HomeMy WebLinkAbout0169 Local Planning Commission 1976 ORDINANCE NO. 169 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING ORDINANCES NUMBERED 77 AND 108, ENACTED ON MAY 28 , 1968 , AND MAY 9 , 1972 , RESPECTIVELY, TO INCREASE FROM SEVEN TO NINE THE NUMBER OF MEMBERS OF THE CITY PLANNING COMMISSION; SPECIFYING TERNS OF AND QUALIFICATIONS FOR OFFICE; PROVIDING THAT ADOPTION OF THIS ORDINANCE SHALL NOT PRECLUDE THE CITY FROM SUBSEQUENTLY RESTRUCTURING THE COMMISSION AS REQUIRED BETTER TO PERFORM ITS FUNCTIONS OR TO COMPLY WITH STATE LAW; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1: Ordinance No. 108 of the City of Chubbuck, Idaho, enacted on May 9, 1972 , which modifies Ordinance No, 77 enacted on May 28 , 1968 , is hereby amended at Section 1 as follows : SECTION 1: That Section 1 , subparagraph 1-2 of Ordinance No, 77 of the City of Chubbuck, Idaho, passed on the 28th day of May, 1968 , be modified to read as follows : MEMBERSHIP : The Planning Commission shall consist of seven nine members to be appointed by the Mayor with the consent and approval of the Council, one of which members shall be a member of the Council, provided further that one member appointed shall also be a member of the Bannock County Planning Committee or similar intergovernmental planning agency, i TERMS OF OFFICE: The Member who is a member of the Council shall serve for an indefinite time at the pleasure of the Mayor and other members of the Council. The other such members shall serve as follows : three four of such members shall serve for a term of two years and three four members shall serve a term of four years, the respect vi e terms of office to be determined by lot at the first meeting held after the effective date of this Ordinance. As between the two additional offices created by this amendatory ordinance, the determination of which shall have an initial term of four years and which shall have an initial term of two years, will be accomplished by lot at the first meeting held after the effective date ofi this amendatory ordinance. Thereafter the term of office or each appointive member shall be for four years. 9 D D O Z mA RESIDENCE REQUIREMENTS : One member of the Commission o � may be a non-resident of the City of Chubbuck who resides > IZ within one mile of the city limits of the City of Chubbuck; all " I other members shall be residents ase -taxpayers of the City of Chubbuck. Section 2 : Adoption of this ordinance shall not preclude the City from re-structuring the Commission by subsequent ordinance as required to enable it better to perform its functions or to comply with the laws of the State of Idaho. Section 3 : The rule requiring ordinances to be read on three separate days is hereby dispensed with, and this ordinance shall become effective upon its passage, approval and publication as required by law.
