Minutes of the recessed meeting of August 8, 1978 held in the city municipal
building August 15, 1978.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain
A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart and City Clerk Vera C. Armstrong.
AREA OF IMPACT - Councilman Romriell suggested the city arrange a meeting
with Bannock County and the City of Pocatello concerning the area of
impact. Mayor Cotant said he would contact the county and arrange a
meeting.
PARRISH STORE DELINQUENT SEWER BILL - Councilman Kinghorn suggested the city
take action against the Parrish Company Store concerning the delinquent
sewer bill. Mayor and other council members agreed the city should
proceed with some final action on this matter.
PIGS IN CITY - Mayor and Council read the letter from Dean Morgan requesting
the city consider allowing pigs in the city, by amending the ordinance.
Mayor and council discussed amending the ordinance to allow pigs in the
city and after thoroughly discussing the matter, they voiced support for
the present ordinance which does not allow pigs in the city.
Mayor Cotant said he would write a letter to Mr. Morgan and invite him
to the August 22 council meeting.
SURFACE WATER DRAINAGE EASEMENT - Attorney Burnett has prepared an agreement
for an easement concerning the drainage that is necessary for development
of the Mountain Park Subdivision. The easement would be on property owned
by Land Investments Inc. Attorney Burnett is to review this easement with
Max Parrish.
OBDINANCE #190 Expressing an intent to sell certain described parcels of
real property owned by the city, etc., was read in full by Mayor Cotant.
Councilman Romirell moved to dispense with the rule of reading ordinance
on three separate days. Councilman Fullmer seconded motion. Roll call
vote: Fullmer, yes; Kinghorn, yes; Quick, yes; Romriell, yes.
Councilman Kinghorn moved to adopt Ordinance #190 as read. Councilman
Quick seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes;
Quick, yes; Romriell, yes.
ASSESSMENT ROLL AND REPORT ON THE BURNSIDE LOCAL IMPROVEMENT DISTRICT #1
Attorney Burnett reported to mayor and council the necessary steps to
conclude the Local Improvements District #1 project. Mr. Burnett
estimated it would take at least 60 days to have hearing on the assessment
roll, prepare ordinance confirming assessment roll, prepare and pass ordinance
on bond sale and notice, and close transactions after bond sale.
Councilman Quick moved to accept engineer's report and assessment roll
on the improvements specified for Local Improvement District #1, Chubbuck
Idaho and to fix the date, time and place, the city council will hear
and consider objections to the assessment roll as 8:00 p.m., Tuesday,
September 5, 1978. Councilman Kinghorn seconded motion. All councilmen
voted in favor.

PUBLIC HEARING -Mayor Cotant called the public hearing to order on the
adoption of a Land Use Ordinance and Adoption of a Land Development
Ordinance at 9:30 p.m.
A lengthy discussion followed on the requirements concerning Production
Homes in courts and outside courts. Also the land uses in the various
zoning districts were considered, the mayor and council being very
concerned about the more detailed land uses recommended by the Planning
and Zoning Commission, if more land uses listed in ordinance might loosen
the control. Council also discussed and questioned the responsibility
of the city in controlling commercial type development in industrial
zones. No specific changes were recommended.
Councilman Romriell moved to recess the public hearing at 10:45 p.m.
until after the regular council meeting agenda items at the regular
city council meeting September 12, 1978. Councilman Quick seconded
motion with all councilmen voting in favor.
Councilman Kinghorn moved, Fullmer seconded, with all councilmen approving
that council meeting adjourn at 10:50 p.m.
