HomeMy WebLinkAbout05 13 1975 CMCOUNCIL MEETING MINUTES - May 13, 1975 199 Minutes of the regular council meeting held in the City Municipal building -ti May 13, 1975• Present : President of Council Wayne Taylor, Councilmen Jack Menard and Earl Romriell and Clerk Vera Armstrong. Mayor Cotant, Councilman Kinghorn and Attorney Burnett excused. President of Council Wayne Taylor asked for corrections or additions to minutes of April 22 and May 6 meetings.' Councilman Romriell suggested the wording be changed to "nature of the subdivision itself" instead of "nature of the problem itself" under heading WATER LINES - HEIGHTS SUBDIVISION - in May 6 minutes. Councilman Menard made this motion and he was in agreement to this change. There being no other corrections, minutes were approved. PUBLIC HEARING ITEM - HEEGHTS SUBDIVISION REZONING -, Dave Clark represented Clark Real Estate in the request of rezoning the proposed Heights Subdivision to a Residential - 2 zone with the exception of lots bordering the park areas which they are requesting be zoned Residential -3 zone. Area presently zoned A -T. Council reviewed the rezoning request. Councilman Romriell felt the proposed four plex development should be scattered throughout the development. Murray Lane was present and voiced the same feeling. However, others present seemed to feel it be best the four plex development be in the same area around the parks. Councilman Menard moved the Heights Subdivision, presently zoned Agricultural Transitional be rezoned as follows; Lots 7, 8, 91 10, 11, 12 and 13, Block 5 and Lots 1, 2, 3, 4, 5, 6, 7 and 8, Block 11 be rezoned to Residential -3 and the balance of the subdivision be rezoned to Residential - 2. Councilman Taylor seconded motion. Roll call vote: Menard, yes; Romriell, no; Taylor, yes. PUBLIC HEARING ITEM - Paul Matthews, 410 James is requesting a variance to allow him to construct a six foot high fence of lumber construction on the west side of his property five foot inside curb line from the back of house north to the property line. This is a corner lot at the intersection of Stuart and James. P & Z commission have recommended granting variance. Councilman Romriell moved the council approve the variance request of Paul Matthews to construct a six foot lumber fence as outlined in diagram. Council- man Menard seconded motion with all councilmen voting in favor. PUBLIC HEARING ITEM - ANNEXATION OF PROPERTY TO CITY LIMITS - The council is holding this public hearing to consider annexation of property which lies north of West Siphon Road in the 300 block, the largest portion of this property belongs to Archie Cutler, 320 West Siphon Road. Councilman Romriell moved the city annex the legal described area as proposed and published, that the zoning be Residential - 2 Livestock and for Attorney Burnett to draw up an ordinance to include the annexation and zoning. Councilman Mrnard seconded motion with all councilmen voting in favor. HEIGHTS SUBDIVISION - Tim Shurtliff, engineer and Dave Johnson, Clark Real Estate expressed concern over city requiring them to install eight and ten inch water lines in Heights Subdivision and paying the entire cost of same. FINANCIAL STATEMENT presented to Mayor and Council. CLAIMS PRESENTED to council and were reviewed. Councilman Romriell moved the claims be approved with the exception of payment of claims to Idaho Power for damage to pole by vehicle driven by Keith Kroger in the amount of $409.01 and the claim to SA -SO Inc. in the amount of $271.16 for badges for police de- partment. Councilman Menard seconded motion, all councilmen in favor.
