Council Meeting Minutes
October 22, 2013
7:00 p.m.
Minutes of a regular Council Meeting held at the City Council Chambers, October 22, 2013,
Present: Mayor Steven England, Council Members: Josh Ellis, Kevin England, Brent Marshall,
Kermit Morrison, Attorney Thomas Holmes, PW Director Steve Smart, Clerk Rich Morgan.
The meeting was called to order at 7:00pm by Mayor Steven England.
The Pledge of Allegiance to the Flag was led by Carson Croxall, BSA Troop 317.
Approval of Minutes. Council Member England moved to approve the regular meeting minutes
of October 8, 2013. Council Member Marshall seconded. Roll call vote: Ellis -yes, England -yes,
Marshall -yes, Morrison -yes.
Public Hearing on Ordinance #728 amending 18.24.050(F) nonconforming uses of structures
or of structures and land in combination. Steve Smart explained nonconforming uses.
Nonconforming uses are uses that are not in harmony with the zone they are in. In the City we
have several residential homes in commercial zones. This is a nonconforming use. In the current
economy, lenders will not lend on residential properties in commercial zones with the current
paragraph (f) in our ordinance. Paragraph (f) does not allow a nonconforming structure to be
rebuilt if over 60% destroyed.
Mayor England opened the public hearing, there being no comment Mayor England closed the
public hearing.
Ordinance #728 amending 18.24.050 nonconforming uses of structures or of structures and
land in combination.
Council Member Ellis moved to waive the rule an ordinance must be read on three different
occasions one being in full. Council Member England seconded. Roll Call Vote: Ellis -yes,
England -yes, Marshall -yes, Morrison -yes.
Council Member Ellis moved to adopt Ordinance #728. Council Member Morrison seconded.
Roll Call Vote: Ellis -yes, England -yes, Marshall -yes, Morrison -yes.
Computer print out claims for October 22, 2013 were presented to the Mayor and Council.
Council Member England moved to approve the claims as published. Council Member Marshall
seconded. Roll Call Vote: Ellis -yes, England -yes, Marshall -yes, Morrison -yes.
At 7:22pm Council Member Morrison moved to adjourn. Council Member Marshall seconded
and the full Council approved.
