HomeMy WebLinkAbout010.01.13City of Chubbuck Land Use and Development Commission Meeting Minutes October 1, 2013 - 7:00 p.m. Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on October 1, 2013. Chairman Peter Anderson: Commission Members: Jay Buttars, Morris Kinghorn, James Eborn, Jason Mendenhall, Bryan Nield. City Staff: Steve Smart, Paul Andrus. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 pm. Nield led the commission in the Pledge of Allegiance. Anderson asked if any commissioners had a conflict of interest within the items before the board tonight. APPROVAL OF THE MINUTES: Anderson entertained a motion to approve the minutes as mailed. Kinghorn moved the minutes of September 3, 2013 meeting be approved as presented; seconded by Eborn. The full authority approved. PUBLIC HEARING: An application by Living Waters Christian Fellowship Church, 840 Swisher Road, Pocatello, ID 83204 for a Conditional Use Permit to allow a church to be built in a General Commercial (C2) zoned area located at 4883 Valenty Road, Chubbuck, ID 83202. Pastor James Gregerson was in attendance to represent the application. The previous building on that property had to be demolished. The congregation has been raising funds to rebuild the church. They are here tonight to get permission to build. No questions from the commission. No comments from city staff. Holmes commented a member of the public ask if the 5 Mile Bar was a problem being so close to the church. There is a State of Idaho code that restricts liquor establishments within 300'however ones that are existing are not a problem so there is no issue. No questions for city staff from the commission. Anderson opened the meeting for public comments for and against the application. No public comments. Anderson closed the Public Hearing bringing the meeting back to the commission for consideration. Anderson reminded the commission that this is a Conditional Use Permit and the decision stays with the Land Use commission. The drawings show it will be frame construction. Kinghorn asked the pastor for the average attendance. Pastor Gregerson stated in the winter it is between 50 and 60, in the summer between 30 and 40. The parking lot at the new church will allow 165 spaces. Mendenhall made a motion to recommend approval of the Conditional Use Permit for The Living Waters Christian Fellowship Church; 840 Swisher Road, Pocatello, ID 83204 to build in a General Commercial (C2) zoned area located at 4883 Valenty Road, Chubbuck, ID 83202. Seconded by Nield. Roll Call Vote: Buttars, Yes; Kinghorn, Yes; Eborn, Yes; Mendenhall, Yes; Nield, Yes; Anderson, Yes. Motion carries. Anderson entertained a motion to adjourn until the next meeting that is scheduled for Wednesday November 6th because of Election Day on Tuesday November 5th; Kinghorn made the motion.
