Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard, Earl Romriell aud Wayne Taylor, Attorney Burnett and Clerk Vera Armstrong. Councilman Kinghorn moved the meeting of March 25 be adjourned, Councilman Taylo~ seconded motion with all councilmen in favor of motion. Meeting called to order at 8:00 p.m. by Mayor Cotant. Mayor Cotant asked for corrections or additions to March 25 minutes. Councilman Romriell moved the minutes of March 25 meeting be approved as written. Councilman Kinghorn seconded motion with all councilmen in favor. PU~,IC HE~RING IT~: Robert and Karen Kennedy are requesting a variance to operate their business of Cust6m Drapery at 5122 Hawthorne Rd which is Residential -2 zone. After reviewing request and P & Z recommendation Councilman Kinghorn moved the council grant this variance on a yearly basis, providing the Kennedys keep all rules including parking and sign rules required in zoning ordinance. Councilman Menard seconded motion with an unanimous vote in favor of motion. PU~,IC HEARING ITEM: Francis R. Beck requests a variance which will allow him to construct a four foot high chain link fence across the front of his property and along the east side of his property at 761 West Chubbuck Road. After review Councilman Romriell moved the council approve the variance allow- lng Mr. Beck to construct a four foot high chain link fence across the front and east side of his property. Councilman Menard seconded motion. All council- men voted in favor of motion. DIP AT TAHOE AND BONANZA INTERSECTION - Lee Belnap ~58~ Tahoe requests the deep dip at this intersection be corrected possibly by the widening of same. Mayor Cotant told Mr. Belnap the city would review this situation and do what seems necessary to correct problem. CIRCLE IN MOBILE PARK REVIEW - John Murray and Charlie Frasure were present to re- view their park development. Mayor Cotant told Mr. Murray and Mr. Frasure the sanitation pick-up seems to be a problem in their park. Mr. Murray and Mr. Frasure told council they preferred the individual pick up system and would go through the court and request those living in the park to keep their cars off the street and any other requirement that would help the pickup of sanitation in the individual containers. Mayor Cotant also asked when they planned to construct their screening fences as required. Mr. Murray and Mr. Frasure told council they plan to install the fence this summer. Mr. Murray asked if they could use the city sweeper or hire city to sweep their streets. After some discussion Attorney Burnett advised council he felt the city should not provide the service if the equipment is available elsewhere, if it is not, the city might provide the service but should charge the regular rate. S~NER SERVICE LINE-PRIMITIVE BAPTIST CHURCH - Council reviewed a request of the Primitive Baptist Church for the city to provide a sewer service line to the church from Lucky Street. The service line is on Adams. The council determined the church should use the service line provided on Adams Street. SEWER SERVICE LINE AT 251 BRISCOE - Gary Archibald bought the house at this address aud is repairing the house to live in. There is not a sewer service line to the property and Mr. Archibald has questioned if city will provide this service. After some discussion Councilman Romriell moved the city see to it that this sewer service line is provided at 251 Briscoe Rd. and Mr. Archibald pay the bac$ sewer rate Sf $9.80 since January l, 197~ and for the city to check out the engineers responsibility of installing this line. Motion died for lack of~ second. Matter tabled for further study with engineer. This issue discussed (cont'd) 181 SE~ER SERVICE LINE AT 251 ERISCOE -(cont,) - at length after arrival of engineer. Council agreed for Mayor Cotant to take care of this decision as he sees fit. LITTLE LEAGUE BASEBAI~ PROGRAM - Frencis R. Beck reviewed the baseball program with the Mayor and Council. Mr. Beck said they wo~uld like to add two more teams this year for a total of 12 teams. Mr. Beck introduced Tim Jackson as president of the league. Mr. Beck told the council the league would like to award first place team and best sportsmanship trophies each for the younger te~m group and older team group. Games to start May 20 and end July 3rd. Mr. Beck stated the league would like to pay $5.00 per game to umpire and would like approval to buy two additional trunks for storage of uniforms. Mr. Beck said they need additional practice area and Mayor Cotant told Mr. Beck he would contact school officials and find out if area at Chubbuck elementary school is available. ' The league also requests the backstop be extended on larger diamond and small field needs worked ~ with more sand. Councilman Menard moved the city participate as requested in