Minutes of the public hearing held on the Land Development Ordinance held
No~ember 30, 1978, a recessed meeting of November 16, 1978.
Present: Dwain A. Kinghorn, LeRoy S. Quick, Boyd L. Fullmer, Attorney
Donald L. Burnett, Engineer Steven M. Smart. Earl L. Romriell attended
from 7:20 p.m. until meeting recessed. Mayor John O. Cotant, Jr. excused.
Meeting called to order at 7:00 p.m. by Councilman Kinghorn.
SECTION 3-4, Paragraph (f), Subparagraph (6), page 24, proposed change at
November 16 hearing should be amended to read "crack control" instead of
"crack controlled"
SECTION 3-4, paragraph (g), subparagraph (2), page 24, proposed change at
November 16 hearing should be amended to read "base course" instead of
"course base~
SECTION 3-4 paragraph (g), subparagraph (3), page 24, proposed change at
November hearing should be amended to delete the last word "membrane"
in sentence.
SECTION 3-4, paragraph (h), subparagraph (2), line 6, page 25, to correct
typographical error of word "approval" should be "approved".
SECTION 3-4, paragraph (i), subparagraph (3), line 5, page 26, Add word
"Standard" in parenthesis to read "(Standard Proctor)" and delete
balance of sentence "of undisturbed excavated trench materials."
SECTION 3-4, paragraph (i), subparagraph (5), line 2, page 27, delete word
"gravel".
SECTION 3-4, paragraph (k), subparagraph (2), line l, page 28, Item Pipe, after word "ductile" delete word "pipe" and substitute "iron pipe, Class
50," and line 5 and 6, delete wording in parenthesis "(iron or cast iron only."
SECTION 3-4, paragraph (k), subparagraph (2), page 29, Item -Minimum Depth Pipe Cover, delete "4 feet" and substitute "5 feet".
SECTION 3-4, paragraph (k), subparagraph (3), page 30, delete "(Proctor)"
and substitute "Standard Proctor". and delete balance of sentence "of
undisturbed excavated trench materials".
SECTION 3-5. paragraph (h), line 3, page 31, after work compacted add "by a method approved by the city engineer" to the .... .
SECTION 3-5, paragraph (i), subparagraph (2), line 2, page 31, delete "six (6)" and substitute "eight (8)".
SECTION 3-5, paragraph (1), page 33, Add new paragraph (1) and number (1)
to (m). New paragraph (1) to read: "If the city engineer determines the
public facilitie~ or facilities to be dedicated to the public, are being
damaged in the course of the development, the engineer may issue a
directive to the responsible parties that development work cease until the
damage is repaired and safeguards adopted to prevent further damage,
parties adversely affected by such directive shall be entitled to hearing
under procedures analogous to those provided with respect to stop
work orders in the Uniform Building Code as adopted by the City, the City
may enforce the engineer's directive in the manner provided in the same
Code."

SECTION 3-6, paragraph (a), line 2, page 33, add word "particular" to read "that particular improvements".
SECTION 3-6, paragraph (a), line 6, page 33, add words "or site" to read
"development or site in question".
SECTION 3-6, paragraph (b) page 33, delete title of paragraph "Inspections"
and substitute title "Compliance" and line'same paragraph, delete
"inspection shall" and substitute "city engineer shall cause the inspection
to" be conducted ...... .
SECTION 3-6, page 33, Add new paragraph (c) titled "Inspection Fees",
paragraph (c) to read "Where the city finds it necessary to utilize the
specialized equipment or to engage the services of outside consultants
the city may be reimbursed for those costs."
The above proposals were approved by council to be included in the final
draft of the Land Development Ordinance. Attorney Burnett was instructed
that in addition to the specific 'hanges which the council has agreed to
propose, that the city attorney is also authorized to draft those additional
changes which reflect discussion of matters on which no specific agreement
was reached but where there was a consensus that additional language in
the ordinance be included, e.g. reserve strip, fence restrictions, etc.
Councilman Quick moved, Kinghorn seconded, with council approval to recess
public hearing meeting until December 7, at 6:30 p.m.
