AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ADDING SECTION
9.20. 100 TO ALLOW ANY RESIDENCE TO HAVE UP TO SIX CHICKENS;
PROVIDING STANDARDS FOR THE KEEPING OF SAME; ADDING SECTION
9.20.110 REGARDING BEES; REPEALING PRIOR CONFLICTING ORDINANCES;
PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE IS EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
The following Sections 9.20. 100 and 9.20.110 are hereby adopted:
9.20. 100 Chickens. Notwithstanding any of the provision of this chapter, the keeping of
not more than six (6) domestic hen chickens (but no roosters) is permitted within the rear yard of
any single family dwelling or duplex located in a residential zone, provided the following
requirements are observed;
(1) Such hens shall not be slaughtered on the premises or raised or sold for slaughter
or pecuniary gain or profit.
(2) For the purposes of this subsection, the term "rear yard" means a residential yard
lying between the rear lot line and the nearest foundation line of the main building
and extending across the full width of the lot. In the case of a corner lot where the
building fronts on a side street, the rear yard may be established from the rear of
the house to the side property line.
(3) Chickens shall be kept in an enclosed area within fences, corrals, barns, pens,
coop, or other similar enclosure which shall serve to contain them, both on the
sides and from flying out the top.
(4) Chickens enclosures must comply with setback requirements.
(5) Chickens shall be kept so as to not cause adverse impacts on neighboring
properties. This includes, but is not limited to, such impacts as odor, noise,
drainage, erosion, and insects. The presence of such impacts can constitute a
public nuisance that the City may cause to be abated.
9.20.110 Bees. Bees shall not be considered "Animals" or "Livestock" as defined in this
Chapter and the keeping of the same shall be governed by the provisions of this Code regarding
nuisances.

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City and any provision of the Municipal Code which are in conflict with the provisions of this
Ordinance are repealed to the extent of such conflict.
Section 2. Severability. The sections of this ordinance are severable. The invalidity of
a section shall not affect the validity of the remaining sections.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication.
