January 28, 1975
Minutes of the regular meeting o£ the mayor and council held in the city municipal
building January 28, 1975.
Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard, Earl
Romriell, Attorney Don Burnett and Clerk Vera An~strong.
Councilman Romriell moved to adjourn the January 16 meeting. Councilman Menard
seconded motion with all councilmen in favor of motion.
Mayor Cotant asked for any corrections or additions to January iA and Januar~y 16
minutes. Councilman Romriell requested the following additions under heading -
COMPLAINT AGAINST DENNY JONES - Councilman Kinghorn remarked the reason the city
has been lenient is because Mr. Jones had made promises to council that he
would do something about his situation.

Attorney Burnett recommended the existing land use of Denny's 0il be discontinued
as to any conflicting use and any future land use comply with the city zoning.
Councilman Romriell moved January iA minutes be approved with additions. Councilman
Menard seconded with an unanimous vote in favor of motion. Councilman Menard moved
January 16 minutes be approved. Councilman Romriell seconded motion with an
unanimous vote in favor.
F,~RE PROTECTION - Mayor Cotant informed council he and Chief Jones had met with
American Falls and Bannock County Commissioners on requesting reimbursement for
expenses incurred as a result of Chubbuck Volunteer Fire Department answering
county fire calls.
SUNSHINE INITIATIVE - Attorney Burnett advised mayor and counc~ he felt the mayor
should register as lobbyist and supplied application blanks.
PUBLIC HEARING - It was noted Rodney Parrish had requested the public hearing on
delinquent sewer charges for the Parrish Company store be taken off the agenda
as neither Max or Rodney Parrish could attend this meeting. Public hearing
was re-scheduled on Feb~nary 11.
ORDINANCE~ 1~2 Mayor Cotant read Ordinance ~142, Amending Section 3 (c) of Ordinance
~q-29 to specify that deposits held in the "Sewer Service Deposit Fund" shall be
refunded when a satisfactory payment record has been established.
Councilman Romriell moved to dispense with rule of reading on three separate days.
Councilman Kinghorn seconded. Roll call vote: Kinghorn~ yes, Menard; yes, Romriell,
yes.
Councilman Menard moved to adopt Ordinance ~l&2. Councilman Romriell seconded
motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes.
Attorney Bturnett requested the city clerk send a signed copy of Ordinance ~42
to the Department of Housing and Urban Development.
Jt~{RY'S 4-Wh~.EL~R - Attorney Burnett informed council he had sent a letter 6o Jerry
Tydeman re~esting him to cease operating his business a% his place of residence
on Hiway Avenue.
ANTENNA - Mayor and Council discussed the antenna installed on Jerry Tydeman's
house. Attorney to research this further.
ONEIDA INVESTM~T vs City of Chubbuck - Attorney Burnett informed mayor and council
he had not received the deposition on the hearing he attended in Boise with
Joseph Wise yet. Attorne~ told council he plans to request the case scheduled
for February 6 be continued.
BLUE ~{OSS INSURANCE INCREASE - Mayor and Counci~ discussed increasing board and
room coverage on employee insurance. Insurance coverage now pays $50.00 room and
board per day. Hospital room and board costs have increased to approximately

$75~00 per day. Insurance premium to increase coverage to $70.00 per day will
will cost ~ ~ $~.00 per month~ $2.00 per month on employee coverage and iS2.00
permonth for family coverage. Counc~lman Kinghorn moved the city approve
paying the employee coverage for the increase if the employees approve[ paying
the family increase. Councilman Romriell seconded motion with all councilmen
voting in favor.
TRAFFIC, SAFETY AND BEAUTIFICATION - Dave Higbee, Chairman has requested to attend
a Safety conference in Boise on February 19 and 20th. Cost to the city for Mr.
Higbee to travel to Boise for this con£erenc~ will be approximately $80.00.
Councilman Romriell moved the council authorize Mr. Higbee to attend the conference.
Councilman Kinghorn seconded with an unanimous vote in favor of motion.
UTILITY ACCOUNTS - City clerk asked mayor and council for permission to adjust
approximately $600.00 in bad utility accounts over the past eighteen months.
Council .~id not approve adjusting these accounts but requested the clerk to
file these accounts with the small claims court.
WAT~PRESSUREAT STUART PARK WM~J,- Councilman Kinghorn explained to council the
problem of pressure valve not working at Well ~2. Councilman Kinghorn also
suggested a power shut off be installed on~.al~el~houses for. pumps as a safet~
