb family owns 23.5 acres and The Academy Charter School owns 7.5. Request to stay Agricultural (A) by the McNabb family. Utilities stop at the canal and servicing by city utilities will not be a problem. No comments or questions from the commission. Comments from city staff Smart let commission know there is not a requirement by ordinance to cover the canal on the property. Anderson opened the public hearing for public comment. Mike Popovich representing the First Baptist Church, 408 North Arthur, Pocatello, ID 83201. The church owns 17 acres directly north, wanting to make sure there is not an issue with them building in the future. Holmes does not see an issue. No other public comment. Public hearing was closed and brought back to the commission. Anderson entertained a motion to recommend to the city council. Mendenhall made a motion to recommend to the City Council to approve the annexation of the property located in NW % Section 9, Township 6 South, Range 34 East of the Boise Meridian in the County of Bannock. The property is next to Philbin Road and 1 -86. Zoning will stay Agricultural (A) and the Urban Service Boundary be extended to include this property. An application by The Academy Charter School, 240 East Maple Street, Pocatello, ID 83201 for a Conditional Use Permit for a school. Located in NW % Section 9, Township 6 South, Range 34 East of the Boise Meridian in the County of Bannock. The property is next to Philbin Road and I- 86. Stuart Ward, Dioptra, 4737Afton Place, Chubbuck, ID 83202 is here to represent the application. Schools are not permitted in any zone but are conditionally permitted in any zone. Request is for a Conditional Use Permit be allowing a school in an Agricultural (A) zone. No comment from city staff No questions or comments from commission. Anderson opened the Public Hearing for public comment. No public comment so the hearing was closed and brought back to commission for discussion. Holmes explained the developer wants to make sure everything is in place. The Conditional Use Permit approval can be stated in the motion. Anderson is concerned that a Conditional Use Permit is issued before the plans are reviewed so a request could be made to review when site plans and building plans are ready. Commission needs to have some control. Burch was given permission to comment. Construction drawing will have to go before city staff for approval. Construction needs to start by October 15 or they will have to wait until next year to build. This is a zoning issue to be able to build a school. Hal Jensen, Architect, 2365 South Fairway Drive, Pocatello, ID 83201 is the architect on this project. Jensen informed commission of some of the plans for the school. • building will be 2 story with 49,000 square feet • 42 parking spaces • the approach into the school has been designed by Rocky Mountain Engineering • 4 to 4.5 acres will be developed • 1 to 1.5 acres for green space and the playground • approx. 550 students, kindergarten thru 8th grade Anderson reminded commission that the Conditional Use Permit is approval or denial. Mendenhall made a motion to approve Conditional Use Permit for the property on Philbin Road and 1 -86 for The Academy Charter School with the following conditions: • The permit does not go into effect until after the final approval from City Council for annexation and the extension of the Urban Service Boundary. • Zoning requirements being approved by City Council before permit is allowed. • Site plan for development be brought back to Land Use Commission for review. An Application by The Academy Charter School, 240 East Maple Street, Pocatello, ID 83201 for The Academy Preliminary Plat. Located in NW % Section 9, Township 6 South, Range 34 East of the Boise Meridian in the County of Bannock. The subdivision is next to Philbin Road and 1 -86. Stuart Ward, Dioptra, 4737Afton Place, Chubbuck, ID 83202 is here to represent the application. Utilities lines will move down Philbin Road and stub into McNabb property for the Charter School. There are 2 lots for this plat, with the main lot being the Charter School. The northwest corner next to the plat is where the city has requested be dedicated for public right of way. Staff has let the developers know that they will be required to develop the street frontage for the street coming off of Philbin Road to access their property. Undeveloped portions of lot 1 would not require the street to be constructed along the north frontage. Alpine Avenue will run from Hawthorne Road to Philbin Road in the future so the right of way corridor needs to be preserved. McNabb would also rely on the Alpine Avenue corridor for their development needs. Ward commented that an agreement will be drawn up with McNabb and the 66'x655' area will be dedicated as the city staff is requesting. Anderson opened the Public Hearing for public comment. Gerald McNabb, 12973 North Philbin Road, Pocatello, ID 83202 owns the 23.5 acres. Utilities and Fort Hall irrigation water have been provided. Intent is for Alpine Avenue to connect with Philbin Road. Support the idea and are in favor of what the school is doing. No further public comments. Anderson closed the Public Hearing bringing the meeting back to the commission. This is a recommendation to City Council. Kinghorn asked McNabb if he is ok with dedication of the 655'. McNabb will cooperate with what the needs are. Motion made by Kinghorn to recommend to City Council the approval of the plat as presented with the addition that the 66' of right of way be dedicated as right of way along the north boundary of this property. Mendenhall seconded. Roll Call Vote: Stoddard, Yes; Kinghorn, Yes; Horner, Yes; Mendenhall, Yes; Anderson, Yes. Motion carries and will go before the City Council in September. Mendenhall suggested the general business be moved to the September agenda. Anderson entertained a motion to adjourn; Mendenhall made the motion. Kinghorn seconded. All voted to adjourn at 8:16 pm.
