COUNCIL MEETING MINUTES
July ll, 1978
Minutes of the regular council meeting held in the city municipal building
July 11, 1978.
Present: President of Council, Councilman Earl L. Romriell, Councilmen Boyd
L. Fullmer and LeRoy S. Quick. Attorney Donald L. Burnett Jr., Engineer
Steven M. Smart, City Clerk Vera C. Armstrong. Mayor John O. Cotant, Jr.
and Councilman Dwain A. Kinghorn excused as they are attending the AIC
Conference in Sun Valley.
Meeting called to order at 8:10 p.m. by President of the council Romriell.
President of Council Romriell asked for any corrections or additions to
council minutes of June 27.
Councilman Fullmer moved to approve council minutes of June 27 as written.
Councilman Quick seconded motion with an unanimous vote in favor.
MERRELL SUBDIVISION - GENERAL DISCUSSION - Max Merrell and Keith Merrell
asked if city would grant a building permit with a written provision that
the Merrell's would share in the expense when stree~ is improved and
developed.
A long discussion followed concerning the above request. Attorney Burnett
informed council an agreement could be entered into whereby Mr. Merrell could
contribute to a fund on a prorated basis to equal what improvements would
cost.
Keith Merrell asked if he could present a bond in the amount of the required
improvements. Attorney Burnett said this could probably be worked out also.
President of council Romriell asked about his plans for sewer service. Keith
Merrell said he had checked with county and they will issue a permit for a
septic tank and drainage system if city would approve.
President of council Romriell said perhaps the city would participate in the
first 185 feet of the street, including sewer and water, and then if the
Merrells would finish the next 400 ft. of street with the subdivision, the
problem would be solved.
The possibility of an imposed Local Improvement District was discussed.
Attorney Burnett told council he felt that a Local Improvement District
could be declared and that Mrs. Fenwick's cost might be less because of
her cost of giving the property for the street.
Councilman Fullmer said if he had a piece of ground and wanted to build,
he would seriously consider an L.I.D.
President of council Romriell asked Engineer Smart to work up some cost
figures of a Local Improvement District and Mr. Romriell would present
the proposal to Mrs. Fenwick.
Councilman Quick said he felt the council would really be overstepping the
line to make any agreements not in line with subdivision requirements.
Mr. Max Merrell asked if he could buy the property from Mrs. Fenwick, which
lies on the east side of Tree Valley Rd then would the city require Mrs.
Fenwick to subdivide the balance of her property. He was told that she
probably would be required to subdivide the balance of her property, but
she could submit a proposal shoeing detailed plat on portion sold and
planned for development at present time and the balance could be considered
as an additional phase to be developed later.

told council the Merrell subdivision had been tabled at the P & Z meeting
and he would like the council to give some direction to the Planning and
Zoning as to the ultimate position it would put the city in for future
development along Tree Valley Rd if Merrells request were granted.
Councilman Romriell asked council if they would be in favor of pursuing
a Local Improvement District. Councilman Fullmer and Quick said they
would be in favor of a Local Improvement District development at this
particular location.
Attorney Burnett informed council that it would not take long to take
steps to declare a Local Improvement District.
No further discussion, Engineer Smart to work up cost estimate of the L.I]D.
and Councilman Romriell to present proposal to Mrs. Fenwick.
ORDINANCE #190 expressing intent to sell certain parcels of city property was
read by title only by President of council Romriell. This reading was
considered as the second reading.
PURCHASE OF PROPERTY - Farrell Poole was present to discuss the sale of his
property to the city. The council assured Mr. Poole the city does plan to
purchase the property, however, council questioned the interest proposed in
the proposal.
Attorney Burnett told council the city would need to lease the property
with a purchase option. The credit with the first years rent being paid
as liquidated damages, if city should default. Attorney Burnett told council
the purchase needs to be entered into by the Mayor with approval of council,
also if city leases, the property remains in private ownership and it will
be taxed.
Attorney Burnett was instructed by the council members present to draw up the
lease with the purchase option.
Claims to be paid in July presented to council.
After claims were reviewed, Councilman Quick moved to approve the claims,
Councilman Fullmer seconded motion with an unanimous vote in favor.
Councilman Fullmer moved, Quick seconded, with council approving that meeting
be adjourned at 10:45 p.m.
