ON LAND USE ORDINANCE

Public notice has been given that the Chubbuck City Council will hold a
public hearing this evening on the adoption of a Land Use Ordinance which
sets forth zoning classifications of land Wi'thin the city and sets forth
permitted and conditionally permitted uses thereof, and which serves in
part to implement the provisions of the comprehensive plan, pursuant to the
Local Planning Act of 1975.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, LeRoy S. Quick, Attorney Donald L. Burnett, Jr., Engineer Steven
M. Smart and City Clerk Vera C. Armstrong. Councilman Kinghorn excused
from meeting at 9:00 p.m.
Public Hearing called to order by Mayor Cotant at 8:15 p.m.
Mayor Cotant proceeded to read the ordinance in its entirety.
The following changes, some of which have been recommended by the Planning
and Zoning Commission at their hearings, were recommended and agreed upon.
Page 2, Chapter 1, Section 1-5, subparagraph (h) line 2, add word "structure"
after dwelling.
Page 2, Chapter 1, Section 1-5, subparagraph (n) lines 4 and 5, the
language "complete, including major appliances and" be stricken.
Page 5, Chapter 2, Section 2-1, subparagraph (c) lines 3 and 4, the
language "and production dwellings in courts." be deleted and line 4,
add at the beginning of the third sentence "Production dwelling courts,".
Page 5, Chapter 2, Section 2-2, lines 9 thru 12, the words "such conflicts
shall be eliminated by revising district boundaries upon application of
land owners or upon transfer of title to affected properties, by sale,
gift, testamentary disposition or any form of conveyance" be stricken
and the following be substituted: "such conflicts shall be eliminated by
ordinance, following transfer of title to property or request from the
landowner (s), when the City Council finds such action is timely for
orderly transition of affected neighborhood (s)."
Page 6, Chapter 2, Section 2-3, subparagraph (b) lines 7 and 8, the
words "the Mayor, upon consultation with, "be stricken.
GENERAL DISCUSSIONS to be considered later in ordinance. l) Fences over six foot being a structure.
2) An alternate procedure of approving production dwellings.
3) Consideration of conditional uses of mobile units as office units.
4) Convenience stores located in neighborhood commercial zones with
bright lights to close at early hours.
Councilman Quick moved to recess public hearing meeting at 10:40 p.m.,
and reconvene July ll, after completion of the items on the regular
council meeting agenda. Councilman Fullmer seconded motion with an
unanimous vote in favor.
