HomeMy WebLinkAbout09 26 1978 CMCOUNCIL MEETING MINUTES 155 September 26, 1978 Minutes of the regular council meeting held in the city municipal building September 26, 1978. Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr., Engineer Steven M. Smart and City Clerk Vera C. Armstrong. Meeting called to order at 8:10 p.m. Mayor Cotant asked for corrections or additions to minutes of September 12. Councilman Romriell requested an addition to his motion approving the K Subdivision ~ ' ] final plat; motion to read~'~hat curb and gutter requirement be waived because of grade and drainage problems." Councilmen Quick and Romriell asked for an explanation to be added to the amended motion not to require sidewalk on East Chubbuck Road~ to be added~ "the reason being that Mr. Forsgren was required to give an eight foot setback on East Chubbuck Road for a collector street and that sidewalk would not be practical until such time as Chubbuck Road is widened." Councilman Romriell also asked for the following addition to agenda item- American Litter Foundation - Mr. Noble told council he was trying to get additional federal funding, however, Mayor Cotant suggested trying to acquire local funding for project. Councilman Kinghorn moved to approve September 12 minutes as amended. Councilman Quick seconded motion with all councilmen voting in favor. WHITAKER ROAD - Speed Dips or Speed Checks - Mayor Cotant suggested inviting the residents living on Whitaker Road into a council meeting to discuss the possible construction of speed dips on Whitaker Rd. PUBLIC HEARING CONCERNING SALE OF CITY PROPERTIES - The city passed and approved Ordinance #190 on August 15, 1978 regarding the sale of city properties, and setting a hearing date for any protests concerning these sales. Public hearing scheduled for this council meeting. No person or parties were present to protest. Mr. Del Bunce was the only Chubbuck resident present and he remarked the plan sounded good and would be a marked improvement for the city. Date for the bond sale was discussed and the date set for November 14, 1978, STREET SWEEPER - The insurance adjuster has asked the city to sign a third party release concerning the accident involving the street sweeper. Engineer Smart said the release would be for property damage only on the sweeper. Mayor and council discussed an appropriate settlement price for the sweeper. Engineer Smart and Councilman Fullmer to follow thru on this request, HOT OIL STORAGE TANK - Engineer Steven Smart informed council the State Highway department in Rigby has a hot oil distributor storage tank listed for sale in their surplus equipment. Engineer Smart also told council he would like to purchase a small hot mix patching machine. Councilman Romriell moved to approve for Engineer Smart to attend the surplus sale at Ribgy and purchase a used hot oil distributor storage tank if he feels the price is right. Councilman Fullmer seconded motion, voting was unanimous in favor. HOT OIL-MIX PATCHING Machine - Engineer Smart discussed with Mayor and council the purchase of a hot oil mix maintenance machine. After some discussion, Councilman Quick moved for city to purchase a hot oil maintenance patching machine. Councilman Kinghorn seconded motion with all councilmen voting in favor. POLICE POLICY - Attorney Burnett, Chief Stone, Mayor and Council reviewed a new police policy in it's entirety. The city has been studying the policy the past several month. Several changes were agreed upon, Attorney Burnett will make these and the policy will again be reviewed. PUBLIC HEARING ON LAND USE ORDINANCE AND LAND DEVELOPMENT ORDINANCE Mayor Cotant called the hearing to order at 10:30 p.m. Councilman Romriell moved to recess the public hearing until Tuesday~ October 3, 1978, at 6:30 p.m. Councilman Fullmer seconded motion with full council approval. WATER~ SEWER, SANITATION RATES - Mayor and Council discussed the amending of the water, sewer and sanitation rates with no definite decisions being made.
