ORDINANCE NO. 291
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
SECTIONS 15.04.010 AND 15.04.020 OF THE CHUBBUCK MUNICIPAL
CODE TO ADOPT DIVISION I OF CHAPTER 7 TO THE APPENDIX OF THE
UNIFORM BUILDING CODE AND MAKE THE SAME APPLICABLE TO COVERED
MALL BUILDINGS WITHIN THE CITY; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS
OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND
PROVISIONS OF CHAPTER 15.04 NOT HEREIN AMENDED SHALL REMAIN
IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Amendment to S§15.04.010 and 15.04.020 of the
Chubbuck Municipal Code. Sections 15.04.010 and 15.04.020 of the
Chubbuck Municipal Code are amended to read as follows:
15.04.010 Adopted. A certain document, three copies of
which are on file in the office of the city clerk, Chubbuck
city offices, being marked and designated as Uniform Building
Code, 1985 "Edition, published by the International Conference
of Building Officials, including Chapter 7, Division I of the
Appendix thereto, is adopted and incorporated by reference in
this chapter.
15.04.020 Procedure for adopting future editions.
Future editions of the Uniform Building Code may be adopted,
as the same are published from time to time by the
International Conference of Building Officials, by resolution
of the mayor and council of the city. Such resolution shall
identify with particularity the edition of the Uniform
Building Code so adopted and shall recite that it is adopted
pursuant to this chapter. Unless specifically stated to the
contrary in the text thereof, such resolution shall have the
effect of adopting the future edition and any appendices
or standards previously adopted by ordinance.

Section 2. Repeal of Conflicting Ordinances. The provisions
of any Ordinance of the City of Chubbuck, Idaho, and any provision
of the Chubbuck Municipal Code which are in conflict with the
provisions of this Ordinance are hereby repealed to the extent of
such conflict. All other sections and provisions of Chapter 15.04
not herein amended shall remain in full force and effect.
Section 3. Severability. If any provision of this ordinance
is held invalid, for any reason, by any court of competent
jurisdiction, such holding shall not affect the validity or
enforceability of any of the remaining provisions.
Section 4. Effective Date. The rule requiring an ordinance
to be read on three separate days, one of which shall be a reading
in full, is hereby dispensed with, and this Ordinance shall become
effective upon its passage, approval and publication as provided
by law.
