Cotant, Jr., Councilmen Dwain King, horn, Jack Menard, Earl Romriell, Attorney Don Burnett and Clerk Vera Armstrong. Meeting called to order at 5:10 p.m. REZONING 0RDINANCE.~¢I60 - Attorney Don Burnett read Ordinance ~160 in full which consists of rezoning property owned by William Armstrong, 5039 Yellowstone, Lot 22 Block A, Mobile Manor Addition ~1 and the Agricultural Transitional property owned by Land Investments lying east of the railroad tracks and south of East Chubbuck Road. Councilman Menard moved the rules to read ordinance on three separate days be suspended. Councilman Kinghorn seconded motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, no. A discussion followed on the necessity of rezoning Land Investments property. The public hearing notice, letter requesting rezoning and minutes of action taken by Planning, Zoning Commission and City Council were reviewed. It was determined the property could not be rezoned Light Industrial as the request for rezoning was to a Mobile Home Residential -2 Zone and not Industrial zone. Councilman Kinghorn moved to strike Section 3 and renumber Section ~ as Section 3. Councilman Romriell seconded motion. Roll call vote: Kinghorn, yes; Menard, no; Romriell, yes. Councilman Romriell moved Ordinance ~160 as amended~be adopted. Councilman Kinghorn seconded motion. Roll call vote: Kinghorn, yes; Menard, no; Romriell, yes. Attorney Barnett agreed to ~rite a letter to Kent J. Parrish, President of Land Investments, Inc. explaining the reason for striking Section 3 from rezoning ordinance above. POLICE C~R ENGINES - Mayor Cotant informed council Chief Stone had advised him two new Ford engines were available for purchase through Denny's Tune-Up and Alignment. Mayor Cotant and Council members were unanimously in favor of buying the engines. COUNCIL MEETING FOLLOW-UPS - Mc Omber Sewer Line Pole Line and Hawthorne Disanne×ation Parrish Sewer Line - Parrish Co. Store Kunz Waterline Easement Rex Christensen Sewer Easement Variance request of Mobile Manor on lots facing Hiline Road. Matter to be placed on next Planning and Zoning meeting agenda. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: Armstrong Property. That the following described lands and property within the boundaries of the City of Chubbuck, Idaho, presently owned bM William Armstrong and Phyllis Armstrong (husband and wife), be re-zoned and changed from General Commercial (C-3) in part and Combined Residential (R-2) in part, to General Commercial (C-3) in the entirety: A tract in the northeast quarter of the southwest quarter of Section 3, Township 6 South, Range 34 E.B.M., in Idaho, particularly described as follows, to-wit: Beginning at the northeast corner of the South 23 rods of said northeast quarter of the southwest quarter of Section 3, run thence west along the north boundary line of the James E. Harrington et. al. property, described in that certain deed recorded in Book 99 of Deeds, Page 506 of the Records of Bannock County, Idaho, a distance of 438.5 feet, run thence at right angles in a northerly direction a distance of 85 feet, run thence at right angles in an easterly direction, parallel with the north boundary line of the Harrington tract above referred to, a distance of 438.5 feet to the east boundary of the said northeast quarter of the southwest quarter of Section 3, run thence in a southerly direction along said east boundary line a distance of 85 feet to the Place of Beginning. Subject to any ditches or laterals or other rights of way upon, over or across said lands as the same now exist, and particularly subject to the right of way for the Yellowstone Highway. SECTION 2: Mobile Manor First Addition.
