HomeMy WebLinkAbout12 07 1978 CM Land Use Public Hearing PUBLIC HEARING LAND USE AND LAND DEVELOPMENT ORDINANCES December 7, 1978 Minutes of the public hearing meeting on the Land Development and Land Use Ordinances held in the municipal building December 7, 1978, a recessed meeting of November 30. Present: Mayor JOhn O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, LeRoy S. Quick, Engineer Steven M. Smart and Clerk Vera C. Armstrong. Councilman Earl L. Romriell excused. Mayor Cotant called the public hearing to order at 6:45 p.m. A lengthy discussion was held concerning a cash contribution to withstand the additional burden on the city of growth from commercial and industrial developments, Land Development Ordinance, Chapter 4, page 33. Attorney Burnett prepared the following: "When the city council finds that the proposed development will impose a demand which is specifically attributable to that development for a particular type of facility, equip- ment or service in order to protect the public health, safety and welfare, the developer shall be required to dedicate the facility or equipment to the city or to contract with the city to provide funds for the service. The council shall state its finding together with reason therefor and the developer shall have the opportunity to address the council in this respect." Mayor and council proposed the above be added to Chapter 4, Parks and Recreation Lands, page 33, Land Development Ordinance. LAND USE ORDINANCE - Mayor and council discussed the need for some fence requirements in the Land Use Ordinance. SECTION 3-5, Land Use Ordinance, page 23, it was proposed by Mayor and Council that two new paragraphs (e) and (f) be added~to read: (e) Except where screening or buffer fences are otherwise required or authorized by the ordinance, no fence shall be constructed more than six (6) feet in height. (f) No structure, fence, object or vegetation shall be constructed, placed, allowed to grow, or permitted to remain at any location where it naturally obscures line-of-sight vision from a street or vehicular way to any point within ten (10) feet along a back-out driveway or to any point within thirty (30) feet along an intersecting street or'~ehicular way. NON-CONFORMING USE - Attorney Burnett, Mayor and Council discussed non-conforming used in residential areas with no changes proposed. Meeting adjourned at 9:15 p.m. Vera C.