the Chubbuck Little League Baseball program. Councilman Taylor seconded motion with all councilmen voting in favor of motion. PU~IC HEARING IT~: C. Roger Seaton has requested a variance to allow the devel- opment of a 168 unit Mobile Home Park on the west side of Hiline Road and lying immediately south of the present Mobile Home Estates development. C. Roger Seaton, Clarence W. Smith, architect, and Beverly Bistline were present on behalf of request. Doug Jensen, city engiueer, explained to council a definite problem with present water system. However, Mr. Jensen said when city installs the 12 inch ~ater line from railroad tracks to Whitaker Road and a six inch looped line be provided to the park, the park coulc~ be served.. The park will require an eight inch water line. Mr. Jensen ~lso stated the park would need a sewer lift station to be served by Chubbuck sewer system. Mr. Jensen said he felt the city might want a city dedicated street running north and south through the park development and that water, sewer, curb, gutter and street drawings need to be provided and approved prior to issuance of a permit to start construction. The ordinance requires natural screening. Counc~ad Menard suggested the zone be changed if the development is allowed. Mayor Cotant stated he felt the area was a good location for the development ora mobile home park. A lengthy discussion followed as to the city water supply. ~ayne Taylor moved the council accept the variance request for approval of development of the Mobile Home park. For lack of a second the motion died. Attorney Burnett noted if council makes a policy decision to require the area be zoned Residential -2 Trailer zone and then grant variance from a Residential 2-T zone, the city will be protected from further demands in Agricultural Trassitional zones for trail? delelopment. An extended discussion followed on water supply and the rezoning proposal. Mr. Seaton and Mr. Smith told co~n~cil they would not request a zoning change and another variance request~an~ that they desire an answer this evening. Councilman Menard moved the counc~ approve the v~riance request of C. Roger Seaton to develop a Mobile Home Park on the west side of Hiline Road and lying '~m~m~ediately south of Mobile Manor Estates~ with all stipulations spoken of adhered to and providing recommendations of engineer be followed. Councilman Taylor seconded motion. Voting was unanimous in favor of motion. APPLICATION FOR BUSINESS LICENSE - Gary Long has made application for a business license to operate the business of skirting trailer homes from his truck. Councilman Romriell moved the business license be issued with the following ' restrictions: That no zoning requirement be violated and business be done from his truck only with no inventory other than what will be contained in the truck. Councilman Kinghorn seconded motion and the voting was unanimous. HEIGHTS SUBDIVISION - Rodney Clark, Dave Johnson and Tim Shurtliff presented the Heights Subdivision tentative final plat. Council reviewed the revised plat. Co~nc~_man Menard moved the tentative Heights Subdivision plat be approved for final plat preparation. Counc~man Taylor seconded motion. All councilmen voted in favor o£ motion. The subdivision property needs to be rezoned prior to filing of plat and develop- ment · PARADISE ACRES SUBDIVISION - Dean Lloyd, President of Northgate Development and Doug Jensen, engineer presented the final plat of Paradise Acres for council approval. Council reviewed the final plat. Councilman Menard moved the Paradise Acres final plat be approved and for Mayor Cotant to sign. Councilman Kinghorn seconded motion. Voting was un- animous in favor of motion. Councilman Romriell asked if the 110%~ surety bond is going to be required. The surety bond requirement was discussed with no action of any kind. O~DIN~NCE ~1~3 - Declaring weeds a nuisance read by title only by Mayor Cotant as second reading. O~DINANCE ~1~8 - Regulating the business of peddling and peddlers read by title only by Mayor Cotant as second reading. FINANCIAL CLAIM presented to Mayor and Council. CLAIMS to be paid in April presented to Mayor and Council. Council reviewed same. Councilman Menard moved the claims be approved for payment. Counc~_man Taylor seconded motion with an unanimous vote in favor of motion. Mayor Cotant declared the meeting adjourned at 11:55 p.m. Vera C. Armstrong, City Cler~ Addition to Minutes: 1. Jack Menard stated he would like added~ the reason he wanted the Seaton proposed mobil home court rezoned to R T -2 was that it is now zoned A T, the city's highest zoning. Attorney Burnett asked to have added, He wou/d further say, if councdl does not want to use R T-2 classification as an interim , as planniug device, then variance should be granted directly.
